ANNA CITY HALL
MARCH 11 ,1997
The City Council of the City of Anna met in regular session
on the 11th day of March 1997 with the following members
present and participating: Mayor
yor Pro Tem: Duane Hayes , Bob
Estep, Debbie McIntosh, Lisa Copeland, Joe Murphy . Mayor ,
Ron Ferguson was absent from this meeting.
The meeting was called to order at 7 : 4i p.m. by Duane Hayes .
Duane asked for any citizen participation at this time.
There was no response.
Tom Belt was asked to speak in regard, to the Platting
requirements . He stated what they were bringing before the
Council an issue in regard to a development of land on
the far north edge of the city limits in the extraterritorial
jurisdiction. The county road 376 , also known as Kelly Rd.
on the north side of the road. Joe asked if they had the
Plat staked off? Tom told Joe that it was . Joe stated that
it was riot Kelly Rd. , but Greer Rd. . Joe stated that he and
Ron went up to Greer Rd. Saturday and took a look at the
plat . Jo e got up and showed Tom on the map where Kelly Rd.
was and also where Greer Rd. is . Tom stated that they were
looking to put in a single 5 acre development . Tom stated
the reason they were coming before the council was to
introduce themselves and to give this information to the City
and to request a variance of our platting requirement . Torn
stated their reason for this cause of the development , it is
a 5 acre site, we are not requesting any services from the
city , the water is supplied through South Grayson, the
improvements to the road are the County ' s , but improvements
to the road are not needed at this time. The 5 acre site is
not going to be divided, it will remain a single site for a
single use. Tom presented a copy of the survey of their plat
for the Council to view. Tom stated that they have reviewed
-the Subdivision Ordinance , that the Secretary provided
)rovided for
them. Tom stated that the Council ma'ybe aware of the
information of Texas State Code 9596 , that states that a 5
acre or greater tract of land doesn ' t recruire platting in a
extraterritorial. -jurisdic tinT
o . om stated that they do fully
intend to comply with the Councils wishes . Tom said they
would prefer to not plat the land because they met with the
County and they require a 120 feet easement , our development
sits back far enough to give 60 feet of easement on the north
side of the road. However , the County did inform us that it
would not have to be dedicated at this time if it did not
have to be Platted . Tom introduced to the Council Don Topper
with DSC . Don also introduced Ric Nelson who will be
handling the facility work on this site. Don presented the
Council with a packet on Corporate overviews and information
on the site . Don stated they were building an EMI Test site.
Don stated that they have been doing this in Plano , but it is
so big now that there is to much interference. Don stated
that from an energy stand point , this is a nice quiet area.
Don stated that they, will build a fiberglass building and
bring telephone equipment to put in it . He stated there will
not be alot of traffic because the testing takes a long time
to complete. There will be a group of engineers that work
out there. Debbie asked how many
Y buildings? Don stated they
will build one for now. They will build a fence around the
site because of the expensive equipment in the building.
Lisa asked it it would interfere with any television or radio
reception. Don stated that J.'t would riot . Duane stated that
since they requested a variance to our City ordinance that we
should take a vote. Debbie made a motion to grant the
variance of the platting requirements , Bob seconded. Motion
carried.
Debbie made a motion on the a-oT)rovai of the minutes for
February 25 , 1997 , Lisa seconded. Motion carried.
Bob asked to see the detail on the bill regarding Animal
Control . joe stated the bill was 506 . 25 . Bob stated his
concerns to the high cost of this bill . Joe read the bill to
the Council in detail , Bob stated the bill was higher than
what you could get the County to do it for . Lisa stated that
Terrie Lawerence has to pay the city 1.67 . 00 due to a ticket
wrote by the Animal Control Officer. Bob stated his concern
about the time it is taking Cliff to do each call . Lisa
stated that it is probably from the time the officer leaves
his office until the time he returns . Debbie stated we were
getting part of this back in fines . Debbie asked when the
Animal Control bill comes in that the City Secretary make
copies for each Council member. Lisa made a motion to
approve the bills , Debbie seconded. Motion carried.
Duane asked the Council to discuss and take action on road
repair . Bob told Duane to read the last minutes regarding
Road Repair. Duane asked what the next step would be on
this? Bob stated that Ron indicated the price that Mr . Burk
quoted him were higher than what Mr . Burk gave Ron . Bob
stated that Ron was suppose to call Mr . Burk and find out
this information. Since Ron was riot present at this meeting ,
the Council agreed to table this until Ron finds out this
information.
The City Secretary, Marie Evans spoke regarding the 96 Audit .
She stated that Linda Flemings came down last Wednesday to
help load Quik Books . Marie stated she was keying the 96
checks and that she was up 'to November now. She stated that
the City will need to purchase a printer with this new
software , because one printer will be used for checks only.
There will be a switch to q(.) from one printer to the other.
Duane stated the City Council. will recess into Executive
Session under Texas Government Code Section 551 . 071. and
551 . 074 of the Texas Open Meetings Act for the tollowinq
purpose:
A. Personnel : To discuss and take action as needed
reqardi.na the re-hiring of Ricky Davies .
Duane stated the Council will re-convene a.nto regular session
to act on items discussed in the Executive Session. Duane
stated the item the Council discussed was the re-hirinq of
Ricky Dawes as the Water Superintendent . Joe made a motion
to hire Ricky at the pay scale he left , he will be on a 90
day probation period , with no Pay raise after the 90 days ,
Lisa seconded. Motion carried .
Duane stated that before the Council closed was there
anything else that needed to be discussed. Lisa stated that
behind Billy Joe Lindsey ' s house the around surface is
terrible, because of the sewer line that was dug up . Joe
stated that as soon as the around dries up he will get the
Construction Crew and himself out there to take care of it .
