HomeMy WebLinkAboutRes 2004-02-02 Finding Public Necessity for Acquisition of PropertyCITY OF ANNA RESOLUTION NO. 2004-02-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, FINDING A PUBLIC NECESSITY FOR THE ACQUISITION OF AN EASEMENT AND AUTHORIZING THE CITY ADMINISTRATOR AND HIS STAFF AND WOLFE, TIDWELL & MCCOY, LLP, ATTORNEYS, TO ACQUIRE THE EASEMENT BY ANY LAWFUL MEANS, INCLUDING BUT NOT LIMITED TO NEGOTIATION AND PROCEEDINGS IN EMINENT DOMAIN. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: SECTION 1: The City Council of the City of Anna, Texas, finds a public necessity for the public welfare and convenience to acquire an easement on the property described below, and authorizes the City Administrator and his staff and Wolfe, Tidwell & McCoy, LLP, attorneys, to acquire the easement by any lawful means including but not limited to negotiations with landowners and, if necessary, proceedings in eminent domain. The City Council of the City of Anna by this Resolution directs the City Administrator and his staff and Wolfe, Tidwell & McCoy, LLP, attorneys, to have the easement described in Exhibit A appraised by a certified appraiser, to make a final monetary offer for the easement consistent with the appraisal and the City's desire to acquire the easement in an efficient manner, and, d necessary, to institute proceedings in eminent domain. The easement to be acquired is located within a 77.13 acre tract owned by George F. West, described as Block 1, Tract 1 in the Guinn Morrison Survey, A-0559, Collin Appraisal District Parcel Number R-6559-001-0010-1, recorded in Volume 3291, Page 580, Collin County Deed Records. The easement area includes 1.06 acres and is 20' in width, along the west side of the 77.13 acre tract, to be used for location of utility lines and appurtenances.
