UNIFORM PLUMBING CODE
AN ORDINANCE TO PROTECT THE PUBLIC HEALTH, SAFETY
AND WELFARE OF THE CITIZENS OF ANNA, TEXAS;
ADOPTING THE UNIFORM PLUMBING CODE, 1985 EDITION;
AMENDING THE UNIFORM PLUMBING CODE, 1985 EDITION,
BY ESTABLISHING AN ADMINISTRATIVE AUTHORITY,
ESTABLISHING A SCHEDULE OF PERMIT FEES, PROVIDING
FOR APPEALS TO THE CITY COUNCIL; PROHIBITING USE OF
PVC PIPE BENEATH CONCRETE FOUNDATIONS; PROVIDING
FOR A SEVERABILITY CLAUSE; ESTABLISHING PENALTIES
FOR VIOLATIONS; AND SETTING AN EFFECTIVE DATE.
WHEREAS, it is deemed by the City Council of the City of
Anna, Texas, that a set of regulations and standards
governing installation, alteration, repair and replacement
of plumbing, piping, fillings, fixtures and equipment which

may be conducted to any water and sewer system in the city
is necessary to protect the public health, welfare and
safety of the citizens of this city; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS, THAT:
SECTION 1: UNIFORM PLUMBING CODE ADOPTED
There is hereby adopted for the purpose of prescribing
regulations governing the installation, alteration,
repair and replacement of plumbing, piping, fittings,
fixtures and equipment which may be conducted to any
water and/or sewer system in the city, that certain code
recommended by the International Association of Plumbing
and Mechanical Officials and endorsed by the
International Conference of Building Officials, known as
the Uniform Plumbing Code, being particularly the 1985
Edition thereof, and the whole thereof, including all
appendices thereto, save and except such portions as are
hereinafter deleted, modified, or amended. One (1) copy
of said code is on file in the office of city secretary
and the same is hereby adopted and incorporated as fully
as if set out at length herein.
SECTION 2: AMENDMENTS TO UNIFORM PLUMBING CODE
A. Section 20.1 - Administrative Authority
Section 20.1 is amended to include the following:
The administrative authority for enforcing the provi-
sions of this code shall be the city plumbing inspector
who shall be appointed by the city council. The
plumbing inspector shall not have any interest whatever,
directly or indirectly, in the sale or manufacture of
any material, process or device, entering into, used in
connection with, plumbing work within the City of Anna.
B. Section 20.3 - Violation and Penalties
Paragraph 1 of Section 20.3 shall be deleted and
replaced by the following:
Any person, firm or corporation violating any provision
of this code shall be deemed guilty of a misdemeanor and
subject to a fine and other penalties as provided for in
Section 5 of the ordinance adopting this code.
C. Section 20.7 -• Cost of Permit
Section 20.7 shall be deleted and replaced with the
following:
Every applicant for a permit to do work regulated by
this code shall state in writing, on the application
form provided for that purpose, the character or work
proposed to be done and the amount and kind in connec-
tion therewith, together with such information, per-
tinent thereto, as may be required.
Such applicant shall pay for each permit, at the time of
issuance, a fee in accordance with the following sche-
dule, and at the rate provided for each classification
shown herein.
Any person who shall commence any work for which a per-
mit is required without first having obtained a permit
therefor shall, if subsequently permitted to obtain a
permit, pay double the permit fee provided, however,
that this penalty shall not apply to emergency work when
it shall be proved to the .satisfaction of the admi-
nistrative authority that such work was urgently
necessary and that it was not practical to obtain a per-
mit therefor before cgmmencement of the work. However,
in such cases, a permit must be obtained as soon as it
is practical to do so, and if there be an unreasonable
delay in obtaining such permit, a double fee will be
charged.
SCHEDULE OF FEES
For plumbing system installations
in new building construction ............. $40.00
For plumbing system installations
in building additions or
.remodeling valued over $1,000 $20.00
For plumbing system installations
in building addition or $10.00
remodeling under $1,000 ..................
For repairing or replacing each $ 5.00
plumbing fixture .........................
D. Section 20.14 - AApeals_
Section 20.14 shall be deleted and replaced with the
followings
Any person aggrieved by an interpretation of the
plumbing code adopted by reference within this section,
or by any decision or ruling by the city's designated
plumbing inspector, shall have the right to make an
appeal to the city council. Such appeal shall be per-
fected by written notice submitted to the city council
asking for a hearing by the council. Such appeal shall
be made within thirty (30) days after the decision or
• ruling which is being appealed. Prior to rendering a
decision on any appeal, the city council may seek expert
advice and counsel. The appeal shall be considered by
the city council and a response made in writing to
appellant within thirty (30) days of the submission of
the appeal, except that the thirty day response require-
ment may be waived upon consent of both council and

SECTION 3: PVC BENEATH CONCRETE FOUNDATIONS PROHIBITED
The installation of poly vinyl/chloride (PVC) pipe
beneath concrete foundations and slabs is prohibited.
Copper is an acceptable material for use beneath such
concrete foundations and slabs.
SECTION 4: SEVERABILITY
It is hereby declared to be, the intention of the city
council that the sections, paragraphs, sentences,
clauses and phrases of this ordinance are severable and,
if any phrase, clause, sentence, paragraph, or section
shall be declared unconstitutional by the valid judgment

• or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and
sections, since the same would have been enacted by the
city council without the incorporation of any unconsti-
tutional phrase, clause, sentence, paragraph, or sec-
tion.
SECTION 5:N PENALTY
Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor, and
upon conviction, shall be subject to a fine of not more
than one thousand dollars ($1,000.00); provided,
however, that no penalty shall be greater or less than
the penalty provided for the same or similar offense
under the laws of the state. Each transaction in viola-
tion of any of the provisions hereof shall be deemed a
separate offense. Prosecution or conviction under this
provision shall not be a bar to any other remedy or
relief for violations of this ordinance.
SECTION 6: EFFECTIVE DATE
O This ordinance shall take effect immediately from and
after its passage and the publication of the caption, as
the law in such cases provides.
