A RESOLUTION OF THE CITY OF ANNA, TEXAS REPEALING RESOLUTION NO. 2010
07 -04 WHICH ALLOWS MEMBERS OF THE CITY COUNCIL TO SIMULTANEOUSLY
SERVE AS A MEMBER OF THE CITY FIRE DEPARTMENT IN A VOLUNTEER CAPACITY
WHEREAS, on July 13, 2010 the City Council of the City of Anna, Texas (the "City Council")
approved Resolution No. 2010-07-04 which allows members of the City Council to
simultaneously serve as a member of the City Fire Department in a volunteer capacity; and,
WHEREAS, the City Council finds that repealing said Resolution is in the best interests of the
City;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS THAT:
Section 1. Recitals Incorporated
The recitals set forth above are incorporated herein for all purposes as if set forth in full.
Section 2. The City Council hereby repeals Resolution No. 2010-07-04 attached hereto as
EXHIBIT 1.
Section 3. The effective date of this resolution is May 1, 2012, upon which date Resolution
2010-07-04 shall be considered repealed and rescinded; Resolution No. 2010-07-04 shall
remain in full force and effect until said effective date.
PASSED AND APPROVED by the City Council of the City of Anna, Texas, on this 25th day of
October, 2011.

A RESOLUTION OF THE CITY OF ANNA, TEXAS ALLOWING IIEIlBERS OF
ITS CITY COUNCIL TO S.ULTANEOUSLY SERVE AS A MEMBER OF THE
CITY FIRE DEPARTMENT IN A VOLUNTEER CAPACITY
WHEREAS. the City Council of the City of Anna. Texas ("'City Council") recognizes that
volunteers make important contributions to the CXI1lllU1ity; and
WHEREAS. the City Council encourages participation in both local government and
volunteer organizations that protect the community's health. safety and welfare: and
WHEREAS, Section 21.003 of the Texas Local Government Code allows a member of
a governmental body to simultaneously serve as a volunteer for an organization that
protects the health, safety and welfare of the municipality regardless of whether the
organization is funded or supported in whole or part by the municipally if the gowHlling
body adopts a resolution allowing members of the governing body to perform service of
that nature:
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:

The City's Fire Department protects the general health. safety and welfare of the City of
Anna, Texas reily'"). Any member of the City Council may serve as a member of the
City's Fire Department in a volunteer capacity provided that the City Council member is
otherwise qualified to serve in such capacity in accordance with any other applicable
law. City ordinance, or internal City policy. Any City Council member who becomes a
volunteer member of the City's Fire Depa1ment-whene acting in said capacity
shall be subject 10 all applicable provisions of the City of Anna Personnel Policy Manual,
all internal policies of the Fire Department. the authority of those in the Fire
Department's chain of command. and the authority of the City Manager. At all times
such City Council member shall act in accordance with the City of Anna, Texas Home
Rule Charter, the City's codes or rules setting forth standards of ethics for public
officials, and all other laws and ordinances that prohibit conduct by a City Council
member including without Imitation those related to interactions with City staff,
representation of groups before the City Council, conflicts of interest. exerting
authoritylinfluence resulting in special treatment or benefits, or other conduct that
conflicts or interferes with the Fire Department's morale. chain of command. or the

who becomes a volunteer member of the City's Fire Department is subject to being
removed from the Fire Department in the same manner as any other volunteer member
of the File Department.
