I D11 -91) NATIONAL ELECTRICAL CODE AN ORDINANCE ADOPTING THE NATIONAL ELECTRICAL CODE, 1987 EDITION; ESTABLISHING THE SCOPE OF THE ORDINANCE; RESTRICTING THE LIABILITY OF THE CITY; ESTABLISHING THE OFFICE AND DUTIES OF THE ELECTRICAL INSPECTOR; ESTABLISHING ELECTRICAL PERMIT REQUIREMENTS AND FEES; ESTABLISHING REGISTRATION AND LICENSING REQUIREMENTS FOR PERSONS PERFORMING ELECTRICAL WORK; AMENDING THE NATIONAL ELECTRICAL CODE BY PRESCRIBING CONDUCTOR MATERIALS, RESTRICTING ALUMINUM WIRE USAGE, AND RESTRICTING KNOB -AND -TUBE WIRING; PROHIBITING UNAUTHORIZED WIRING OR CONNECTIONS BY ELECTRIC POWER COMPANIES; AUTHORIZING EMERGENCY POWER DISCONNECTIONS; PROVIDING FOR APPEALS TO THE CITY COUNCIL; PROVIDING FOR A SEVERABILITY CLAUSE; ESTABLISHING PENALTIES FOR VIOLATIONS: AND SETTING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: SECTION 1: NATIONAL ELECTRICAL CODE ADOPTED The 1987 Edition, and all subsequent revisions, stan- dards, or supplements thereto, of the National Electrical Code of the National Fire Prevention Association, is hereby adopted by reference and made part of this section as the general standard for electrical equipment and installations in the city, except such provisions thereof as may be in conflict with this ordinance. All electrical equipment installed or used in the city and all installations of electrical equipment shall be reasonably safe to persons and pro- perty in conformity with the standards provided in the National Electrical Code, 1987 li cable state sition, and ith the t tutee provision of this section and app and any rules and regulations issued by authority thereof. A copy of the .National Electrical Code referred to herein is on file in the office of the city secretary for reference and inspection. IV SECTION 2: SCOPE The provisions of this section shall apply to all installations of electrical conductors, fittings, devi- ces, signs, fixtures, motors, generators, starters, controls and raceways, hereinafter referred to as "electrical equipment," within or on public and private buildings and premises within the city. SECTION 3: LIABILITY OF CITY This section shall not be construed to affect the responsibility or liability of any party owning, operating, controlling or installing any electrical equipment for damages to persons or property which were caused by any defect in such equipment or in the installation thereof, nor shall the city be held as assuming any liability by reason of the inspection, failure to inspect or reinspection authorized herein or the certificates of conformance or nonconformance issued as herein provided, or by reason of the approval or disapproval of any equipment authorized herein. SECTION 4: ELECTRICAL INSPECTOR A. Office of Electrical Inspector Created The office of electrical inspector of the City of Anna is hereby created. Such electrical inspector shall be competent to perform the duties of this office and shall be appointed by the mayor and shall receive such compen- sa�ion as fixed by the city council. B. Duties of the Electrical Inspector It shall be the duty of the electrical inspector to see that all provisions of this section are fully complied with and make inspections of electrical installations. The electrical inspector shall keep complete records of all permits issued, inspections made, and any other official work performed. It shall be the duty of the 0 4V electrical inspector to inspect all electrical wiring and apparatus in the City of Anna at any time in order to ascertain whether such electrical wiring or apparatus is in any respect dangerous to life or property; and, if any part of said electrical wiring or apparatus shall be found to be defective or in dangerous condition, he shall notify in writing the owner of such wiring or equipment to have the defect corrected within a reaso- nable time. It shall be the duty of the electrical inspector to notify the service company, firm or indivi- dual furnishing electric current to such defective wiring or equipment to cease to supply electricity to same. Upon receipt of such notice, the service company, firm or individual furnishing electric current to such defective wiring or equipment shall immediately discon- nect the service or feed wires and cease to supply current to the defective installation until the defects have been corrected. SECTION 5: ELECTRICAL PERMITS A. permits Required (1) No individual, firm or corporation shall erect, construct, alter or change any electrical installa- tion, machinery, apparatus work or wiring in the City of Anna until a permit has been issued by the city. When required by the electrical inspector, plans and specifications for the proposed work must be filed before the permit is granted. (2) No permit will be required for the installation of wires to operate electrical bells, gas lighting apparatus, house annunciators, burglar alarms, telephones, telegraphs, district messengers, watch clocks, fire alarms or other similar instruments if current operating is of less than twenty-five (25) volts potential. (3) When any wiring or apparatus is installed in such a manner that the same could be used for electric light or power purposes under the provisions of this section, it shall be deemed that the said wiring or apparatus is to be used for such purposes and permit shall be required and inspection made as provided for such. 3 —• i or B. Registration Required U 11 erect No individual, firm or corporation s a , construct, alter or change any electrical installation, work, wiring or setting of electrical machinery or equipment until such individual, firm or corporation has registered with the city and obtained a registration license thereof. No electrical permit will be issued unless such person performing such work has first registered with the City of Anna and paid an annual license fee of twenty-five dollars ($25.00). Such registration license shall expire on the thirty-first (31st) day of December next following issuance thereof. B. Application for Registration License Any individual, firm or corporation desiring a registra- tion license shall make application to the city secre- tary. Such application shall contain the person's name, address, telephone and any other information that might seem pertinent or necessary. Any changes in address shall be immediately filed. with the city secretary. Where the holder of a registration license changes the firm name or where additional members are taken into the firm, or where the firm is incorporated, a notice of such change shall be forwarded to the city secretary, otherwise such registration license is liable to be revoked because of its questionable ownership. C. Re istration License is Not Transferrable It shall be unlawful for any individual, firm or cor- poration holding a registration license issued by the city to transfer same ti r to allow otherthe use f same, directly or indirectly, y an Y person pose of obtaining a permit to do any electrical work herein specified. D. Revocation Any failure on the part of the holder of such registra- tion license to comply with the provisions of any sec- tion hereof or any other applicable ordinance of the city regulating electrical work or to faithfully carry out the conditions of a contract for electrical work shall be deemed sufficient cause for revoking said registration license together with all rights and privi- leges hereunder. The city may also refuse to issue a registration license to any person associated with such previous holder of a revoked registration license. SECTION 7: AMENDMENTS TO NATIONAL ELECTRICAL CODE A. Section 310-2(b) - Conductor Material Section 310-2(b) of the 1987 National Electrical Code is amended as follows: Conductors in this code shall be of aluminum, copper - clad aluminum or copper unless otherwise specified. No aluminum wire under 3/0 shall be used within the City of Anna. B. Section 324 Concealed Knob -and -Tube Wiring Knqb-and-Tube wiring shall not be permitted when installing or repairing electrical installations. SECTION 8: ELECTRIC POWER COMPANIES NOT TO CONNECT UNTIL AUTHORIZED It shall be unlawful for any electric, light, heat or power company to do any wiring of any nature in or on any building (except power houses and substations of electric, light, heat and power company operating under a franchise granted by the city) or to make any electri cal connection to any,building or electrical wiring or apparatus until a certificate, stating that electric wiring has been approved, or written permit authorizing connection, has been issued by the electrical inspector. All firms, corporations or individuals, whether operating under a regular franchise granted by the city or not, shall upon written notice by the electrical inspector disconnect from any such circuit, including main service wires, branch feeder wires or distribution as designated by said notice, shall not reconnect to said installation except upon written notice from the electrical inspector. SECTION 9: WHEN WIRES MAY BE ORDERED DISCONNECTED Every company, firm, co -partnership, corporation or individual owning or controlling electrical wires and apparatus for the transmission of light, heat or power shall in time of fire or in case of severe climatic con- ditions or any other emergency wherein lives or property of the citizens of the City of Anna may be endangered by the operation of such wires and apparatus upon notice by the electrical inspector, the mayor or the chief of the fire department or chief of police, disconnect such dangerous wires from current or service as are designated by the electrical inspector. SECTION 10: APPEALS Any person aggrieved by an interpretation of the electrical code adopted by reference within this sec- tion, or by any decision or ruling by the city's designated inspector, shall have the right to make an appeal to the city council. Such appeal shall be per- fected by written notice submitted to the city secretary and addressed to the mayor and city council asking for a hearing by the council.. Such appeal must be made within thirty (30) days after the decision or ruling which is being appealed. Prior to rendering a decision on any appeal, the city council may seek expert advice and counsel. The appeal shall be considered by the city council and a response made in writing to appellant within thirty (30) days of the submission of the appeal, except that the thirty day response requirement may be waived upon consent of both council and appellant. SECTION 11: SEVERABILITY It is hereby declared ,to,, be the intention of the city council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable and, 6 if any phrase, clause, sentence, paragraph, or section shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections, since the same would have been enacted by the city council without the incorporation of any unconsti- tutional phrase, clause,- sentence, paragraph, or sec- tion. SECTION 12: PENALTY Any person violating any of the provisions of this ordi- nance shall be deemed guilty of a misdemeanor, and upon conviction, shall be subject to a fine of not more than one thousand dollars ($1,000.00); provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the laws of the state. Each transaction in violation of any of the provisions hereof shall be deemed a separate offense. Prosecution or conviction under this provision shall not be a bar to any other remedy or relief for violations of this ordinance. • SECTION 13: EFFECTIVE DATE This ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law in such cases provides.
