Powell Parkway, Anna, Texas 75409 The City Council of the City of Anna will meet at 5:00 PM, on December 15, 2020, at the Anna City Hall, Located at 111 North Powell Parkway (Hwy 5), to consider the following items. Welcome to the City Council meeting. Please sign the Sign -In -Sheet as a record of attendance. If you wish to speak on an open -session agenda item, please fill out the Opinion/Speaker Registration Form and turn it in to the City Secretary before the meeting starts. 1. Call to Order, Roll Call and Establishment of Quorum. 2. Neighbor Comments. At this time, any person may address the City Council regarding an item on this meeting agenda that is not scheduled for public hearing and any item that is not on this meeting agenda. The public will be permitted to offer public comments electronically, as provided by the agenda and as permitted by the presiding officer during the meeting. We are encouraging neighbors, who wish to speak, to complete a Speaker Registration Form and submit to City Secretary Carrie Land (cland(@annatexas.pov) by 5:00 PM so it may be read into the record. Each person will be allowed up to three (3) minutes to speak. No discussion or action may be taken at this meeting on items not listed on this agenda, other than to make statements of specific factual information in response to a citizen's inquiry or to recite existing policy in response to the inquiry. 3. (City Secretary Carrie Land) SUMMARY: The canvass is the official tabulation of the election votes. The final tabulation is prepared by Collin County's Election Office and is to be approved by the City Council. (December 8, 2020 Runoff Election Canvass) AN ORDINANCE OF THE CITY OF ANNA, TEXAS CANVASSING THE RETURNS OF A RUNOFF ELECTION OF ONE CITY COUNCIL MEMBER, FOR THREE-YEAR TERM EXPIRING MAY 2023 AND SPECIAL RUNOFF ELECTION OF ONE CITY COUNCIL MEMBER FOR TWO-YEAR TERM EXPIRING MAY 2022. WHEREAS, a runoff election was held in the City of Anna, Texas (the "City") on December 8, 2020 for the purpose of electing one city council member for a three-year term; and WHEREAS, a special runoff election was held in the City on December 8, 2020 for the purpose of electing one city council member for a two-year term; and WHEREAS, the City Council of the City of Anna (the "Council") has reviewed and investigated all matters pertaining to this election and returns thereof, and WHEREAS, the Council hereby canvasses the returns of this election, at which there was submitted to all resident, qualified electors of the City for their action thereupon, the election of one city council member, for a three-year terms; and WHEREAS, the Council hereby canvasses the returns of this election, at which there was submitted to all resident, qualified electors of the City for their action thereupon, the election of one city council member for a two-year term; and WHEREAS, the Council has diligently inquired into the poll lists and the official election returns which were duly and lawfully made to this Council by the judges, officials and clerks holding and conducting the election, the poll lists and the official elections returns showing separately the votes cast in the election; and WHEREAS, from the returns, this Council hereby finds and declares that the following votes were cast in the election by voters who were resident, qualified electors of the City; and WHEREAS, each of the candidates in said election received the following votes: Candidate/or Proposition Number of Votes City Council, Place 3 (Concilio de Ciudad, Lugar 3) Hugh Heath 255 Stan Carver 495 City Council, Place 4 (Concilio de Ciudad, Lugar 4) Randy Atchley 485 Bryan Heath 262 Ordinance No. Canvassing the December 8, 2020 Runoff Election NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: SECTION 1. The above recitals are incorporated herein as if set forth in full. The Council officially finds, determines, and declares that the election was duly and properly ordered, that proper legal notice of such election was duly given in the English language and the Spanish language, that proper election officers were duly appointed prior to the election, that the election was duly and legally held, that all resident, qualified electors of the City were permitted to vote at the election, and due returns of the results of the election had been made and delivered, and that the City of Anna has duly canvassed such returns, all in accordance with the laws of the State of Texas and of the United States of America and the Ordinance calling the election. SECTION 2. Subject to being duly qualified and taking the oath of office as provided by the laws of the State of Texas and the City of Anna Home -Rule Charter, the following person is elected as Council Member, Place 3 of the City for a term of three (3) years: Stan Carver II. SECTION 3. Subject to being duly qualified and taking the oath of office as provided by the laws of the State of Texas and the City of Anna Home -Rule Charter, the following person is elected as Council Member, Place 4 of the City for a term of two (2) years: Randy Atchley.
