HomeMy WebLinkAboutOrd 2002-09 Specific Use Escamilla.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 2002-9 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR THE LOCATION OF A MANUFACTURED HOME; REQUIRING OWNER OCCUPATION OF THE MANUFACTURED HOME; AMENDING THE ZONING MAP OF THE CITY OF ANNA TO PROVIDE FOR REZONING OF CERTAIN PROPERTY; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owner of the property described in Exhibit A attached hereto has requested a Specific Use Permit for location of a manufactured home on said property; and WHEREAS, the City Council of the City of Anna has given the requisite notices and afforded a full and fair hearing to all property owners generally and to all persons interested in and situated in the affected area and in the vicinity thereof; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by granting a Specific Use Permit to Gilberto Escamilla and Adebel Escamilla to locate a manufactured home on the tract described on Exhibit A, attached hereto and made an integral part of this ordinance. Section 2. The Specific Use Permit may be transferred to subsequent owners of the tract described in Exhibit A if the manufactured home to be located on the tract is owner -occupied. Section 3. The official Zoning Map of the City of Anna shall be corrected to reflect the change in zoning established by this Specific Use Permit, including designation of the tract as SUP 2002-01. Section 4. All ordinances of the City of Anna in conflict with the provisions of this ordinance are repealed to the extent of that conflict. Section 5. This ordinance shall take effect immediately from and after its passage and approval. Stark Survey, A-798, Collin County, Texas, according to Warranty Deed filed for record in Volume 5006, Page 3566 (Clerk's Certificate No. 2001- 0118476), of the Collin County Land Records, and being more particularly described as follows: Beginning at a '/2 inch rod found for the northeast corner of said 1.00 acre tract, said corner being in the westerly right-of-way line of State Highway No. 5, and said corner being also the southeast corner of a 1.00 acre tract of land according to deed to William C. Hopper, filed for record in Volume 4721, Page 2443, of said Collin County Land Records; Thence South 18° 04' 00" West 142.35 feet along the westerly right -of way line of said State Highway No. 5 to a'/ inch iron rod found for corner; Thence West 299.83 feet to a fence post for corner; Thence North 135.33 feet to a '/ inch iron rod fund for corner, said corner being also the southwest corner of said 1.00 acre Hopper tract; Thence east 343.97 feet to the point of beginning and containing 43,560 square feet or 1.00 acres of land.
