RESOLUTION NO. 2011-01-01
A RESOLUTION REQUESTING THAT THE STATE HIGHWAY 121 REGIONAL TOLL
REVENUE FUNDS HELD IN THE DALLAS-FORT WORTH SUB-ACCOUNT WITHIN
FUND 6 BE HELD IN RESERVE FOR NORTH TEXAS TRANSPORTATION
PROJECTS IN ACCORDANCE WITH THE STATE HIGHWAY 121 PROJECT
AGREEMENT BETWEEN THE NORTH TEXAS TOLLWAY AUTHORITY (NITA) AND
THE TEXAS DEPARTMENT OF TRANSPORTATION (TXOOT)
WHEREAS, the North Central Texas Council of Governments (NCTCOG) is designated
as the Metropolitan Planning Organization for the Dallas-Fort Worth Metropolitan Area
by the Governor of the State of Texas in accordance with federal law; and,
WHEREAS, the Regional Transportation Council, comprised primarily of local elected
officials, is the regional transportation policy body associated with the North Central
Texas Council of Governments and has been and continues to be the regional forum for
cooperative decisions on transportation; and,
WHEREAS, on June 18, 2007, the Regional Transportation Council (RTC)
recommended to the Texas Transportation Commission (TTC) that the North Texas
Tollway Authority (NTTA) undertake the development, design, construction, financing,
operation, and maintenance of the S.H. 121 toll project in Collin and Denton Counties;
and,
WHEREAS, NTTA, and the Texas Department of Transportation (TxDOT) entered into
a project agreement for S.H. 121. Per the terms of that agreement, NTTA transferred
approximately $3.2 billion of the Regional Toll Revenue into the Dallas-Fort Worth sub
account within Fund 6; and,
WHEREAS, on January 24, 2008 the Regional Transportation Council approved a
Resolution requesting that all S.H. 121 regional toll revenue proceeds paid by NTTA
into Fund 6, including interest earned, be transferred to local financial institutions,
controlled by the RTC as part of the "Public Sector Credit Union Bank"; and,
WHEREAS, funds from the S.H. 121 regional toll revenue proceeds, including interest
have not been transferred and remain in Fund 6; and,
WHEREAS the RTC has designated funds from the S.H. 121 regional toll revenue
proceeds to pay for needed construction projects throughout the north Texas region,
including the reconstruction of FM 455 in the City of Anna, Texas; and,
WHEREAS, without the S.H. 121 regional toll revenue funds, it will not be possible to
complete the reconstruction of FM 455 within the City of Anna;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS THAT:
Section 1. Recitals Incorporated
The recitals set forth above are incorporated herein for all purposes as if set forth in full.
Section 2. Request that S.H. 121 Project Funds be held in Reserve.
The City Council of the City of Anna, Texas hereby requests that the Texas Legislature
and the Texas Department of Transportation continue to hold in reserve all proceeds,
including interest from the State Highway 121 Project Agreement between NTT A and
TxDOT for the transportation projects in north Texas identified by the RTC to be funded
by regional toll revenue funds, including the reconstruction of FM 455 in the City of
Anna, Texas. The City Council further requests that all members of the Texas
Legislature oppose any effort to reallocate or use said funds for any other purpose.
PASSED AND APPROVED by the City Council of the City of Anna, Texas on this 25th
