CITY COUNCIL
REGULAR MEETING
The City Council of the City of Anna will meet in Regular Session at 7:30 p.m., Tuesday,
November 12, 2002, at the Anna City Hall, 101 N. Powell Parkway, to consider the following
items:
1. Call to Order.
2. Roll Call and Establishment of Quorum.
3. Consider citizen comments and presentations.
4. Consider presentation regarding Community Development Plan and action to accept
said Plan under terms of contract between City and Texas Office of Rural Community
Affairs and contract between City and Southwest Consultants.
5. Public Hearing: Petition by Mr. Clarence Richardson for change in zoning of 2.5 acres
located in G. Stark Survey, A-0798, Block 1, Tract 41 and Tract 36 (916 – 920 S.
Interurban Street), from Single Family -1 (R-1) to Duplex (R-2).
6. Consider recommendation regarding petition by Mr. Clarence Richardson for change in
zoning of 2.5 acre tract located in G. Stark Survey, A-0798, Block 1, Tract 41 and Tract
36 (916 – 920 S. Interurban Street), from Single Family -1 (R-1) to Duplex (R-2).
7. Consider action on PZC recommendation regarding annexation request by Mr. Mark
Johns for 35.08 acre tract on W. White Street (FM 455).
8. Public Hearing: Petition by Mr. Mark Johns for zoning of 35.08 acres located in Joseph
Schluter Survey, A-0856 (on south side of W. White Street approximately 1,000 feet
west of Slayter Creek) to Planned Development (Single Family Residential and
Commercial).
9. Consider action on PZC recommendation regarding zoning request by Mark Johns for
35.08 acre tract located in Joseph Schluter Survey, A-0856 (on south side of W. White
Street approximately 1,000 feet west of Slayter Creek) to Planned Development (Single
Family Residential and Commercial).
10. Consider action on preliminary plat for Westfield Addition.
11. Consider PZC recommendation regarding annexation of 96.085 acre tract owned by
Soon Chee.
12. Public Hearing: Petition by Mr. Soon Chee for zoning of 96.085 acre tract located in
Thomas Rattan Survey, A-0782 and Henry Smith Survey, A-0823 (on north side of CR
367 adjacent to and east of Throckmorton Creek) to Planned Development (Single
Family Residential).
13. Consider PZC recommendation regarding petition by Mr. Soon Chee for zoning of
96.085 acre tract located in Thomas Rattan Survey, A-0782 and Henry Smith Survey, A-
0823 (on north side of CR 367 adjacent to and east of Throckmorton Creek) to Planned
Development (Single Family Residential).
14. Consider recommendation regarding preliminary plat for 114.252 acre Bradley tract,
located near northwest corner of FM 455 (W. White Street) and U. S. Highway 75 (S.
Central Expressway).
15. Consider recommendation regarding zoning request by Dr. William Weaver for 344.33
acre tract located J. M. Kincaid Survey, A-509, Joseph Boyle Survey, A-105, and John
Coffman Survey, A-197.
16. Consider annexation petition of Mr. Tommy Tompkins for 57 acre tract located on W.
White Street (north side of W. White adjacent to and west of Slayter Creek).
17. Consider recommendation regarding preliminary plat for Anna 57 Acre West Tract.
18. Consider recommendation regarding final plat for The Falls, Phase 1B.
19. Consider action on Garage Sale Ordinance.
20. Consider action on Compromise, Settlement, and Release Agreement between City of
Anna and TXU Electric and TXU Gas.

Gas Company.

4. Community Development Plan
The City received state grant funds to conduct a community planning project. Mr.
Maurice Schwanke gave an abbreviated presentation to the council on this project about
three months ago. You asked him to submit the documents to the state for review and
come back later to make a final presentation. You were given copies of the planning
documents at the earlier meeting. If anyone did not receive a copy, please contact me.
5-6. Clarence Richardson zoning petition – Single Family Residential to Duplex (R-1 to R-2)
Petitioner seeks to rezone the property (see attached map) from Single Family
Residential to Duplex. I improperly advised him that he would need to seek multifamily
zoning when he first discussed this matter with me. Therefore, his formal request was
for multifamily zoning. The PZC recommended approval of a revised zoning request to
Duplex (R-2) zoning, as detailed in the attached ordinance.
7-9. Johns (Tompkins) annexation and zoning (35.08 acres)
PZC recommended approval of annexation of 35.08 acres, owned by Mr. Tommy
Tompkins.
The council tabled action on the 35.08 acre Johns (Tompkins) tract because of last
minute changes in the zoning request. Mr. Tompkins has requested that the original
PZC recommendation be approved. The major features of the ordinance and project
are:
a. Lot size variable but maximum number of lots not to exceed 133.
b. Setbacks
• Side yard – 5’, except 15 feet on corners
• Front yard – 25’
• Back yard – 25’
c. Payment for perimeter sidewalk to be made by developer and to be detailed in
Facilities Agreement
d. Commercial zoning along entire frontage of W. White Street (FM 455).
Commercial to be C-1 except that car wash and restaurant uses would be
permitted and buildings up to 8,000 square feet in size would be permitted.
10. Westfield preliminary plat.
Plat is for 133 lots, based on zoning described in item 9. Copy of preliminary plat is
attached. Landscape and utility easement of 25’ is provided on W. White Street
frontage, which also allows for future expansion of W. White to 130’ right-of-way. PZC
recommended plat approval.
11-13. Chee annexation and zoning (98.085 acres)
PZC recommended approval of annexation of 96.085 acres, owned by Mr. Soon Chee.

PZC recommends approval of zoning of 96.085 acres, owned by Mr. Soon Chee, as
detailed in the attached ordinance. The major features of the ordinance and project are:
a. Lot size to be minimum of 50’ wide and 6,000 square feet total area.
b. Setbacks
• Side yard – 5’, except 15 feet on corners
• Front yard – 25’
• Back yard – 25’
c. Payment for perimeter sidewalk to be made by developer and to be detailed in
Facilities Agreement.
d. Masonry – 70% brick or stone on front and wrap corners with brick along side for
two feet from front of house. In addition, side of two-story dwelling to be at least
50% brick or stone.
14-15. Bradley tract preliminary plat and Weaver tract zoning.
These two items probably need to be examined together because the developer intends
to combine the tracts.
Bradley
The Bradley tract is just over 100 acres and has been previously annexed and zoned.
The zoning includes 50’ wide lots, 27’ street pavement, and allows cementatious
material exterior (Hardie Board). The property owner has agreed to increase street
width to 31’ on the collector streets in the subdivision and modify the use of cement fiber
siding (see attached draft of zoning ordinance for Weaver tract).
In recent conversation with the Mayor, he has raised questions about the street layout
that none of us are probably qualified to answer. He has suggested retaining a traffic
engineer to review the plat prior to final council action. I think that suggestion has
considerable merit.
Weaver

The major features of the ordinance are:
a. Lot size to be minimum of 50’ wide, 90’ deep, and 6,000 square feet total area.
b. Setbacks
• Side yard – 5’, except 15’ on corners
• Front yard – 20’, with porches permitted to be within 15’ of front yard line
• Back yard – 15’
c. Minimum house size – 1,200 s.f.
d. Masonry –
“Exterior building materials for residential structures shall be at least 70%
masonry. “Masonry” means brick, stone, pre-cast stone, cement fiber siding, and
any other similar veneer material attached to an outside wall.
In a residential subdivision that has utilized the “masonry” products of brick, stone,
or pre-cast stone anywhere within said subdivision, any residential structure built
on a corner lot within such subdivision shall be required to contain a minimum
coverage of 100% containing brick, stone, and pre-cast stone of the first floor side
of the residential unit facing any collector street. When utilizing brick, stone, and
pre-cast stone, interior structures (structures not on corner lots), in addition to the

front elevation requirement, shall be required to apply or wrap the corners of the
structures with the brick, stone, and pre-cast stone with a minimum coverage of
two feet on the side extending back from the front corners.”
16-17. Tompkins 57 acre tract annexation and preliminary plat.
Petitioner submitted preliminary plat one week before PZC meeting. Review of plat
could not be completed during the limited time available. Because of need to close
contract on land, petitioner asked that plat be approved conditional on satisfaction of
review comments. Annexation and zoning petitions were not submitted in time to be
placed on PZC agenda.
PZC recommended disapproval of plat since property has not been annexed and/or
zoned.
18. Final plat for The Falls, Phase 1B.
Plat is for 124 residential lots (making total of 155 lots in Phases 1A and 1B). Plat is
consistent with approved zoning and subdivision regulations. PZC recommended
approval of plat.
19. Garage sale ordinance.
Per your request of October 22 meeting, sample ordinance is attached.
20-22. Settlement Agreement and Franchise Agreements with Oncor and TXU Gas
See attached information submitted by Oncor and TXU Gas.
23. Appointments to Park Board.
The Park Board ordinance provides for appointment of up to nine members. Currently
there are five members. The Park Board has recommended appointment of three
additional members, as follows:

Ms. Beverly White
Mr. Ty Chapman
24. Out-of-city water/sewer rates.
You asked staff to provide data on options of annexation and rate changes. The study
has not been completed but we expect to be finished by Tuesday and provide the
information to you at the council meeting.
25. Surface water project engineering commitment.
The City has been asked by Greater Texoma Utility Authority to commit to its share of
the engineering of the Collin-Grayson (Howe to Melissa) surface water line project. The
total cost of engineering will be $200,000 and our share will be $50,000.

The participating cities have not yet been provided cost of water information from GTUA-
Sherman. Unless that information is available by your council meeting, I recommend no
action by the City of Anna on the commitment to pay engineering costs. I will contact
Mr. Jerry Chapman of GTUA prior to the council meeting and have current information
on this matter for you at the meeting.
