HomeMy WebLinkAboutOrd 906-2021 Canvassing the Returns of the May 1, 2021 Bond ElectionCERTIFICATE FOR ORDINANCE We, the undersigned officers of the City of Anna, Texas, hereby certify as follows: 1. The City Council of said City convened in Regular Session on the 11 day of May, 2021, at the scheduled meeting place thereof, and the roll was called of the duly constituted officers and members of said City Council, to -wit: Nate Pike, Mayor Lee Miller, Mayor Pro Tern Josh Vollmer, Deputy Mayor ProJem Stan Carver, Council Member Kevin Toten, Council Member Danny Ussery, Council Member Randy Atchley, Council Member Jim Proce, City Manager Carrie Land, City Secretary and all of said persons were present, except 1� j/�' , thus constituting a quorum. Whereupon, among other business, the following was transacted at said meeting: a written Ordinance entitled "ORDINANCE CANVASSING BOND ELECTION RETURNS." was duly introduced for consideration and passage. It was then duly moved and seconded that said Ordinance be passed; and, after due discussion, said motion, carrying with it the passage of said Ordinance, prevailed and carried by the following vote: AYES: NOES: ABSTENTIONS: 2. A true, full and correct copy of the aforesaid Ordinance passed at the meeting described in the above and foregoing paragraph is attached to and follows this Certificate; said Ordinance has been duly recorded in the official minutes of said City Council; the above and foregoing paragraph is a true and correct excerpt from said minutes of said meeting pertaining to the passage of said Ordinance; the persons named in the above and foregoing paragraph, at the time of said meeting and the passage of said Ordinance, were the duly chosen, qualified and acting members of said City Council as indicated therein; each of said officers and member was duly and sufficiently notified officially and personally in advance, of the time, place and purpose of the aforesaid meeting and that said Ordinance would be introduced and considered for passage at said meeting; and said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code. 3. That the Mayor of said City has approved and hereby approves the aforesaid Ordinance; that the Mayor and the City Secretary of said City have duly signed said Ordinance; and that the Mayor and the City Secretary of said City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Ordinance for all purposes. ATTEST: Nate Pike, Mayor Carrie Land, City Secretary (SEAL) CERTIFICATE FOR ORDINANCE CANVASSING BOND ELECTION RETURNS ORDINANCE NO. `40(P .2021 ORDINANCE CANVASSING BOND ELECTION RETURNS THE STATE OF TEXAS § COLLIN COUNTY § CITY OF ANNA § WHEREAS, the City Council of the City of Anna, Texas (the "City") ordered an election to be held in the City on May 1, 2021 for the approval or disapproval of general obligation bonds on the PROPOSITIONS hereinafter stated; and WHEREAS, said City Council has investigated all matters pertaining to said election, including the ordering, giving notice, officers, holding and making returns of said election; and WHEREAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council; and WHEREAS, it is hereby officially found and determined that the meeting at which this Ordinance was adopted was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: 1. That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election, that said election was duly held, that the City has complied with the Federal Voting Rights Act and the Texas Election Code, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said election. 2. That the City Council officially finds and determines that the following votes were cast at said election, on the submitted PROPOSITION by the resident, qualified electors of said City, who voted at the election: CITY OF ANNA, TEXAS SPECIAL ELECTION CITY OF ANNA, TEXAS PROPOSITION A FOR 1,154 THE ISSUANCE OF $8,000,000 OF BONDS BY THE CITY OF ANNA, TEXAS FORA FIRE STATION AND EQUIPMENT. AGAINST 168 ) TAXES SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON THE BONDS WILL BE IMPOSED. CITY OF ANNA, TEXAS SPECIAL ELECTION CITY OF ANNA, TEXAS PROPOSITION B FOR 844 ) THE ISSUANCE OF $2250003000 OF BONDS BY THE CITY OF ANNA, TEXAS FOR A COMMUNITY LIBRARY. TAXES AGAINST 465 ) SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON THE BONDS WILL BE IMPOSED. CITY OF ANNA, TEXAS SPECIAL ELECTION CITY OF ANNA, TEXAS PROPOSITION C THE ISSUANCE OF $28,0005000 OF BONDS BY THE CITY OF FOR 935 ) ANNA, TEXAS FOR PARKS AND RECREATION ) IMPROVEMENTS. TAXES SUFFICIENT TO PAY THE AGAINST 377 ) PRINCIPAL OF AND INTEREST ON THE BONDS WILL BE )IMPOSED, 3. That the City Council officially finds, determines and declares the result of said election to be that the PROPOSITIONS so submitted have received favorable majority votes in all respects and have carried. 4. That the aforesaid bonds may be issued as voted and as provided by law. 5. That this ordinance shall become effective irmnediately upon its passage and approval. I, therefore, make the following report of my findings from the May 1, 2021 City of Anna General and Special Election that was held in Collin County, Texas.
