A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS
REPEALING CITY OF ANNA, TEXAS RESOLUTION NUMBER 2005-10-04
REGARDING ·rHE ULTIMATE BOUNDARY LINE AGREEMENT WITH THE CITY OF
WESTON, TEXAS
WHEREAS, on October 25, 2005, the City Council of the City of Anna, Texas ("City
Council") adopted Resolution No. 2005-10-04 with respect to a document titled
Ultimate Boundary Line Agreement ("Boundary Agreement") that had been
discussed by representatives of the City of Anna ("Anna") and the City of Weston
("Weston"); and
WHEREAS, the City Council adopted Resolution No. 2005-10-04 to authorize the
execution of the Boundary Agreement based on the impression that Anna and
Weston had mutually assented to the terms of the Boundary Agreement; and
WHEREAS, the City Council has determined and finds that Weston never assented to
the terms of the Boundary Agreement, never provided Anna with any consideration to
support the Boundary Agreement, never executed the Boundary Agreement, and
rejected any offer to enter into the Boundary Agreement; and
WHEREAS, the City Council desires to withdraw any offer regarding or otherwise
pursue the Boundary Agreement; and
WHEREAS, the Boundary Agreement was never mutually assented to and the City
Council desires to repeal City of Anna, Texas Resolution No. 2005-10-04 and adopt this
resolution and the findings herein to memorialize that the Boundary Agreement never
came into effect and to assure that Anna's records accurately reflect same;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The determinations, findings and recitals above are incorporated herein as if set forth in
full for all purposes.
Section 2. City of Anna, Texas Resolution No. 2005-10-04 Repealed.
The City of Anna, Texas Resolution No. 2005-10-04 is hereby repealed in its entirety.
