AN ORDINANCE OF THE CITY OF ANNA, TEXAS, REPEALING REGULATIONS
RESTRICTING THE USE OF BICYCLES ALONG A PORTION OF FARM TO MARKET
ROAD 455 IN THE CITY OF ANNA; PROVIDING A SAVINGS, SEVERABILITY, AND
REPEALING CLAUSE
WHEREAS, Section 8.01.002 (Restriction of bicycles along FM 455) currently restricts
any person from riding on or operating a bicycle on the segment of FM 455 beginning at the
east service road of US 75 and continuing in a westerly direction to East Fork Circle (the
"Restrictions"); and
WHEREAS, the City of Anna City Council ("City Council") finds that the driving public
and those who operate bicycles on public streets in the City of Anna have, over the
years since the Restrictions were adopted, become more aware of and attentive to the
need to safely share the public roadways as between motor vehicles and bicycles; and
WHEREAS, in recognition of the public's personal responsibilities to follow state law as
pertains to the operation of bicycles on public roadways, the City Council finds the
Restrictions are no longer necessary;
NOW,THEREFORE, BE IT ORDAINED BYTHE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1. Recitals Incorporated.
The above recitals are incorporated herein as if set forth in full for all purposes.
Section 2. Repeal of Section 8.01.002 (Restriction of bicycles along FM 4551.
Anna Code Section 8.01.002 (Restriction of bicycles along FM 455) including all of its
subparts is hereby repealed in its entirety.
Section 3. Savings, Severability, and Repealing Clauses.
All ordinances ofthe City in conflict with the provisions of this ordinance are repealed to the
extent of that conflict. If any provision of this ordinance shall be held to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect the
same as if such invalid or unconstitutional provision had never been a part hereof. The
City declares that it would have passed this ordinance, and each section, subsection,
clause, or phrase thereof irrespective of the fact that any one or more sections,
subsections, sentences, clauses, and phrases be declared unconstitutional or invalid.

PASSED by the City Council of the City of Anna, Texas on this 10day of August
2021 to be effective immediately.
