RESOLUTION NO. 2011-11-03
A RESOLUTION OF THE CITY OF ANNA, TEXAS EXPRESSING SUPPORT FOR: (1)
COLLIN COUNTY COMMISSIONERS COURT TAX INCENTIVE PROGRAM (50/3) TO
ENCOURAGE THE CREATION AND RELOCATION OF NEW BUSINESS TO COLLIN
COUNTY, SUBJECT TO CERTAIN ELIGIBILITY LIMITATIONS; AND (2) COLLIN
COUNTY COMMISSIONERS COURT TO ADOPT A BROADLY APPLICABLE TAX
ABATEMENT POLICY THAT DOES NOT DISCRIMINATE AGAINST SMALL
BUSINESSES AND THAT ENCOURAGES BUSINESSES OF ALL SIZES DESIRING
TO LOCATE IN ANY COLLIN COUNTY MUNICIPALITY FOR THE PURPOSES OF
JOB GROWTH AND ECONOMIC DEVELOPMENT
WHEREAS, it has been reported to the City Council of the City of Anna, Texas ("City Council")
that the Collin County Commissioners Court voted on October 10th to enact a tax incentive
program (50/3) to encourage the creation and relocation of new businesses to Collin County;
and
WHEREAS, it has been reported to the City Council that the 50/3 program will be adopted
pursuant to Chapter 381 of the Local Government Code and will provide a 50% "refund" for
each of the first 3 years that an eligible business is in operation; and
WHEREAS, the City Council desires to express its support for the 50/3 program, provided that
the certain types of businesses that would create negative secondary effects are excluded from
the program; and
WHEREAS, it has been reported to the City Council that the Collin County Commissioners
Court is considering the adoption of a policy governing a tax abatement program that could
have a Significant impact on development within the City; and
WHEREAS, the City Council believes that small business and business startups that might
otherwise not relocate to Collin County would be significantly more motivated to do so if the
County's tax abatement program was broad enough to allow such businesses to participate;
and
WHEREAS, the City Council finds that small businesses employ millions of people in Texas and
that counties and communities that compete for small businesses will see greater job growth
and economic development than those that restrict small business from tax incentive/abatement
programs; and
WHEREAS, the City Council desires to support the Commissioners Court in adopting a policy
that supports small businesses and smaller municipalities in a fair and sufficient manner by not
limiting tax abatement program eligibility in a manner that would exclude smaller businesses or
business startups from the benefits of such a policy or have the effect of discriminating in favor
or larger municipalities and larger businesses; and
WHEREAS, while the City Council supports the 50/3 program and a tax abatement program
that would encourage businesses of all sizes to locate in Collin County, the City Council has

determined that it should request that the Commissioners Court limit eligibility for such programs
by excluding certain types of businesses that would be harmful to desirable growth in and near
the City based on negative secondary effects such businesses would generate; and
WHEREAS, the City Council finds that the following types of businesses would generate
negative secondary effects if located within or near the City: (1) adult entertainment businesses,
including but not limited to adult arcades, adult video and/or bookstores, adult novelty stores,
adult cabarets, adult motion picture rooms and theaters, nude modeling studios, adult hotels or
sexual encounter centers, and massage parlors; and (2) short term loan agencies, fat rendering
plants, garbage offal or dead animal reduction plants, tattoo parlors, body piercing shops, and
retail outlets specializing in drug paraphernalia used for consumption of cannabis and other
recreational drugs;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS THAT:
Section 1. Recitals Incorporated
The recitals set forth above are incorporated herein for all purposes as if set forth in full.
Section 2. Support of 5013 Economic Development Program
The City Council hereby expresses its support for the Collin County 50/3 Economic
Development Program, requesting that the following types of businesses not be eligible for the
program: (1) adult entertainment businesses, including but not limited to adult arcades, adult
video and/or bookstores, adult novelty stores, adult cabarets, adult motion picture rooms and
theaters, nude modeling studios, adult hotels or sexual encounter centers, and massage
parlors; and (2) short term loan agencies, fat rendering plants, garbage offal or dead animal
reduction plants, tattoo parlors, body piercing shops, retail outlets specializing in drug
paraphernalia used for consumption of cannabis and other recreational drugs, establishments
that permit 8-liner machines, and illegal gambling establishments.
Section 3. Support of Broad Eligibility for Tax Abatement Program
The City Council hereby expresses its support for broad eligibility for businesses with respect to
any tax abatement program adopted by the Collin County Commissioners Court such that the
County's policy/program would not have the effect of discriminating against a business based
on its size or amount of taxable assets, but requests that the following types of businesses not
be eligible for the program: (1) adult entertainment businesses, including but not limited to adult
arcades, adult video and/or bookstores, adult novelty stores, adult cabarets, adult motion picture
rooms and theaters, nude modeling studios, adult hotels or sexual encounter centers, and
massage parlors; and (2) short term loan agencies, fat rendering plants, garbage offal or dead
animal reduction plants, tattoo parlors, body pierCing shops, and retail outlets specializing in
drug paraphernalia used for consumption of cannabis and other recreational drugs,
establishments that permit a-liner machines, and illegal gambling establishments.
