RESOLUTION NO. 2013-04-05
A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING AND AUTHORIZING THE
CITY MANAGER TO ACT ON THE CITY'S BEHALF IN EXECUTING AND APPROVING
CHANGE ORDER NO. 1 AND CHANGE ORDER NO. 2 TO THE CONTRACT WITH
QUALITY EXCAVATION, LTD. FOR THE FM 455 UTILITY RELOCATION PROJECT
WHEREAS, on October 23, 2012, the City of Anna, Texas (the City) award a contract to
Quality Excavation, Ltd. for the FM 455 Utility Relocation Project (the "Project"), and;
WHEREAS, during the course of construction City Staff has identified several changes that
need to be made to the Project (including the addition of a number of valves, hydrants, and
connections that were not included in the original construction plans), and the cost of these
changes (Change Order No. 1) will be $152.905.50, and;
WHEREAS, the project engineer estimates that TxDOT will reimburse the City for 51.65% of
the cost of Change Order No. 1 making the City responsible for $73,925.31, and;
WHEREAS, Collin County has agreed to contribute funds (not to exceed $800,000) to cover
50% of the total project costs, and the City Staff anticipates that the City's cost for Change
Order No. 1 will be covered by the financial contribution from Collin County, and;
WHEREAS, the construction of the Oak Hollow sound wall will require the City to relocate a
water line adjacent to this subdivision, and the cost of this water line relocation (Change
Order No. 2) will be $69,829.25, and;
WHEREAS, the project engineer has advised the City that TxDOT will reimburse the city
100% of the cost of Change Order No. 2;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Approval of Change Order No. 1 and Change Order No. 2.
The City Council hereby approves Change Order No. 1 and Change Order No. 2 to the
contract with Quality Excavation, Ltd., attached hereto as Exhibit 1 and Exhibit 2
respectively; and authorizes, ratifies and approves the City Manager's execution of same.
The City Manager is hereby authorized to execute all documents and to take all other
actions necessary to finalize, act under, and enforce the Change Orders.
PASSED AND APPROVED by the City Council of the City of Anna, Texas, on this 23rd day
of April, 2013.

Description of changes: Addition of valves, hydrants, fittings and connections of
water line.
Reason for Change Order: Original TxDOT survey was an aerial survey and did not
pick up all existing valves and hydrants. Development also occurred since the
original survey was performed 7 years ago.

Contract changes are approved as follows:
Description of changes: Relocation of approximately 900 feet of water line that is in
conflict with the proposed noise wall construction adjacent to the Oak Hollow
Subdivision.
Reason for Change Order: TxDOT is constructing a noise wall along the ROW
adjacent to the Oak Hollow subdivision as required by the environmental
documentation.
