RESOLUTION NO. 2013-09-03
A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING THE PRELIMINARY PLAT
FOR THE "LAKEVIEW ESTATES" GENERALLY LOCATED SOUTH OF WEST WHITE
STREET AND EAST OF FERGUSON PARKWAY SUBJECT TO THE SUBDIVISION
RULES AND REGULATIONS AND WAIVERS/SUSPENSIONS AND RELATED
CONDITIONS AS SET FORTH IN THIS RESOLUTION AND STIPULATIONS TO BE
ADDRESS THROUGH THE FINAL PLAT PROCESS.
WHEREAS, In order to provide for the orderly development of land within the Anna city limits
and extraterritorial jurisdiction, the City Council of the City of Anna, Texas (the "City Council")
has adopted Part III -A of the Anna City Code of Ordinances ("Subdivision Regulations"); and
WHEREAS, during the course of design the Developer of the area known as Lakeview
Estates is requesting waivers/suspensions to the City's Subdivision Regulations that will not
be detrimental to the public safety, health or welfare, and will not be injurious to other
property or the owners of other property, and the waiver/suspension will not prevent the
orderly subdivision of other property in the vicinity, and;
WHEREAS, development comments that are made by the staff through the review process
will be addressed by the developer's engineers during preparation of final construction plans
and related subdivision improvement agreements, and;
WHEREAS, the Planning and Zoning Commission has recommended that the City Council
approve the Lakeview Estates Preliminary Plat and certain waiver/suspension, with certain
conditions as set forth herein.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Approval of Preliminary Plat
The City Council hereby approves the Lakeview Estates Preliminary Plat subject to the staff
comments, attached hereto as Exhibit 1, and the following variances to the City's
Subdivision Regulations, subject to the conditions set forth in Section 3 of this resolution.
1.) Block "C" can exceed the minimum block depth of 800'.
2.) The double frontage lots that backup to Ferguson Parkway are not required to have
10' of extra depth.
Section 3. Conditions
It shall be a condition to the approval of the waivers/suspensions described in Section 2,
above, that all lots depicted in the Lakeview Estates Preliminary Plat must be developed in

terms of lot sizes and lot widths as shown, in a manner that is substantial similar to said
Preliminary Plat, and that the median lot size shall not be less than 7700 square feet and the
average lot size shall not be less than 8300 square feet. No Final Plat or Replat shall be
approved that substantially varies from said Preliminary Plat in terms of lot sizes or lot widths,
notwithstanding minor changes may be approved as allowed in the Anna City Code of
Ordinances, Part III -A, Article 2, Section 3.06(a). Further, the City Council reserves the right
at its discretion to revoke the waivers/suspensions described in Section 2, above, if the lots
are not developed in the manner prescribed in the Preliminary Plat in terms of lot sizes and/or
lot widths.
PASSED AND APPROVED by the City Council of the City of Anna, Texas, on this 24" day
of September, 2013.
