ORDINANCE NO. &D0& -0b
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, SETTING THE WATER
AND SEWER RATES REQUIRED TO PROVIDE WATER AND SEWER
SERVICES TO CITIZENS OF ANNA, SETTING THE EFFECTIVE DATE OF THE
NEW RATES, AND REPEALING ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT WITH THIS ORDINANCE.
WHEREAS, the City of Anna operates a water production, storage, and
distribution system as a service to residents, property owners, and other users of
the system: and
WHEREAS, certain regulations governing the use of the water & sewer
system operated by the City of Anna are necessary to insure its orderly and
efficient operations and to protect the health and welfare of the citizens of the
City;
NOW, THEREFORE, BE IT ORDAINED BY RATES CITY COUNCIL OF THE
CITY OF ANNA, TEXAS THAT THE FOLLOWING SHALL GOVERN THE
SALE OF THE WATER & SEWER SERVICE BY THE CITY
Section 1. Water & Sewer Rates
(a) INSIDE CITY WATER RATES
Each customer shall pay a minimum charge of $25.00 for the first 2,000
gallons plus a usage charge of $4.00 for each additional 1,000 between
2,000 and 10,000 gallons and $4.50 for each additional 1000 gallons over
10,000 gallons.
(b) INSIDE CITY SEWER RATES
Each customer shall pay a minimum charge of $21.00 for the first 2,000
gallons plus $2.00 for each additional 1000 gallons up to $30.00 maximum.
(c) OUTSIDE CITY LIMITS
Each customer shall pay two times the rate charged to customers inside
the city limits.
(d) COMMERCIAL RATES
Each customer shall pay a minimum charge of $23.00 for the first 2,000
gallons plus $2.75 for each additional 1000 gallons.
(e) INDUSTRIAL RATES
Each customer shall pay a minimum charge of $23.00 for the first 2,000
gallons plus $3.75 for each additional 1000 gallons.
Section 2. Severability
It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable and, if any phrase, clause, sentence, paragraph, or section shall
be declared unconstitutional by the valid judgment or decree of any court
of competent; jurisdiction, such unconstitutionality shall not affect any of
the remaining phrases, clauses, sentences, paragraphs and sections, since
the same would have been enacted by the City Council without the
incorporation of any unconstitutional phrase, clause, sentence, paragraph,
or section
Section 3. Penal
Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor, and upon conviction, shall be subject to
a fine not to exceed the maximum as prescribed by law. Each day of
violation may be considered a separate offense under the provisions of
this ordinance. Each transaction in violation of any of the provisions
hereof shall be deemed a separate offense. Prosecution or conviction
under this provision shall not be a bar to any other remedy of relief for
violations of this ordinance.
Section 4. Effective Date
This ordinance shall take effect on the first billing cycle of January 2004
from and after its passage and the publication of this caption, as the law in
such cases provides.
