HomeMy WebLinkAboutRes 2011-04-03 Public Necessity-Permanent Utility Easement-CDBG.pdfCITY OF ANNA, TEXAS RESOLUTION NO. 2011-04-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, FINDING THAT A PUBLIC NECESSITY EXISTS FOR ACQUISITION OF 1.548 ACRES OF REAL PROPERTY, MORE OR LESS, FOR A PERMANENT UTILITY EASEMENT; AUTHORIZING THE CITY MANAGER AND HIS STAFF AND THE CITY'S ATTORNEYS TO ACQUIRE SAID PROPERTY BY ANY LAWFUL MEANS, INCLUDING BUT NOT LIMITED TO NEGOTIATIONS AND, IF NECESSARY, PROCEEDINGS IN EMINENT DOMAIN; PROVIDING AN EFFECTIVE DATE. WHEREAS, there is a need to provide utility system improvements to benefit the City of Anna, its citizens and general health, safety and welfare; and WHEREAS, it is necessary to acquire property not now owned by the City of Anna for such utility system improvements; and WHEREAS, it is necessary to establish procedures for determining the establishment and approval of just compensation for the permanent utility easement(s) to be acquired for such project; and WHEREAS, the City Council ("Council") of the City of Anna, Texas ("City") finds that a public necessity exists for acquisition of one or more permanent utility easements comprising 1.548 acres of real property, more or less, which is more particularly described in Section 2 of this resolution, for the purposes of installation, maintenance, replacement, or repair of utilities benefiting the public health, safety and welfare; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANNA, TEXAS, THAT: Section 1. Purpose 1.01 The above-listed recitals are incorporated herein as if set forth in full for all purposes. 1.02 This resolution is intended to comply in all respects with the Texas Local Government Code § 251.002 and Texas Property Code § 21.001 et seq. 1.03 This Council by this resolution intends to exercise the City's powers under Texas Local Government Code § 251.001 and § 552.002(b). Section 2. Property to be Acquired Res. 2011-04-03 Public Necessity-TCOBG easements PAGE 1 OF 3 04-12-11 2.01 The necessary permanent utility easements sought to be acquired will affect approximately 1.548 acres of real property ("the Property"), held by several owners. Said approximate 1.548 acres of real property are generally aligned and located on and along certain segments of certain of the Water Lines depicted in the attached Exhibits "A" and "B." Each of the permanent utility easements sought to be acquired from the owners of the Property, under which easements certain of said utility lines shall run, are further described and depicted in the following attached Exhibits, each of which is incorporated herein by reference: "C-1" "G-1" "K-1" "0-1" "C-2" "G-2" "K-2" "0-2" "D-1" "H-1" "L-1" "P-1" "D-2" "H-2" "L-2" "P-2" "E-1" "1-1" "M-1" "0-1" "E-2" "1-2" "M-2" "0-2" "F-1" "J-1" "N-1" "R-1" "F-2" "J-2" "N-2" "R-2" "S-1" "S-2" 2.02 In addition to the permanent utility easements described in subsection 2.01, above, temporary "secondary easements" are sought to be acquired to allow temporary use of areas outside the Property including strips of real property of up to twenty (20) feet in width that are alongside and adjacent to said permanent utility easements as may be reasonably necessary to construct and install the necessary facilities and improvements within said permanent utility easements that are reasonably suited for the purpose of said permanent utility easements. After full completion of construction and installation of said facilities and improvements, said secondary easement shall expire. Section 3. Finding of Public Necessity and Authorization to Take Action 3.01 The Council finds a public necessity for the public welfare and convenience to acquire the easements identified in Section 2, above, for the purpose of a permanent utility easement and other municipal purposes. The Council authorizes the City Manager, his staff, and, Wolfe, Tidwell & McCoy, LLP attorneys to acquire the needed Property by any lawful means including but not limited to negotiations with landowners and, if necessary, proceedings in eminent domain. 3.02 The Council by this resolution directs the City Manager, his staff, and Wolfe, Tidwell & McCoy, LLP attorneys to-as necessary-have the Property appraised by a certified appraiser, to send the landowners a copy of the landowner's bill of CITY OF ANNA, TEXAS RESOLUTION No.~{)JI'" Ot:~ PAGE 2 OF 3 '" rights statement, to enter into good-faith negotiations with the landowners and make any necessary final monetary offers in an attempt to acquire the permanent utility easements on and under the affected Property consistent with the appraisal(s) and to convey the City's desire to acquire an easement through the Property in an efficient manner, and, if necessary, to institute proceedings in eminent domain and take aU necessary actions in such proceedings to condemn and acquire the Property. The Council hereby authorizes and ratifies any such actions taken thus far. Section 4. Effective Date. This resolution shall take effect immediately upon its passage.
