CITY OF ANNA, TEXAS
ORDINANCE NO. 95,49
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, PROHIBITING
ACCUMULATIONS OF LUMBER, JUNK, TRASH, AND DEBRIS AND
ABANDONED, DISCARDED OR UNUSED OBJECTS OR EQUIPMENT;
PROVIDING A PENALTY NOT TO EXCEED THE MAXIMUM AS
PRESCRIBED BY LAW FOR EACH VIOLATION; PROVIDING A
SEVERABILITY CLAUSE AND EFFECTIVE DATE; AND VOIDING
ORDINANCE NO. 112-86.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS
THAT:
For the purpose of this section, the term "nuisance" is
defined to mean any condition or use of premises or of
building exteriors which is detrimental to the property
of others which causes or tends to cause substantial
diminution in the value of other property in the
neighborhood in which such premises are located. This
includes, but is not limited to, the keeping or the
depositing on, or the scattering over the premises of any
of the following:
(1) Lumber, junk, trash or debris;
(2) Abandoned, discarded or unused objects or equipment
such as furniture, stoves, refrigerators, freezers,
cans, containers, vehicles, and/or farm equipment.
No person owning, leasing, occupying or having charge of
any premises shall maintain or keep any nuisance thereon,
nor shall any such person keep or maintain such premises
in a manner causing a substantial diminution in the value
of the other property in the neighborhood in which such
premises are located.
C. ENFORCEMENT OF PROVISIONS
Enforcement of this section may be accomplished by the
City in any manner authorized by law, and in addition,
any person who by reason of another's violation of any
provision of this section, suffers special damage to
himself different from that suffered by other property
owners throughout the City generally, may bring action to
enjoin or otherwise abate an existing violation.

Any person who fails to comply with or violates any of
the provisions of this ordinance shall be deemed guilty
of a misdemeanor and upon conviction thereof shall be
subject to a fine not to exceed the maximum as prescribed
by law, and each and every day of such violation shall be
a separate and complete offense.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable and,
if any phrase, clause, sentence, paragraph, or section of
this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences,
paragraphs, and sections of the ordinance, since the same
would have been enacted by the City Council without the
incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph, or
section.
• F. EFFECTIVE DATE
This ordinance will take effect immediately from and
after its passage and publication as the law in such
cases provides.
