A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, FINDING
A PUBLIC NECESSITY FOR THE ACQUISITION OF PROPERTY AND
AUTHORIZING THE CITY ADMINISTRATOR AND HIS STAFF AND WOLFE,
TIDWELL & MCCOY, LLP, ATTORNEYS, TO ACQUIRE THE PROPERTY BY ANY
LAWFUL MEANS, INCLUDING BUT NOT LIMITED TO NEGOTIATION AND
PROCEEDINGS IN EMINENT DOMAIN.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS:
SECTION 1: The City Council of the City of Anna, Texas, finds a public necessity for
the public welfare and convenience to acquire an easement on the property described
below, and authorizes the City Administrator and his staff and Wolfe, Tidwell & McCoy,
LLP, attorneys, to acquire the property by any lawful means including but not limited to
negotiations with landowners and, if necessary, proceedings in eminent domain. The
City Council of the City of Anna by this Resolution directs the City Administrator and his
staff and Wolfe, Tidwell & McCoy, LLP, attorneys, to have the property described below
appraised by a certified appraiser, to make a final monetary offer for the property
consistent with the appraisal and the City's desire to acquire the property in an efficient
manner, and, if necessary, to institute proceedings in eminent domain. The property to
be acquired is an easement located within a 48.000 acre tract owned by Paula Powell,
located on CR 367, Collin Appraisal District Parcel Number R=6868-000-0130A ,
recorded in Volume 569, Page 328, Collin County Deed Records. The easement is
30' in width, from the west line to the east line through the north part of the 48.000 acre
tract, to be used for location of utility lines and appurtenances.
SECTION 2: This Resolution shall take effect immediately upon its passage.

ITEM 9. Consider resolution establishing a public hearing date to consider
land use assumptions and capital improvements plan for the designated service
area for the purpose of possible adoption of impact fees.
You have in your agenda packet the land use assumptions and capital improvements
plan for both water and sewer impact fee improvements. Work on the thoroughfare
improvements element is underway but is probably 30-60 days away from completion.
We want to proceed with the water and sewer elements now because the time frame for
adoption is about 60 days and we believe the need for adoption is compelling.
IMPACT FEE ADOPTION PROCESS
1. City Council authorizes preparation of capital improvements plan to be developed by
qualified professionals
2. City Council establishes by resolution or ordinance a public hearing date to consider the land
use assumptions and capital improvements plan for the designated service area
3. On or before the first publication of notice of public hearing and CIl' the land use
assumptions, time period of projections, and description of proposed capital improvement
facilities must be made available to public
4. The City publishes notice of public hearing before the 30�' day before the date set for the
hearing in newspaper of general circulation in the county. The notice must contain language
found in LGC, 395.044
5. Not less than 30 days after public hearing, the City Council decides whether to adopt or
reject an ordinance or resolution approving the land use assumptions and CIP.
6. At same time that land use assumptions and CIP are adopted, the City Council shall adopt a
resolution setting a public hearing to discuss the imposition of an impact fee
7. The City publishes notice of public hearing before the 30th day before the date set for the
hearing in newspaper of general circulation in the county. The notice must contain language
found in LGC, 395.049
8. Impact Fee Advisory Committee meets and files written report on proposed impact fees
before the 5th business day before the date of the public hearing to set impact fees
9. Not less than 30 days after the public hearing, the City Council conducts a public hearing
regarding imposition of impact fees.
10. Within 3.0 days after public hearing, the City Council decides whether to adopt or reject an
ordinance approving the adoption of impact fees

WHEREAS, Chapter 395 of the Texas Local Government Code requires that the City adopt an
order, ordinance, or resolution establishing a public hearing date to consider the land use
assumptions and capital improvements plan prior to adoption of impact fees; now therefore
Section 1. Public Hearing Date Established.
A public hearing to consider comments on land use assumptions and capital improvements plan
developed for the purpose of consideration of adoption of impact fees shall be held on March 16,
2004, at 7*00 p.m., at the Community Room, Texas Star Bank, located at 402 W. White Street
(FM 455), Anna, Texas,

Anna'a population growth since 2000 has been similar to the growth experienced by Plano,
Frisco, and Allen when those communities were the size Anna is now. Based on that historical
background, Anna's population is projected to grow to 15,000 over the next 10 years.

= 5,357 units
Water supply required = 5,357 units x 0.6 gpm/unit

Business development is expected to occur along Highway 75, Highway 5, Highway 121, and
FR 455. Residential development is expected from Hurricane Creek on the west to some
distance east of Highway 5. Particular housing concentrations are expected between Highway 75
and Highway 5 and southeast from "Old Town". Housing concentrations are scattered so the
need for distribution pipelines during the planning period is significant.
Groundwater supply will be adequate for the planning period. Surface water will likely be
developed for Anna at some future time; however, that eventuality is beyond the scope of this
planning period.
The system will require additional elevated storage by 2006. Cost effectiveness argues for the
addition of a 1,5003000 gallon elevated tank. Such a tank will meet the total water storage needs
for the population projected for 2014. This availability of elevated storage will enable remote
water wells to be connected to the distribution system without the need for associated ground
storage and high service pumping facilities at each site.
