ANNA CITY HALL
FEBRUARY 25 , 1997
The City Council of the City of Anna met in regular session
on the 25th day of February 1997 with the following members
present and Participatinq : Mayor , Ron Ferguson, Bob Estep,
Debbie McIntosh, Lisa Copeland , joe Murphy . Duane Hayes was
absent from this meeting .
The meeting was called to order. at 7 : 33 P .m. by ,on Ferquson .
Ron asked for anv citizen ' s participation at this time .
There was no response .
Debbie made motion on the approval A the minutes for
February 11 , 1997 , Lisa seconded. Motion carried .
Alan judkiewiez was asked to come to the table to discuss the
rate increase for Texas Waste Management . Alan was not able
to attend so Alan West and Tommy Pfaft were there to
represent Texas Waste Manaaement . They asked for the annual
rate increase for the CPI , which was 3 . 1% and a 10% increase
on landiill . Alan stated that the total increase will be 46
cents . This 46 cents is broke up by the the CPI and the
landfill . Lisa made motion to approve the rate increase ,
Debbie seconded. Motion carried .
The Council was provided with copies eat Animal Controi
Ordinances tram other cities to review the running at large
dekinition. Joe stated there was a big difference in the
other ordinances . He compared the wording of running at
large. Richardson and Piano states that if you don ' t have
the animal on a leash at least six feet long they will take
the animal . Alien ' s is the same as Anna ' s . Bob stated that
there is a difference deiinino running at large . He also
stated that you cannot detine a dog runninq at large if its
on private Property . He thinks running at large should mean
the animal is running the streets unattended or unsupervised.
They should only be Picked up it there are complaints made .
Bob' s concern is it the animal is in the front yard of your
property and you are in the back yard, the ordinance states
that it the animal is not in direct supervision the Animal
Control Officer has the right to pick the animal up . Joe
stated that he was concerned about the wording also . Debbie
asked it they took the word direct out would that help? joe
apreed that he thought it would work . Betty Adams was one of
the citizen ' s present at this meeting . She stated that by
taking the word direct out this would take care of the
problem. Bob stated that if we can' t come to any other:,
agreement , that by takinq the word direct out would help .

dcat letinq the word direct , Debbie seconded . Motion carried.

having the Animal Control Officer was changed , then could it
be mailed? Debbie stated her concerns about the reqistration
of animals . She said our city does not have the ability to
register animals . Ron read the mailer takinq out the word
direct , added the area codes to the phone numbers and
eliminatinq the registration part . The Council agreed that
the Animal Control OUicer could mail the corrected copy .
Ron stated that on the advise of the City Attorney , Marie has
typed as letter stating the City ' s opinion based on the
Council ' s approval on what needs to be done . Debbie asked if
we were for sure about the law. Ron stated there was no law
about cutting water service off . Lisa asked it she has
called regarding this matter. Ron stated that she called and
left as message the niaht at the February 11th meetinq . She
stated that she was sick and could not make it , but that she
would come up to City Hall the next day to take care at the
problem. Debbie asked it we have heard from her? The City
Secretary stated that we have not . Debbie stated we don ' t
have much choice . joe stated that we did not have the
authority to take away from the rest of the city for one
individual . Bob stated that since it was the cities fault
that she is in this situation , we should put as cut off on the
meter , so when she moves it could be locked up. Debbie
stated that it was Brinna ' s responsibility to pay the water
deposit just like everyone else. Ron stated that when the
water department discovered that her water was still on they
contacted her and she stated she would come down to take care
of it . Lisa thought that if she still was without emplovment-,
that maybe we could have her make two $50 , 00 installments ,
instead of the kull deposit at once . Joe stated we should
give her till April 1 , 1997 . This would give her 30 days to
come up with this . Debbie made a motion that we terminate
the water service as of April 1 , 1997 at 10 a .m. it she
doesn' t come up with the deposit , Lisa seconded. Motion
carried ,
Ron stated that on the tax rate for senior citizens that not
one city in Collin County freezes there city taxes . The City
Secretary stated that there would have to be a software
package desiqned to do this . She also stated that this wouid
take some time to complete . She said that most every town in
Collin County has exemptions tor their senior citizens . Joe
said we need to get this started to show our appreciation to
Che senior citizen ' s . Bob stated that the tax oftice could
work on the software to kreeze the taxes . The Secretary
stated that it would take some time and this had to be turned
into the tax oftice by May 1 , 1997 for the exemptions to be
in effect for the 1997 Year . Joe stated that it we Ove them
as 10 , 000 exemption this would be a $58 . 63 savinqs at our
current tax rate , joe stated that as 5 , 000 exemption would be
insultinq . Bob stated that not tree' ina them would almost be
insulting . ,Joe stated this would be a start , Debbie made a
motion to Me a 10 , 000 exemption to 65 and over citizens ,
joe seconded . Motion carried,,
Bob stated that he wouid like to make a motion to treeze the
taxes for the senior citizen ' s . Ron stated we need to check
the leqai end of this betore we do this . Debbie stated that
Grayson County ireezes taxes , joe stated we also need to
tind out it the city can afford to do this aiso ,
Ron stated that regardinq the approval or the Water & Sewer
bills , industrial Chem Labs sent deareaser that is beina
returned for a credit . Debbie asked it the bill tor TC Home
Repair was an the list . Debbie made a motion that the T(,*
Home Repair bill not be payed because the vendor was not
requested bv the city to do the work and did not do anythina
anvwca,y , Lisa seconded . Motion carried.
Lisa made a motion that we approve the bills with the tw(,,)
exceptions ( industrial Chem Labs and TC Home Repairs ) , Debbie
seconded . Motion carried .
Ron asked the Council to discuss and take action on the
Sexual Oriented Business Ordinance; Bob asked it someone was
askinq to open up a business in this reqard. joe stated that
this is a saa.teguard tar the citv . Debbie did research an
this Ordinance and she stated that she read several ditterent
cities ordinances and this one covered the most .
joe made a motion to accept the Sexual Oriented Business
Ordinance . Lisa seconded. Motion carried.
joe made a motion to accept Ordinance 97-05 as Printed,
Debbie seconded , Motion carried .
Bob wanted to share with the Council some A the research
reaardinq road repair . Bob aDd Mr , Burk drove around the
town to survey the roads . Mr . Burk told him that Riqqins and
interuban were the oniv roads that could be Patched
successfully . It would take 80 tons of asphalt at $69 . 00 a
ton to do this . Mr . Burk suqqested Puttina rock on the road
by the Steel Mili , He could Put a load of road base rock,
from Hwv . 5 to the black top . This would take 15 tons of
rock to do this at $19 . 00 as ton. Then on Haa,ckberry the tirs"t
part of that is bad and he could put 10 tons or rock on that ,
Bob stated Mr . Burk would oniv charqe tar what he uses . Bob
spoke with Edward Powell about the easement tor road repair
on Edwards Street . Edward Powell spoke like he would qo for
this . Bob stated we will need to tind out whether we need
easements or transters or title for this . Mr . Burk told Bob
that Edwards Street miaht as well be Nowed up and start
over .
Ron spoke reqardinq Ricky Dawes statinq that he called him
and asked to come back to work for the city . He said Rickv
stated that he had made a mistake in leavinq and would like
to return . Ron stated that when Ricky lett he oave a two
week notice , he did our reports , he has a DD License and he
knows our system,
joe made a motion to adlourn the meetinq at 9 : 27 P .m—
