ORDINANCE NO. 95-14
AN ORDINANCE OF THE CITY OF ANNA, TEXAS PRESCRIBING
CERTAIN RESTRICTIONS ON PARKING OF VEHICLES WITHIN
THE CORPORATE LIMITS OF THE CITY; ESTABLISHING A
PENALTY FOR VIOLATIONS; PROVIDING A SEVERABILITY
CLAUSE; ESTABLISHING AN EFFECTIVE DATE; AND VOIDING
ORDINANCE NO. 109-96.

No person shall Park any vehicle upon a street, other
than an alley, in such manner or under such conditlonv

1. No person shall park a vehicle within an alley in
such a manner or under such conditions as to leave
available loss than ten feet. (10+) of the width of
the roadway for the free movement of vehicular
traffic, and no person shall stop, stand, or park a
vehicle within an alley in such position as to
block the driveway to any abutti.nq property.
2. No person shall park a vehicle which is not a
commercial vehicle as defined :in subsection E below
within any alley situated in any business district.

In any case where any street in the City of Anna is
being torn up, repaired, paved, or where any work is
being done upon the same, making necessary the
regulation of traffic thereon, the mayor is hereby
authorized to prevent parking either altogether or to
any extent deemed wise by him for any certain period of
time that he may deem necessary, or to close the street
to traffic altoqether for such period of time by
erecting thereon official si.yns with the parking
restrictions clearly stated thereon.

It shall be unlawful for any person or any owner to
leave, park, or stand any truck—tractor, road tractor,

trailer, semi—trailer, bus, or anv other commercial
motor vehicle bearing commercial .license upon any public
street, alley, parkway, boulevard, or public placer,
provided, this section shall not apply to street
construction. maintenance, and repair equipment, trucks,
rollers, and implements, and trucks, equipment,
trailers, and vehicles used by public service utility
companies engagers in repairing or extending public
service utilities, and to motor buses when taking on or
discharging passengers at the customary bus stops, and
except all other vehicles designated herein when
tactually parked at a designated loading zone in those
areas of limited parking where loading zones are
designated; provided, further that this subsection shall
not apply to any vehicle defined or designated therein
developing as mechanical defect after such vehicle has
commenced to run, enro Ute, making it Unsafe to proceed
further, and in this event, it shall be lawful to stand
or park the vehicle during the time necessary to make
emergency repairs.

No person shall park a vehicle upon any street for the
principal purpose of:
1. Displaying such vehicles for sale.
2. Washing, greasing, or repairing such vehicles,
except repairs necessitated by an emergency.
3. Displaying for sale or selling any merchandise,

The mayor is hereby authorized to erect signs indicating
no parking upon that side of any street adjacent to any
school property when such parking would interfere with
traffic or create a hazardous situation.

No person shall stand or park a vehicle in front of any
entrance which provides access to hotels, motels,
theaters, skating rinks or to the Upper floors of any
building two (2) or more stories in height. Such
entrances shall remain open for fire or other emergency
purposes.

The mayor is hereby authorized to erect signs indicating
no parking capon any street when the width of the roadway
does not exceed twenty feet (201), or upon one side of a

street as indicaati•np by such signs when the width of the
roadway does not exceed thirty feet (30+). When
official signs prohibiting parking are erected upon
narrow s'tree'ts as authorized herein, no person shall
park a vehicle upon any such s'tree't in violation of ;any
such sign.

In the event; a highway .includes two ('r_') or more separate
roadways and traffic is restricted to one direction of
travel upon any such roadway, no person shall stand or
park a vehicle upon the left—hand sice of such one—way
roadway unless signs are erected to permit such standing
or parking. The mayor is authorized to determine when
standing or parking may be permitted upon the left—hand
side of any such one—way roadway and to erect signs
giving notice thereof.

The mayor is hereby authorized to determine and
designate by proper signs place:, in which the stopping,
standing, or vehicles would create an especially
hazardous condition or would cause unusual delay in
traffic..

No {:person shall allow, permit, or suffer any vehicle
registered in his name to stand or park in the City of
Anna in violation of any provisions of this section
regulating the standing or parking of vehicles.

If a vehicle is found unattended or unoccupied upon a
street, highway, alley, or other public place in
violation of any provision of this section regulating
the stopping, standing, or parking of vehicles, the same
is hereby declared a nuisance per se and the fact that
the vehicle is unattended or unoccupied by any person
shall be prima facie evidence that the owner unlawfully
stopped, placed, or parked such vehicle.

1.. It shall be unlawful for any person, owner, or
corporation to leave standing in any public street,
alley, or other public place any vehicle,

automobile, truck, trailer, or other character of
private property unattended for a longer continuous
Period of time than forty-eight (48) hours.
F:. If a vehicle is found unattended or unoccupied upon
a street. highway, alley, or other public place in
violation of this provision, the same is hereby
declared a nuisance per se and the fart that such
vehicle is unattended or unoccupied by any person
shall be prima facie evidence that the owner
unlawfully stopped, placed, or parked such vehicle.
The records of the State Highway Department or the
County Highway License Department showing the name
of the Person to whom Texas Highway License plates
were :issued shall constitute prima facie evidence
of the ownership by the person there named.
:3. In the event any property of any description,
vehicle, automobile, truck, trailer, or other
oharac:ter of private property shall be found
existing. standing, parked, stopped, erected, or
lying in or ,coon any part of any public: street,
alley, or other public plane within the corporate
limits of the City of Anna, Texas, in violation of
this section or any portion thereof, the same shall
be a nuisance per set and shall be removed by any
appropriate law enforcement officer and taken to
ouch place as designated by the mayor and kept
there until application for its redemption shall be
made by the owner or his authorized agent, who
shall be entitled to the possession thereof upon
Payment of the sum of ten dollars 010.00),
together with all other costs of removal and
storage that may have accrued thereon. This remedy
and impounding) fee shall be cumulative of any and
all other penalties that may be provided; in the
event the property impounded shall not be redeemed
by the owner, or his authorized apent, within five
(5) days, it shall be disposed of in a manner,
prescribed by law.

Any person who fails to comply with or violates any of
the provisions of this ordinance shall be deemed guilty
of a misdemeanor and upon conviction thereof shall be
fined not more than the maximum as prescribed by law and
each and every clay of such violation shall be a separate
and complete offense.

It is hereby declarers to be the intention of the city
council that the sections, paragraphs, sentences,

clauses, and phrases of this, ordinance are 'severable
and, if :any Dhrrase, clause, sentence, paragraph, or,
section of this ordinance shall be declared
unconstitutional by the valid judgement or decree of any
court of competent jurisdiction, such
unconstitutionality shall not affect any of the
remaining phrases, clauses, Uentences, paragraphs, and
sections of this ordinance, since the same would have
been enacted by the city council without the
incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph, or
section.
Election 4. Effective Dghi
This ordinance will take effect immediately from and
after its passage and publication as the law in such
cases provides.
