HomeMy WebLinkAboutRes 2011-08-02 Granting Exemption to Application of Certain Provisions of Personnel Policy ManualCITY OF ANNA, TEXAS RESOLUTION NO. 2011-08-02 A RESOLUTION OF THE CITY OF ANNA, TEXAS, GRANTING EXEMPTION TO APPLICATION OF CERTAIN PROVISIONS OF PERSONNEL POLICY MANUAL WHEREAS, the City of Anna, Texas ("the City") has previously adopted the City of Anna Personnel Policy Manual ("the Manual"), which describes guidelines and policies for the City's personnel; and WHEREAS, the City of Anna, Texas City Council ("City Council") has determined that it is in the City's best interest to exempt the current City Secretary from the application of certain personnel policies. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The above -referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Exemption from Personnel Policy Manual. 2.01 The City Council has found and determined that it is in the best interests of the City to allow the current City Secretary to use accrued sick and/or vacation leave to supplement workers' compensation payments received or to be received by the said City Secretary to the extent that the sum of the benefits paid through worker's compensation and the salary and wages paid by the City of Anna do not at any time exceed the present take-home compensation provided to the City Secretary in the absence of being away from work due to temporary incapacity stemming from an on-the-job injury that occurred on July 12, 2011. Take-home compensation means the net pay plus the amount normally deducted for dependent health insurance and supplemental life insurance as shown on the attached Exhibit A. 2.02 This allowance is an authorized exemption from any City policies to the contrary, including any provisions of the rules, policies or regulations contained in the City of Anna Personnel Policy Manual. 2.03 This allowance is effective immediately upon the adoption of this resolution and shall authorize the City Secretary's use of sick and/or leave time beginning on Res. 2011-08-02 Personnel Manual Exemptions Page 1 of 2 08-02-11 July 13, 2011. 2.04 This allowance shall be in effect until the City Secretary is released to return to work, until she exhausts her accrued sick and vacation time, or until it is revoked by official action of the City Council, whichever may occur first. 2.05 The City Secretary shall have complete discretion on whether or not to exercise the expenditure of accrued sick and vacation time in accordance with this Resolution and the amount of such time to be expended. Section 3. Effective Date. This resolution shall become effective immediately upon adoption. PASSED by the City Council of the City of Anna, Texas, on this the 2nd day of August, 2011.
