HomeMy WebLinkAboutOrd 2000-14 Planning & Zoning.pdf• CITY OF ANNA, TEXAS ORDINANCE NO.aouo -14 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING SECTION 27 OF THE ZONING ORDINANCE OF THE CITY OF ANNA BY ALLOWING PERSONS RESIDING IN THE EXTRATERRITORIAL JURISDICTION OF THE CITY TO BE ELIGIBLE FOR APPOINTMENT TO THE CITY OF ANNA PLANNING AND ZONING COMMISSION; PROVIDING FOR A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Anna has determined that several persons residing in the extraterritorial jurisdiction of the City are interested in and qualified for membership on the City's Planning and Zoning Commission; and WHEREAS, state law allows persons residing in the extraterritorial jurisdiction of a city to be members of the city's Planning and Zoning Commission; and WHEREAS, much of the work of the City of Anna Planning and Zoning Commission affects the city's extraterritorial jurisdiction; and WHEREAS, the Planning and Zoning Commission.of the City of Anna has recommended to the City Council that Section 27 of the City's Zoning Ordinance be amended to allow persons residing in the City's extraterritorial jurisdiction to be eligible for appointment to the Planning and Zoning Commission, NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. Section 27 Amended Section 27.A of the Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended to read as follows (the underlined section being added by this ordinance): A. CREATION OF PLANNING AND ZONING COMMISSION There is hereby created a planning and zoning commission that shall be organized, appointed, and function as follows: The planning and zoning commission shall consist of five (5) members who are residents of the City of Anna or its extraterritorial jurisdiction, each to be appointed by the city council for a term of two (2) years and removable for cause by the appointing authority upon written charges and after public hearing. The city council shall designate one (1) member as chairman. Vacancies shall be filled for the unexpired term of any member, whose place becomes vacant for any cause, in the same manner as the original appointment was made. Provided, however, that the city council may appoint two (2) alternate members of the planning and zoning commission who shall serve in the Page 1 of 2 N, 4 . absence of one (1) or more of the regular members when requested to do so by the chairman or city administrator, as the case may be. The terms of three (3) members shall expire in May of each odd -numbered year and the terms of two (2) of the members shall expire in May or each even -numbered year. Commission members may be appointed to succeed themselves. Vacancies shall be filled for unexpired terms, but no member shall be appointed for a term in excess of two (2) years, Newly appointed members shall be installed at the first regular commission meeting after their appointment. Section 2. Repealer Clause All ordinances of the City of Anna in conflict with the provisions of this ordinance are repealed to the extent of that conflict. Section 3. Effective Date This ordinance shall take effect immediately from and after its passage by the City Council and approval by the Mayor.
