RESOLUTION NO. 2011-06-05
A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING AND AUTHORIZING THE
CITY MANAGER TO ACT ON THE CITY'S BEHALF IN EXECUTING A CONTRACT WITH
5THQUALITY EXCAVATION FOR THE STREET AND WORTHAM STREET
REHABILITATION PROJECT, AND APPROVING A CONTINGENCY APPROPRIATION TO
FUND THE PROJECT.
WHEREAS, the City of Anna, Texas (the City) FY 2011 Budget has allocated $100,000 for a
street improvement project; and,
WHEREAS, the City staff has recommended that the funds be used to rehabilitate a portion
of 5th Street and Wortham Street (the "Project"); and,
WHEREAS, the City Council of the of the City of Anna, Texas (the City Council) authorized
the Staff to solicit competitive bids for the Project; and,
WHEREAS, the City, having solicited competitive bids in accordance with State law, opened
said bids on May 31,2010; and,
WHEREAS, Quality Excavation is the apparent low bidder having submitted a base bid of
$75,012.50 and an alternate bid of $37,283.50 for a total bid of $112,296.00; and,
WHEREAS, the City Council desires to award the Project bid to Quality Excavation and
execute a contract between the City and Quality Excavation for the Project;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, 'rHAT:
Section 1. Recitals Incorporated.
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Approval and Authorization of Contract.
The City Council hereby approves the Contract attached hereto as Exhibit 1 for the 5th
Street and Wortham Street Rehabilitation Project, and authorizes, ratifies and approves the
City Manager's execution of same. The City Manager is hereby authorized to execute all
documents and to take all other actions necessary to finalize, act under and enforce the
Contract.

Section 3. Contingency Appropriation
Consistent with Section 7.08 of the Anna City Charter, the City Council hereby authorizes the
City Manager to transfer $12,000 from the FY 2011 Budget Contingency Appropriation to the
Street Capital Improvement account No. 10-580-6933.
