RESOLUTION NO. 2011-02-07
A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING A CONTRACT AND
AUTHORIZING EXECUTION OF SAME FOR THE PURCHASE OF A FIRE ENGINE.
WHEREAS, the City Council of the City of Anna, Texas ("City Councin finds that the
City of Anna Fire Chief--in furtherance of the Fire Department's purpose of preserving
and protecting the public health and safety of the City's residents-has. after extensive
research, recommended that the City purchase a new fire engine for fire prevention and
protection services, and specifically recommends that the City purchase an E-One
Tradition Pumper with Typhoon Chassis, 1250 GPM Pump, and a 1000 gallon tank
("Fire Engine"); and
WHEREAS, the City of Anna, Texas (the "City") has received a written quote from Hall
Mark Fire Apparatus -Texas LLC to purchase the Fire Engine for the purchase price of
$269,500; and
WHEREAS, the City's Financial POlicy adopted on September 28, 2010 by Ordinance
No. 511-2010 requires that all purchases above $50,000 must be purchased under
fonnal competitive sealed bidding rules or as otherwise pennitted by the Texas Local
Government Code under Chapters 252 and 271; and
WHEREAS, Section 252.022(a)(2) of the Texas Local Government Code exempts from
competitive bidding a procurement necessary to preserve or protect the public health or
safety of the municipality's reSidents; and
WHEREAS, the City's Fire Chief has advised the Council and the Council has found
and detennined that the purchase of the Fire Engine is necessary and essential to
preserve and protect the public health or safety of the City's residents; and
WHEREAS, the City Attorney has advised that based on these findings competitive
bidding is not required for the purchase of the Fire Engine as it falls under the
exemption in Section 252.022(a)(2) of the Texas Local Government Code; and
WHEREAS, the purchase price contained in the written quote offered by Hall-Mark
Apparatus -Texas LLC is identical to the purchase price for the same Fire Engine
offered by Hall-Mark through the Texas Local Government Purchasing Cooperative
competitive procurement program;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS THAT:

Section 2. Approval of Contract
The City Council hereby authorizes the City Manager to execute on its behatf, subject to
legal review and approval by the City Attorney, a contract with Hall-Mark Fire Apparatus
-Texas LLC for the purchase of the Fire Engine, as shown on the written quotation
attached hereto as Exhibit 1.
PASSED AND APPROVED by the City Council of the City of Anna, Texas on this 22nd
day of February 2011.
