ITEM 8. Consider action on recommendation of Planning and Zoning Commission regarding preliminary plat for Villages of Hurricane Creek. The PZC has scheduled action on this plat at its meeting of August 9. The plat was originally reviewed by the PZC at its meeting of July 6. The primary concern raised at that meeting related to the presence of driveways on minor collectors, particularly the primary north -south collector street. There is no hard and fast rule on this issue; it is to a large extent a judgment call. The developer has submitted a letter from his traffic consultant, Mr. Jack Hatchell, that supports his contention that the design of the subdivision is such that the driveway locations are not a problem. Your planning consultant, Mr. Maurice Schwanke, supports this view. We have also asked Mr. Tom Walton, our traffic engineer, to review and comment on the issue. I am attaching the original Schwanke comments. What happens to the 30' and 157 utility easements at the southwest terminus of Lot 12 Block JJ and Lot 22 of Block KY, Perhaps a lift station. If so, it should be shown on some identifiable lot. Contours should be labeled. Please identify the rear property lines of all lots. Label the tract west of Street O Street K on is labeled as 60' of right-of-way; however, it is drawn as 50' of right- of-way. Adjust Street K and change the lots accordingly. Please coordinate Sheet 2 with Sheet 5. Renumber lots, perhaps adjust lot lines, and adjust right -of --ways. Street O street name is duplicated on Sheet 5. Street M is labeled as 60' of right -of --way; however, it is drawn as 50' of right-of- way. Adjust Street M and change the lots accordingly. Lot 11 of Block O is a keyhole lot and does not meet the minimum lot width as measured at the front building line. According to section 8.5.2. of the Subdivision Rules and Regulations the Lot Width Definition is as follows "The lot width is the minimum distance between the side lot lines of a building lot measured along a straight line at the rear of the required front yard and parallel to the street line or a line tangent thereto, unless otherwise defined." IIF 10 & 11 of Block N are dimensioned incorrectly. According to section 5.1.3.4. the location of building lines shall be shown. The limits of the property shall be clearly indicated on the eastern edge of the property. Additionally, the match line reference on the southwest corner of this plat should be removed. Reference to parkland and or should be removed from this and future plats within this subdivision. A tract number should be assigned along with approximate acreages. The status of the 170' electric easement should be clarified. If it is an easement who owns the property and has responsibility for maintenance? According to section 5.1.3.1 of the SRR the following. "I'he proposed name of the subdivision. The proposed mane shall not have the same spelling as or be pronounced similarly to the name of any other subdivision located within the city or within two miles of the city." An unrecorded subdivision exists to the north called Hurricane Creek Estates. The City may want the name of this subdivision changed because of this conflict. Prior to the issuance of a building permit this property should be platted. 2. What is the deal with the 4' reservation and a 52' reserved for row designation? 3. Is the 4' so the neighbor cannot access it? If so then the road should be a private road maintained by the AISD. If it is a public road as noted then it should be located on the property line. Additionally, if it is a public road then it should be built to City Street Standards. 4. I have definite concerns about fire protection for the rear of the building. What is your usual hose lay distance. Usually they are 150' from where a truck can park. If this is the case modification of the site plan needs to occur. 5. The fire lane circle on the north side of the school is not adequate to turn most large fire trucks around in. 6. A recommendation may be to put a fire lane completely around the building. The way the drainage is configured on the southwest and west corner of building, access to the building may be limited if a recent rain has occurred and ground has not had adequate time to dry. Perhaps some type of hidden surface such as grasscrete can be used for emergency purposes. 7. If 700+ students are expected at this facility another emergency situation potential is apparent. During times that students are being dismissed or arriving a potential of numerous vehicles and buses will be using the east drive (the only drive). If for some reason an emergency situation occurs at the school, especially during inclement weather, an emergency vehicle may not be able to get to the School (school is a significant distance from County Road). Perhaps another entrance on the west side for emergency purposes only (do not enter signs on both ends) is appropriate and necessary. 8. Minimum inside radius on fire lanes should be a minimum of 30' and an outside radius of 54. Most of the striping shown is less than 30'r and some are 90 degrees. 9. One parking Space per each faculty and staff member (teachers, counselors, nurse, custodians, kitchen workers, and administrators) is required per zoning ordinance. When the total spaces in a parking lot is between 101 and 150 the required number of handicapped spaces is 5. The items in Column 1 need to be addressed. In Column 2 you will find the beginnings of the Society's plans to move and restore the depot. 1. Identify the structure 2. Size 3. Shape 4. Materials l . Mayor Kenneth Pelham Anna, Texas Dear Mr. Pelham, 8 August 2004 Recent discussions compel us to write to you now to revisit the subject of County Road 366. We do not think there is any material difference in our impressions of the agreement reached on May 28th when members of the Luscombe family, yourself, Ryan Betz, representing the Skorburg Company, and the county commissioners met. Our portion of the land comprises just over ten acres and lies along the private road running north off 366. The alternate route 2 will separate our land from the rest of the Luscombe homes. We left the May 28th meeting having agreed to donate one half of the land needed to attain the 110 feet right of way along the southern end of our property, contingent upon our negotiating an agreement with the Skorburg Company to acquire the land at the junction of 366 and the private road. This triangle of land is created by the curvature of the proposed road, and would no longer be contiguous to the Skorburg development. We met with Ryan Betz on June 2, as soon as practicable after the May 28th meeting, to offer a possible solution. In fact, we made an offer, the details of which we will not go into here, which was received by Ryan with evident goodwill and the promise to get back to us right away. We advised Mr. Betz that we would be leaving on a mission trip on June 12'h. Mr. Betz and Mr. Skorburg were reminded again on June 8 at the Anna City Council meeting that we were leaving and we were told that they would get back to us before we left. We have since heard nothing from the Skorburg Company. We consider our offer to remain on the table and we would appreciate a reply. We are aware that expressions of displeasure have been conveyed from the Skorburg Company to the City of Anna regarding our proposal. We think our offer was fair. If not, we would like to hear any objections. When we last spoke we were prepared to donate the land for the road. We remain so prepared, but this will not occur until a mutually satisfactory agreement is reached with the Skorburg Company. In the absence, due to other commitments, of Marc and Carol Lee Downs (my niece) I would like to personally deliver their letter addressed to the mayor. I believe it conveys to the council their desire for an answer from the Skorburg Company in order to hasten the resolution of the CR 366 situation. Next, I have a comment from my own perspective. I would like to be assured that the Skorburg Company has donated the agreed 55' to 110' of ROW for the new Thoroughfare so that I might donate the 55' to 60' where so required (and where the error in measurement by Skorburg was made). This would be a distance south of CR 366 from Skorburg property to the curvature shown in our engineer's drawing of the north Thoroughfare Plan. I would like to see this project concluded.
