A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, PROVIDING FOR A DECLARATION OF NO
OBJECTION TO THE PALLADIUM EAST FOSTER CROSSING
MULTIFAMILY DEVELOPMENT IN ANNA, TEXAS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Palladium East Foster Crossing, Ltd., a Texas limited partnership
("Applicant") has proposed the acquisition of land and development of approximately 239
units of multifamily rental housing for the general population or families on approximately
8.26 +/- acres of land located approximately at the northeast corner of East Foster Crossing
and Vail Lane, City of Anna, Collin County, Texas, to be commonly known as Palladium East
Foster Crossing ("Development"); and
WHEREAS, Applicant has advised that it intends to submit an application to the Texas
Department of Housing and Community Affairs ("TDHCA") for 4% Noncompetitive Housing
Tax Credits to partially finance the Development; and
WHEREAS, pursuant to Section of 11.9 of the current TDHCA Qualified Allocation
Plan and Chapter 2306 of the Texas Government Code, the City desires to provide a
Resolution of No Objection to the Applicant for 4% Noncompetitive Housing Tax Credit
application for the Development;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
SECTION 1. That in accordance with the requirements of the Texas Government Code
§2306.670711 it is hereby found that:
a. Notice has been provided by Applicant to the City Council of the City ofAnna
in accordance with Texas Government Code §2306.67071(a); and
b. The City Council of the City of Anna as the Governing Body has had sufficient
opportunity to obtain a response from the Applicant regarding any questions
or concerns about the Development; and
c. The City Council of the City of Anna as the Governing Body has held a hearing
on October 12, 2021, at which public comment was allowed be made on the
application for the Development in accordance with Texas Government Code
§2306.67071(b); and
d. After due consideration of the information provided by the Applicant, public
hearing, and public comment on the proposed Development, the City Council
of the City of Anna, acting as the Governing Body, does not object to the
proposed TDHCA application for the Development.
SECTION 2. That it is FURTHER RESOLVED, that for and behalf of the Governing
Body the City Secretary of the City of Anna is hereby authorized, empowered, and directed
to certify this resolution to the TDHCA and the Applicant may submit said certified resolution to
TDHCA.
CONSIDERED, PASSED AND ADOPTED by the City Council of the City of Anna at
a regular meeting on the 12th day of October 2021 at which a quorum was present, and for
which due notice was given pursuant to Government Code, Chapter 551.
