SALES TAX ELECTION
ANNA, TEXAS, MAY 1, 1999
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS CANVASSING THE
RETURNS OF AN ELECTION FOR THE ADOPTION OF AN ADDITIONAL ONE-HALF PERCENT
SALES AND USE TAX UNDER THE PROVISIONS SET FORTH IN ARTICLE 5190.6 SEC. 4A
V.T.C.S., AS AMENDED, WITH THE PROCEEDS THEREOF TO BE USED FOR THE PROMOTION
AND DEVELOPMENT OF NEW AND EXPANDED BUSINESS ENTERPRISES AND THE
ADOPTION OF AN ADDITIONAL ONE-HALF PERCENT SALES AND USE TAX UNDER THE
PROVISIONS SET FORTH IN ARTICLE 5190.6 SEC. 413 V.T.C.S., AS AMENDED WITH THE
PROCEEDS TO BE USED FOR PARKS AND RECREATIONAL PROJECTS AND OTHER
PURPOSES AUTHORIZED BY ACT, .
ORDERING THAT SAID TAXES BE IMPOSED; INSTRUCTING THE CITY SECRETARY TO
FORWARD A CERTIFIED COPY OF THIS ORDINANCE TO THE COMPTROLLER OF PUBLIC
ACCOUNTS AND ESTABLISHING AN EFFECTIVE DATE,
BE IT REMEMBERED THAT on this the 4 t h day of May, 1999, at a meeting of the City Council of
the City of Anna, Texas, a quorum being present, the meeting was called to order and the following
business was transacted.
Upon motion of Councilmember Joe Murphy and seconded by Councilmember
Lisa Copeland , it was unanimously ordered that the City Council consider the official
• returns of an election held in the city on May 1, 1999, for the adoption of an additional one-half percent
sales and use tax under the provisions set forth in Article 5190.6 Sec. 4A V.T.C.S., as amended, with the
proceeds thereof to be used for the promotion and development of new expanded business enterprises and
the adoption of an additional one-half percent sales and use tax under the provisions set forth in Article
5190.6 Sec. 413 V.T.C.S., as amended, with the proceeds to be used for Parks and Recreational Projects and
other purposes authorized by the Act.
WHEREUPON said official returns were opened, examined, canvassed and the results declared as follows:
CANVASS OF RETURNS AND DECLARATION OF RESULTS
WHEREAS, there was held an election in the City of Anna, Texas on May 1, 1999 on the question of the
adoption of an additional one-half percent sales and use tax under the provisions set forth in Article 5190.6
Sec. 4A V.T.C.S., as amended, with the proceeds thereof to be used for the promotion and development of
new and expanded business enterprises and the adoption of an additional one-half percent sales and use tax
under the provisions set forth in Article 5190.6 Sec. 4B V.T.C. S., as amended, with the proceeds to be used
for Parks and Recreational projects and other purposes authorized by the Act; and,
WHEREAS, immediately after said election the Presiding Judge and other officials holding said election
made their returns of the results thereof to the City Council as follows, and said returns being made
according to law, and duly authenticated, and it being shown that written notice of said election was given
for the time and in the manner provided by law, and all other proceedings pertaining to said election having
been shown to have done and performed at and within the manner provided by law, and all papers
pertaining thereto having been returned and filed with the City Council and it appearing that said election
was in all respects legally held and that said election was given for the time and in the manner provided by
law, and all other proceedings pertaining to said election having been shown to have been done and
performed at and within the manner provided by law, and all papers pertaining thereto having been returned
and filed with the City Council and it appearing that said election was in all respects legally held and that
said returns were duly and legally made and no protest or objection being made to or regarding any matter
pertaining to said election; NOW THEREFORE,
• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS;
SECTION 1. That after examining said returns and opening and canvassing the votes of said election, the
result of said election in regard to Proposition Numberl and 2 is as follows:
PROPOSITION NUMBER 1
THE ADOPTION OF A SALES AND USE TAX FOR THE PROMOTION AND DEVELOPMENT OF
NEW AND EXPANDED BUSINESS ENTERPRISES AT THE RATE OF ONE-HALF OF ONE
PERCENT.
That there were cast at said election 1 0 6 total votes of which 52 votes were cast
FOR the adoption of Proposition Number 1, and 54 votes were cast AGAINST the adoption of
Proposition Number 1. The number of votes by which Proposition 1 failed was by 2
A majority of the qualified voters having voted AGAINST the adoption of an additional one-half of one
percent sales and use tax for the promotion and development of new and expanded Business Enterprises.
PROPOSITION NUMBER 2
THE ADOPTION OF AN ADDITIONAL ONE-HALF PERCENT SALES AND USE TAX TO BE USED
FOR ANY PURPOSE AUTHORIZED BY SECTION 4B, ARTICLE 5190.6, V.T.C.S., AS AMENDED
(THE DEVELOPMENT CORPORATION ACT OF 1979), INCLUDING BUT NOT LIMITED TO
PROJECTS FOR THE PROMOTION AND DEVELOPMENT OF NEW OR EXPANDED
ENTERPRISES, INCLUDING A PROJECT TO PROVIDE PUBLIC SAFETY FACILITIES, STREETS
AND ROADS, DRAINAGE AND RELATED IMPROVEMENTS, DEMOLITION OF EXISTING
STRUCTURES, GENERAL MUNICIPALLY OWNED IMPROVEMENTS, AS WELL AS ANY
IMPROVEMENTS OR FACILITIES THAT ARE RELATED TO ANY OF THOSE PROJECT THAT
is PROMOTES OR DEVELOPS NEW OR EXPANDED BUSINESS ENTERPRISES, AS WELL AS
PROJECTS REQUIRED OR SUITABLE FOR USE FOR PROFESSIONAL AND AMATEUR SPORTS,
ATHLETIC, ENTERTAINMENT, TOURIST, CONVENTION, AND PUBLIC PARK PURPOSES AND
EVENTS, INCLUDING STADIUMS, BALL PARKS, AUDITORIUMS, AMPHITHEATERS,
CONCERT HALLS, LEARNING CENTERS, PARKS AND PARK FACILITIES, OPEN SPACE
IMPROVEMENTS, MUNICIPAL BUILDINGS, MUSEUMS, EXHIBITION FACILITIES, AND
RELATED STORE, RESTAURANT, CONCESSION, AND AUTOMOBILE PARKING FACILITIES,
RELATED AREA TRANSPORTATION FACILITIES, AND RELATED ROADS, STREETS, AND
WATER AND SEWER FACILITIES AND OTHER RELATED ITEMS THAT ENHANCE ANY OF
THOSE ITEMS.
That there were cast at said election 97 total votes of which 49 votes were cast
FOR the adoption of Proposition Number 2, and 48 votes were cast AGAINST the adoption of
Proposition Number 2. The number of votes by which Proposition Number 2 passed was by I
A majority of the qualified voters having voted FOR the adoption of an additional one-half of one percent
sales and use tax to be used for any purpose authorized by Section 4B, Article 5190.6, V.T.C.S., as
amended (The Development Corp. Act of 1979), including by not limited to projects for the promotion and
development of new or expanded enterprises, including a project to provide public safety facilities, streets
and roads, drainage and related improvements, demolition of existing structures, general municipally
owned improvements, as well as any improvements or facilities that are related to any of those projects and
any of those projects and any other project that promotes or develops new or expanded business enterprises,
as well as projects required or suitable for use for professional and amateur sports, athletic, entertainment,
tourist, convention, and public park purposes and events, including stadiums, ball parks, auditoriums,
amphitheaters, concert halls, learning centers, parks and park facilities, open space improvements,
municipal buildings, museums, exhibition facilities, and related store, restaurant, concession, and
automobile parking facilities, related area transportation facilities, and related roads, streets, and water and
sewer facilities and other related items that enhance any of those items.
Therefore Proposition Number 2 is declared approved and said tax is hereby imposed by the City of Anna,
Texas, pursuant to Section 321.405 of the Texas Tax Code, and shall become effective as provided by law,
and the City Secretary is hereby instructed to forward to the Comptroller of Public Accounts, State Capital,
Austin, Texas by registered or certified mail a certified copy of this ordinance.
SECTION 2. That this canvass and declaration of results of said election be entered in the Minutes of the
City Council.
SECTION 3. This ordinance shall take effect immediately upon its passage as provided by the charter of
this City and the laws of the State of Texas.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Anna, Texas, this the
4th day of May 1999.
