Good to hear from you. we strive for about 7,500 sq. ft. and at least 75 parking
spaces. we have four locations throughout Tarrant county and our attendance varies
depending upon the location, day of the week, time of year, etc... sometimes 75 in
attendance all the way up to 250-300. Age demographics vary too. Since the
introduction of electronics a younger crowd has moved in but we still have our older
standbys. However, on average, most players tend to be female in their 40's and
50's.

The City Council of the City of Anna will meet in Special SessionBudget Workshop at
6:30 p.m., July 30, 2013, at the Anna City Hall Administration Building, located at 111
North Powell Parkway (Hwy 5), to consider the following items.
Welcome to the City Council Meeting. Please sign the Sign -In -Sheet as a record of
attendance. If you wish to speak on an open -session agenda item please fill out the
Opinion/Speaker Registration Form and turn it in to the City Secretary before the
meeting starts.
1. Call to Order.
2. Roll call and establishment of a quorum.
3. Consider/Discuss/Action adopting an Ordinance Canvassing the July 20, 2013
Run-off Election to Fill a Vacancy, Place U. (City Council)
Public Hearing: To consider public comments on a request by ATC NO. 1
BRGT/LTD, property owners) to amend the Roads" portion of Section 4
(Design Standards) for the entire Planned Development, change development
standards for 3 areas, and add 50 additional acres into the Planned Development.
The property is currently zoned as Planned Development as per Ordinance No.
129-2004 and SF-72 Ordinance Number 149-2004. (Maurice Schwanke)
(b) Consider/Discuss/Action adopting an ordinance amending the existing
planned development zoning, amending the "Roads" portion of Section 4 (Design
Standards) for the entire Planned Development, change development standards for

AGENDA SUBJECT: Consider/Discuss/Action regarding approving a Ordinance
canvassing the returns of a July 20, 2013 Run-off Election to fill a vacancy, Place 6 for a
two year ten month term of one City Council Member.
SUMMARY: On June 25, 2013 City Council passed Ordinance No. 623-2013 ordering a
July 20, 2013 Run-off Election. Early voting was held for 5 days and Saturday, July 20,
2012 was Election Day. Canvassing documents are included in the packet for your
review. Tiffany Burleson received 33 votes and Dick Dowd received 41 votes for a total
of 74 votes cast.
RECOMMENDATION: Staff recommends a motion to approve the ordinance
canvassing the returns of the City of Anna, July 20, 2013 Run-off Election.

ORDINANCE NO.
A ORDINANCE OF THE CITY OF ANNA, TEXAS CANVASSING THE
RETURNS OF A RUN-OFF ELECTION HELD JULY 20, 2013 TO FILL A
VACANCY OF ONE CITY COUNCIL MEMBER, PLACE 6, FOR A TWO YEAR
TEN-MONTH TERM.
WHEREAS, arun-off election was held in the City of Anna, Texas on July 20, 2013 for
the purpose of the election of one city council member, to fill the vacancy of an
unexpired three-year term, Place 6, for two year ten month term.
WHEREAS, the City Council of the City of Anna ("Council") has reviewed and
investigated all matters pertaining to this election and returns thereof; and
WHEREAS, the Council hereby canvasses the returns of this election, at which there
was submitted to all resident, qualified electors of the City for their action thereupon, the
election of one city council member, to fill the vacancy of an unexpired three-year term,
Place 6, for a two year ten-month term; and
WHEREAS, the Council has diligently inquired into the poll lists and the official
election returns which were duly and lawfully made to this Council by the judges,
officials and clerks holding and conducting the election, the poll lists and the official
elections returns showing separately the votes cast in the election; and
WHEREAS, from the returns, this Council hereby finds that the following votes were
cast in the election by voters who were resident, qualified electors of the City; and
WHEREAS, each of the candidates in said election received the following votes;

Section 1. The above stated recitals are true and correct and are incorporated here as

Section 2. It is hereby certified that Dick Dowd a candidate for the position of City
Council Member, Place Six received a majority of votes cast.

Section I The Council officially finds, determines, and declares that the election was

of the results of the election have been made and delivered, and that the City of Anna has
duly canvassed such returns, all in accordance with the laws of the State of Texas and of

Section S. If any section, subsection, sentence, clause, or phrase of this ordinance, or
its application to a particular set of persons or circumstances, is declared invalid or
adjudged unconstitutional by a court of competent jurisdiction, it does not affect the
remaining portions of this ordinance, as the various portions and provisions of this
ordinance are severable. The City Council of the City of Anna, Texas, declares that it
would have passed each and every part of this ordinance notwithstanding the omission of
any part that is declared invalid or unconstitutional.

SUMMARY:
This zoning request addresses three sections of the original Planned Development
Ordinance No. 129-2004.
The first section being modified is Area "A". Within Area "A" the current lot size
allowed is 6,000 sq. ft. with a minimum lot width of 55'. The proposed change would
aHow a 50' wide lot on 50 percent of the lots and increase the lot size to 7,200 sq. ft. on
the other 50 percent with a lot width of 60'. The end result will average out to 55' lot
width with an average lot size exceeding 6,600 sq. feet.
The second section is Area "B". Within Area "B" the current lot size allowed is 5,500 sq.
ft. with a 50' lot width. The proposed change would allow an option of 15,000 sq. ft. lots
if allowed on an Estate Street Section. This street section would not have curbs but a bar
ditch for drainage.
The third part of the ordinance change simplifies the "Roads" section of the ordinance by
tying it to the "Adopted City Thoroughfare Plan"

The last part of the ordinance change is the addition of 50 acres to be known as "Area K".
"Area K" contains a residential component that was originally zoned as "SF-72" by
Ordinance No. 149-2004. This tract will contain 7,200 sq. ft. lots with the ability to
reduce the lot size to 6,000 sq. ft. if "Area B" builds the 15,000 sq. ft. lots. If "Area B"
builds smaller lots then the "Area K" lots will remain 7,200 sq. ft.
The staff is in favor of this request.
PLANNING AND ZONING ACTION: The Planning and Zoning Commission
recommended approval of the zoning request unanimously at their meeting July 1, 2013.

SUMMARY: Our current zoning ordinance does not allow for thin wall masonry
fences. This ordinance change will allow for the use of thin wall construction when

and with columns on piers. Additionally, the wall will need to be sealed by an engineer
and receive City approval.
Additionally, a graphic needed clarification and a pipe sized needed to be corrected to a
standard size pipe.
PLANNING AND ZONING ACTION: The Planning and Zoning Commission
recommended approval of the amendment to the screening elements and fences
unanimously at their meeting July 1, 2013.

Treated lumber attached with galvanized screws to 3-1�2 3/8". Diameter
galvanized poles installed in an 8" diameter holes no less than 2-1/2 feet deep
in 2' of premixed concrete. All posts shall have caps. Brick, stone, Masonry,
vinyl materials or a combination with columns every 81. Vinyl materials cannot

Section 3. Penalty.
Any violation of any of the terms of this ordinance, whether denominated in this ordinance as
unlawful or not, shall be deemed a misdemeanor. Any person convicted of any such violation
shall be fined in an amount not to exceed $2,000 for each incidence of violation. Each violation
is considered a separate offense and will be punished separately.
Section 4. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to the
extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect the same
as if such invalid or unconstitutional provision had never been a part hereof. The City declares
that n would have passed this ordinance, and each section, subsection, clause, or phrase
thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses,
and phrases be declared unconstitutional or invalid.
Section 5. Publication of the Caption Hereof and Effective Date.
This ordinance shall be in full force and effective from and after its passage and upon the
posting and/or publication, if required by law, of its caption and the City Secretary is hereby
directed to implement such posting and/or publication.

Muhammed Polani, owner of property, requesting a Specific Use Permit to host bingo at
2513 N. Powell Plcwy, Suite 400, the subject property. The property is currently zoned as
Restricted Commercial (C1) zoning. The use is classified as a Private Event/Meeting
Hall Facility.
(b) Consider/Discuss/Action adopting an ordinance for a Special Use Permit to host
bingo at 2513 N. Powell Pkwy, Suite 400, the subject property. The property is currently
zoned as Restricted Commercial (C1) zoning. The use is classified as a
Private/Event/Meeting Hall Facility.
SUMMARY: The Specific Use Permit request is to allow Bingo to be hosted at the
facility commonly known as "The Palace". Mr. Polani, owner of property, has noted in
his letter of intent that the facility would be used to house the scheduled games that
would be sponsored through the Anna American Legion. Every town in Texas that has
bingo. activity must hold an election. In 1982 the City held that election which passed.
Bingo is heavily regulated and governed by the Charitable Bingo Operations Division of
the Texas Lottery Commission.
This item was tabled at the last Planning &Zoning meeting, June 3, 2012.
Since the Planning and Zoning Commission Meeting the American Legion has informed
the City via email and in person that they do not intend on sponsoring the Bingo Activity.
Since all of the traffic generated will be funneled through the single residential street with
no direct access to North Powell Parkway and the American Legion is not sponsoring this
request the Staff cannot support this request. Additionally, even though the Zoning
Ordinance parking regulations are being met the intended use may cause parking
problems and congestion on the surrounding streets. In the staffs opinion this use in close
proximity to residential uses from a planning perspective is not compatible and
appropriate.

COMPREHENSIVE PLAN, ZONING MAP, AND ZONING ORDINANCE AND APPROVING A
SPECIFIC USE PERMIT ON CERTAIN PROPERTIES AS DESCRIBED HEREIN;
PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY CLAUSES; PROVIDING
FOR AN EFFECTIVE DATE; PROVIDING FOR A PENALTY CLAUSE NOT TO EXCEED
$29000 OR THE HIGHEST PENALTY AMOUNT ALLOWED BY LAW, WHICHEVER IS LESS;
AND, PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the owner of the property described in Exhibit A attached hereto has requested a Specific
Use Permit for said property; and
WHEREAS, the Planning and Zoning Commission of the City of Anna and the City Council of the City
of Anna have given the requisite notices by publication and otherwise and have held the public hearings
as required by law and afforded a full and fair hearing to all property owners generally and to all persons
interested in and situated in the affected area and in the vicinity thereof, the City Council of the City of
Anna has concluded that the Specific Use Permit be approved as follows:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1. The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by approving a
Specific Use Permit on the tract described in Exhibit A, attached hereto and made an integral part of this
ordinance, and approving the Specific Use Permit in the Restricted Commercial (Cl) zoning district to
allow Bingo to be hosted at the facility commonly known as "The Palace". The use is classified as a
Private/Event/Meeting Hall Facility located at 2513 N. Powell Pkwy, Suite 400.
1. All other provisions of the Restricted Commercial (Cl) District in the existing City of Anna
Zoning Ordinance are applicable to the tract and. any uses of the tract.
Section 2. The official Zoning Map of the City of Anna shall be corrected to reflect the Specific Use
Permit described herein.
Section 3. All ordinances of the City of Anna in conflict with the provisions of this ordinance are
repealed to the extent of that conflict.
Section 4. This Ordinance shall take effect immediately from and after its passage and the publication of
the caption of said ordinance as the law in such case provides.

SUMMARY:
As the AISD prepares to open the newest campus, the Pre K and K campus on Sherley
Avenue, some amendments to the Code of Ordinances are necessary to address traffic
safety in the areas of the school.
Part II, Article 59, 2.04 deals with the need for malting Sherley Avenue a "one-way"
street during drop off and pick up times.
Part II, Article 59, 3.05 needs to be amended to include the addition of the school speed
zone (20 mph) at the new campus during drop off and piclt up times.
STAFF RECOMMENDATION: Approve the ordinance amending the Code as it
pertains to traffic safety in the area of the new Sherley Avenue campus.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE CITY OF ANNA
CODE OF ORDINANCES BY AMENDING PART II, ARTICLE 59, SECTIONS 2 AND
3; PROVIDING FOR SAVINGS, SEVERABILITY, AND REPEALING CLAUSES;
PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION
OF THE CAPTION HEREOF.
WHEREAS, the City of Anna, Texas ("the City") has previously adopted ordinances,
rules and regulations governing traffic in the areas of the City's Public Schools; and
WHEREAS, the City of Anna, Texas City Council has investigated and determined
that it would be advantageous and beneficial to the City and its citizens to amend
Part II, Article 59, Sections 2 and 3, of the City of Anna Code of Ordinances ("Anna
Code") by amending the provisions of Section 2 and by amending Section 3 to
include the addition of a newly opening elementary school campus on Sherley
Avenue.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The above -referenced recitals are incorporated herein as if set forth in full for all
purposes.
Section 2. Amendments.
In accordance with Part II, Article 1, Section 9 of Anna, the following amendment is
made to Part II, Article 59, Section 2 by adding to the code section 2.04 in its entirety:
2.04 One -Way Traffic on Certain Streets
The City Council of the City of Anna, hereby designates one-way
traffic in the following location and times:
al Sherlev Avenue. For periods beainnina 30 minutes
before the start of school and ending 15 minutes after the
start of school; starting again 15 minutes before the
dismissal of morning classes, and ending 30 minutes after
the beginning of afternoon classes, and then startinq 15
minutes before school ends for the day and ending 30
minutes after classes are dismissed for the day, or any
other time as deemed necessary by the Chief of Police.

In accordance with Part ll, Article 1, Section 9 of Anna, the following
amendment is made to Part II, Article 59, Section 3, Speed Limit
Regulations, subsection 3.05 by adding to the current language with the
underlined language below:
3.05 School Zone Speed Limits
The City Council of the City of Anna, hereby designates school speed zones in
the following locations:
(e) Sherley Avenue. A maximum speed of 20 miles per hour is
established for periods beginning 30 minutes before the start of school
and ending 30 minutes after school ends for the day.
(f? All of these school speed zones shall be effective in the areas between
the school zone signage and in effect on the days when school is in
session.
Section 4. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to
the extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect
the same as if such invalid or unconstitutional provision had never been a part hereof.
The City declares that it would have passed this ordinance, and each section,
subsection, clause, or phrase thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses, and phrases be declared unconstitutional or
invalid.
Section 5. Publication of the Caption Hereof and Effective Date.
This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, if required by law, of its caption and the City Secretary is
hereby directed to implement such posting and/or publication.
