Trash contract Bids will be accepted until Monday, October 8, at 5:00 p.m. Bids will be tabulated and available to Council at the regular meeting. 4. Light Standards – Oak Hollow Subdivision Proposed light poles are identical to those the Council approved for Tara Farms except they will be 10 and 12 foot poles instead of 8 foot poles. 5. 2000-2001 Budget Amendments Amendments to the budget for the year ending September 31, 2001, are required to bring budget into line with actual income and expenditures. 6. Amendment to Planned Development Zoning of 36.05 acre Meadow Ridge Addition tract. The developer seeks revision of the existing PD Zoning of the tract. The requested changes are listed in the petitioner’s application materials. The Planning and Zoning Commission has recommended approval of the amendment to the original Planned Development. (See Attachments) 7. Annexation of 100 Acre Central Expressway 196 Joint Venture Tract This tract is located at the northwest corner of U. S. Highway 75 and FM 455. Property owner has petitioned for annexation The Planning and Zoning Commission has recommended approval of the annexation. (See Attachments) 8. Public Hearing: Zoning of 100 Acre Central Expressway 196 Joint Venture Tract This tract part is the western part of the tract that fronts FM 455 and Highway 75 (northwest corner of intersection). A group represented by Don Collins has a purchase option on the 100 acres and wants to develop the property primarily for single family residential development. The zoning request for this property is virtually identical to provisions in the Oak Hollow and Creekside subdivisions. The public hearing is an opportunity for interested persons to express opinions and ask questions. The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by amending Planned Development #2001-01 (Meadow Ridge Addition), which includes the tract described in Exhibit A, attached hereto and made an integral part of this Ordinance. The Planned Development #2001-01 is hereby amended as follows: 1 Front yard setbacks for all lots within the PD shall be a minimum of 20 feet. 2 Side yard setbacks for all lots within the PD shall be a minimum of 5 feet. 3 Street widths for all streets within the PD shall be a minimum of 27 feet from back of curb to back of curb. 4 A Home Owner’s Association to be established by the developer shall enforce limited street parking. Section 2. The official Zoning Map of the City of Anna shall be amended to reflect the change in zoning described herein. Section 3. All ordinances of the City of Anna in conflict with the provisions of this ordinance are repealed to the extent of that conflict. Section 4. This Ordinance shall take effect immediately from and after its passage by the City Council of the City of Anna. C:\\Users\\kavery\\AppData\\Local\\Temp\\Meadow Ridge Zon Ord Amdt.doc_1188\\Meadow Ridge Zon Ord Amdt.doc Page 1 of 2 CITY OF ANNA, TEXAS ORDINANCE NO. ___2001-17___ AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF ANNA, COLLIN COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS AND ADOPTING A SERVICE PLAN FOR SAID TERRITORY AND ITS INHABITANTS WHEREAS, certain property owners have petitioned the City of Anna to have their property, described in Exhibit A, annexed to the City of Anna; and WHEREAS, said properties are adjacent to and adjoin the present boundaries of the City of Anna; and WHEREAS, a service plan providing for the extension of municipal services into the proposed annexed area and attached to this ordinance as Exhibit B and hereby made part of this ordinance was prepared prior to publication of notice of hearings and reviewed at said hearings; and WHEREAS, after hearing the arguments for and against the annexation, the City Council has voted to annex said territory to the City of Anna, Texas; now therefore Section l. The land and territory described in Exhibit A, attached hereto and hereby made an integral part of this Ordinance, lying adjacent to and adjoining the present boundaries of the City of Anna, Texas, is hereby added and annexed to the City of Anna, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Anna, Texas, and the present boundary limits of such city are altered and amended so as to include said area within the corporate limits of the City of Anna, Texas. Section 2. The above described territory and the area so annexed shall be a part of the City of Anna, Texas, and the inhabitants thereof, if any, shall be entitled to all of the rights and privileges of all citizens and shall be bounded by the acts, ordinances, resolutions, and regulations of the City of Anna, Texas. Section 3. The service plan providing for the extension of municipal services into the annexed area and attached to this ordinance as Exhibit B is hereby adopted. The City Secretary is hereby directed to file with the County Clerk of Collin County, Texas, a certified copy of this ordinance. The Planned Development shall include the following elements: Permitted Uses: The permitted uses will be the same as those permitted in the “R-1 – Single Family Residential” zoning district. Setbacks: Minimum front yard – 20 feet; however, covered porches and bay windows may encroach up to five (5) feet into the required setback. Minimum side yard – five (5) feet; however, ten (10) feet shall be required on a corner lot adjacent to a side street and garages that face a side street must maintain a minimum setback of twenty (20) feet. Minimum rear yard – 15 feet. Lot Dimensions: The minimum dimensions for residential lots will be as follows: Minimum lot area – 6,000 square feet Minimum lot width – 50 feet Minimum lot depth – 90 feet Minimum Dwelling Area: The minimum single-family dwelling unit area shall be 1,200 square feet. The land and territory described below is hereby disannexed from the City of Anna, Texas, and said territory shall hereafter be excluded from within the boundary limits of the City of Anna, Texas, and the present boundary limits of such city are hereby altered and amended so as to exclude said area from within the corporate limits of the City of Anna, Texas. Beginning at a point in the north right-of-way of FM 2862, also being the southwest corner of a tract conveyed to Roy L. Dobbins in Volume 92, Page 59953, Collin County Deed Records; Thence North along the west line of said Dobbins tract to a point in the northwest corner of said Dobbins tract, also being a point in the southwest corner of a tract conveyed to Chris Peters in Volume 3575, Page 409, Collin County Deed Records, continuing along the west line of said Peters tract to a point in the northwest corner of said Peters tract, also being a point in the southwest corner of a tract conveyed to Abel Yougas in Volume 4281, Page 731, Collin County Deed Records, continuing north along the west line of said Yougas tract to a point in the northwest corner of said Yougas tract, also being a point in the southwest corner of a tract conveyed to Harold Baty in Volume 4730, Page 2362, Collin County Deed Records, continuing along the west line of said Baty tract to a point in the north Anna city limits; Thence east a distance of 30 feet to a point; Thence south along a line 30 feet east of and parallel to the west line of said Baty tract, continuing on the same course through the said Peters and Dobbins tract to a point in the south line of said Dobbins tract, also being a point in the north line of FM 2862; Page 1 of 2 CITY OF ANNA, TEXAS ORDINANCE NO. 2001- 20 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING ORDINANCE NO. 98-14 BY ESTABLISHING A TERMINATION NOTIFICATION FEE; ESTABLISHING A PENALTY FOR VIOLATION OF THE PROVISIONS OF THE ORDINANCE; AND SETTING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Anna has established rules, regulations, and procedures for payment of water and/or sanitary sewer bills and for termination of service for unpaid accounts; and WHEREAS, the City Council desires to clarify the rules, regulations, and procedures for notification of termination of water and/or sanitary sewer service, including establishment of a fee for notification of termination of service; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT Section 1. Section 3 of Ordinance No. 98-14 Amended Section 3 of Ordinance No. 98-14 is amended to read as follows: Section 3. Billing; Failure to Pay; Notification Charge; Reconnection Charge A statement for the water used and/or sewer service furnished shall be mailed to each water and/or sewer customer of the city on the first day of each month. The charges herein prescribed shall be collected monthly. Any water customer and/or th sewer customer who shall fail or refuse to pay his monthly bill on or before the 15 day of the month shall be assessed an additional ten percent (10%) late charge and may have his service discontinued until the amount owed to the city is paid. th A customer with an unpaid bill will be notified on the 25 day of the month of the unpaid bill and scheduled date of termination of service. The written notification may be provided through personal service. If provided through personal service and if the customer is not at the place of residence or business that has the delinquent bill, the written notification will be placed on the front door or as close to the front door as feasible. A fee of ten dollars ($10.00) shall be added to the customer’s bill for the notification service. A reconnection fee of ten dollars ($10.00) will be assessed to any customer who has had service disconnected. Page 1 of 2
