HomeMy WebLinkAbout2002-08-13 Regular Meeting Agenda CITY OF ANNA REGULAR MEETING OF THE CITY COUNCIL The City Council of the City of Anna will meet in Regular Session at 7:30 p.m., Tuesday, August 13, 2002, at the Anna City Hall, located at 120 W. 4th Street, to consider the following items: 1. Call to Order. 2. Roll Call. 3. Citizen’s Participation. 4. Consider Ordinance No. 2002-?? accepting TXU gas rate change. 5. Consider Ordinance No. 2002-?? relating to bonds proposed to be issued and delivered by the Greater Texoma Utility Authority, approving the issuance thereof, and the facilities to be constructed, acquired, and improved by such Authority, and repealing the Ordinance No. 202-05 adopted March 26, 2002. 6. Consider and take action as desired regarding presentation on back flow prevention policy by Mr. Earl Spencer. 7. Consider and take action as desired regarding presentation on out of City water rate policy by Ms. Doris Haker. 8. Consider amendment to Planned Development 2001-01 (Sandra Bryant). 9. Consider recommendation regarding final plat of Tara Farms, Phase 4. 10. Consider action on ordinance defining masonry as an exterior building material in building construction. 11. Consider action on Ordinance No. 2002-?? adopting the 2001 International Building Code. 12. Consider action on Ordinance No. 2002-?? adopting the 2001 International Plumbing Code. 13. Consider action on Ordinance No. 2002-?? adopting the International Energy Code. 14. Consider action on Ordinance No. 2002-?? adopting the International Housing Code. 15. Consider action on Ordinance No. 2002-?? adopting the International Mechanical Code. 16. Consider action on Ordinance No. 2002-?? adopting the International Property Maintenance Code. 17. Consider action on Ordinance No. 2002-?? adopting the 1994 Uniform Code for the Abatement of Dangerous Buildings. 18. Consider Resolution No. 2002-?? authorizing execution of an ultimate boundary line agreement between the City of Weston, Texas, and the City of Anna, Texas. 19. Consider Resolution No. 2002-?? requesting that Texas Department of Transportation include construction of an interchange at or near the intersection of CR 370 and U. S. Highway 75. 20. Consider action on request by Mr. ????? Piper for location of underground drainage structures on City right-of-way in front of property at ????? Thousand Oaks Drive. 21. Budget Workshop. 22. Minutes. 23. Bills. 24. Staff Reports. 25. Adjourn. COMMENTS ON AGENDA, AUGUST 13, 2002 4. TXU gas rate change Council voted to accept the rate change as presented by TXU at your meeting of July 9. TXU requests that this action be formalized through adoption of the attached ordinance. 5. GTUA bond ordinance This ordinance has the effect of reducing the 1.25 revenue to debt service coverage factor contained in current bond resolutions. Mr. Jerry Chapman of GTUA will be here to discuss this item. 6. Back flow prevention policy TRNCC regulations now require back flow protection devices on all commercial property that has possibility of contamination of city’s water supply. The devices must be tested yearly. Mr. Earl Spencer of Spencer Plumbing, Inc., will be present to discuss this item and offer a proposal to the City. A copy of information regarding this item is attached. 7. Out of city water rates Ms. Doris Haker has asked to discuss this item with the council. 8. Planned Development 2001-01 (Sandra Bryant) Property owner of property located at ??? N. Powell Parkway has requested a revision of the Planned Development zoning of the property. The zoning originally included two buildings, each containing two offices and two apartments. The property owner has constructed one of the buildings and now requests an amendment of the PD to remove the second building. The PZC unanimously recommends approval of the request. Information regarding this item is attached. 9. Final plat of Tara Farms, Phase 4 This final plat is consistent with preliminary plat. The City’s consulting engineer has identified one issue for which a variance is required. The City’s Subdivision Ordinance requires an 8” sanitary sewer in residential subdivisions. The City has permitted 6” sewers in the remainder of the Tara Farms subdivision and the engineer has no objection (per telephone conversation with Tim Morris on July 31, 2002) to granting a variance to allow 6” sewers. The PZC unanimously recommends approval of the plat and granting the variance to allow 6” sewers in locations as requested by developer for Tara Farms, Phase 4. Information regarding this item is attached. 10. Definition of masonry The Planning and Zoning Commission has recommended that the council revise the City’s building codes and zoning ordinance to define masonry as brick, stone, and/or stucco. This issue has arisen because of use of Hardie Plank siding in some of the subdivisions in the city. 11-17. Construction Codes The State now requires use of the International Codes for Building, Plumbing, Mechanical, and Energy. The City of McKinney uses the International Building, Plumbing, Mechanical, Housing, and Property Maintenance Codes. McKinney also uses the 1994 Uniform Code for the Abatement of Dangerous Buildings. Since we are using McKinney building inspectors and since most of these codes are now required by the state, I recommend that we adopt the Codes as described in items 11 through 17 on the agenda. 18. Boundary Agreement with Weston Recent conversations with the Mayor of Weston suggest that Weston would like to see a boundary agreement settled between the two communities. The Anna ISD boundary is the East Fork of the Trinity and we have been treating that line as the western boundary of the community for several years. The proposed agreement uses the East Fork as the ultimate boundary across which neither city would encroach. 19. TXDOT interchange at CR 370 The Texas Department of Transportation has indicated that it would entertain a resolution requesting an interchange at or near the intersection of CR 370 and U. S. 75. This resolution would put the City of Anna on record as requesting that the interchange be constructed at the earliest possible date. 20. Storm drain on Thousand Oaks Drive The homeowner has requested that he be allowed to put culvert pipes in the City right- of-way at the front of the referenced tract, which is a one acre lot in Tara Farms. The City’s consulting engineer has raised serious questions regarding the wisdom of this action. The staff and consulting engineer recommend that the council deny the request until such time as the homeowner presents adequate engineering data to convince us that the City will not be creating drainage and maintenance problems by allowing this construction. 21. Budget workship Preliminary budget information will be presented for examination at the council meeting. I strongly suggest that we briefly review this information and set a budget workshop date for later this month to more thoroughly review the information. The budget sets priorities for next year and we need to very carefully review this information. Lee Lawrence Date
