This item was tabled from your January 13, 2004, meeting. You may'recati that there was a disagreement regarding the location of a water main along the front of this development (along CR 367). The City Is attorney and the attorney for Ryland Homes are having a telephone conversation on Monday that will hopefully give us some direction in how to resolve this matter. If no agreement between the lawyers is reached, the council will probably need to meet in executive session with our attorney to see what direction you want to go with this issue. ITEM 7. Consider action on resolution setting date, time, and place for public hearings on annexation of the following tracts a. A 105.475 acre tract in the G. Stark Survey, Abstract No. 798, owner being Gordon Davis, located on the south side of E. White Street (FM 455), west of and adjacent to Wildwood Estates subdivision, b. A 3.83 acre tract in the G. Stark Survey, Abstract No. 798, Collin Appraisal District Account No. R=6798-001-0500=1, owner being Tommy Cunningham, located on east side of S. Powell Parkway (SH 5) at south edge of the city limits. a. The City has received an annexation request for this tract (see attached). b. You authorized a public hearing schedule for the Cunningham tract several in October, 2003. We simply did not have time then to get the documents together and to consult with the City's attorney regarding the annexation at that time. We are therefore asking you to reset the public hearing schedule for this annexation. The proposed annexation schedule for these tracts is attached.
