AND WELFARE OF THE CITIZENS OP ANNA, TEXAS;
ADOPTING THE UNIFORM FIRE CODE, X985 EDITION;
PROVIDING FOR ENFORCEMENT AND ADMINISTRATION;
PROVIDING LIMITS RELATIVE TO STORAGE OF ;:FLAMMABLE
LIQUIDS, LIQUIFIED PETROLEUM GASES, AND'I-$XPLOSIVES
AND BLASTING AGENTS; PROVIDING FOR APPEALS TO THE
CITY COUNCIL; PROVIDING FOR A SEVERABILI'YY;CLAUSE;
ESTABLISHING PENALTIES FOR VIOLATIONS; AND.SETTING
AN EFFECTIVE DATE.1+
WHEREAS, it is deemed by the City Council pf the City of
Anna that a set of regulations and standards?'governing con-
ditions hazardous to life and property from fire and explo-
sion is necessary to protect the public health welfare, and
safety of the citizens of the city; now theregore

SECTION l: UNIFORM FIRE CODE ADOPTED

purpose of prescribing regulations governing'" conditions
hazardous to life and property from fire .an&,,,,explosion,•the
1985 Edition of the Uniform Fire Code pu4l ished by the
Western Fire Chiefs Association and they International
Conference of Building Officials, save and except such por-
tions as hereafter deleted, modified, or amended ,.`, including

all appendices thereto. One (1) copy of 94idr•eode is on
file in the office of city administrator,Which:,shall-be
subject to inspection at all times during r'' lar :rbus iness
hours.

SECTION 21 ENFORCEMENT
The Uniform Fire Code shall be enforced by:,R the ':Bureau of
Fire Prevention of the City 9£ Anna, Texas,'ahich is hereby
established and which shall' be operated, under the super-
vision of the Fire Marshal. Wherever thewords "Chief of
the Bureau of Fire Prevention are used in •thelUniform Fire

SECTION 3s JURISDICTION DEFINED
When the word "jurisdiction" is used in tho" Uniform Fire
Code, it shall mean the Anna fire distri# '`boundary' as

SECTION 4s ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH
STORAGE OF FLAMMABLE OR COMBUST$BLE'LIQUIDS IN
OUTSIDE ABOVEGROUND TANKS IS PROHIBITED

The storage of flammable or combustible ligJlds in outside
aboveground tanks is prohibited within the city limits
unless a special use permit has been grantedby the city
council in accordance with the city's zoning regulations..
SECTION 5s ESTABLISHMENT OF LIMITS IN Wo STORAGE OF
LIQUEFIED PETROLEUM GASES IS TO'$1; RESTRICTED
The limits referred to in Section 82.105(a)' ', fr` the Uniform
Fire Code, in which storage of liquefied` petroleum' gas is
restricted, are hereby established as to be'hfi'thin the city
limits unless a special use permit' has been,°,granted by x•the

tions.
SECTION 6s ESTABLISHMENT OF LIMITS OF DISTAICTS'IN WHICH
STORAGE OF EXPLOSIVES AND BLAS xNG AGENTS IS
PROHIBITED

SECTION 7s APPEALS ,,+ T Z6
When the Fire Marshal disappioves an application or refuses
to grant a permit applied for or or when it is:, claimed that
the provisions of the Code do not apply or' `.that'"the true
intent and meaning of the Code has been misconstrued or
wrongly interpreted, the person aggrieved shall have the
right to make an appeal to the city council.'''?;"Such appeal
shall be perfected by written notice submitted,;:to'the city

SECTION 8s SEVERABILITY 1.' y
It is hereby declared to be the intention of r;�r eA{`city coun-
cil that the sections, paragraphs, sentenceRtvllclauses and
phrases of this ordinance are severable and, I# any phrase,
clause, sentence, paragraph, or section shal'3 be 'declared
unconstitutional by the valid judgment or 'decree of any
court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases,{{;clauses, sen-
tences, paragraphs and sections, since the salve would have
been enacted by the city council without the 4,incorporation
of any unconstitutional phrase, clause, sentea ,,'paragraph,
or section.
SECTION 91 PENALTY
Any person violating any of the provisions ofis,ordinance
shall be deemed guilty of a misdemeanor, ans ruponconvic-
tion, shall be subject to a fine of not, mope•. than one
thousand dollars ($1,000.00)t provided, -,.how er, that no
penalty shall be greater or less than the pelilty provided
for the same or similar offense under the lawslit'the state.
Each transaction in violation of any of th;e'� provisions
hereof shall be deemed a separate offense. roseeution or
conviction under this provision shall not be,.,a ' bar to any
other remedy or relief for violations of this I'd.inance. # h
SECTION 10i EFFECTIVE DATE

This ordinance shall take effect immediatelyFI,
