REGULAR MEETING MINUTES
The City Council of the City of Anna met in Regular Session on Tuesday, July 9, 2002, at the
Anna City Hall, located at 120 W. 4"" Street.
Call to Order
Mayor Pro Tem Mark Montgomery called this meeting to order at 7:30 p.m.
2. Roll Call
The following council members were present: Mayor Pro Tern Mark Montgomery, Joe
Finley Jr., Lynn Mosier, Lynn Dhane and John Geren.
3. Citizen's Participation
Ms_ Doris Haker asked the council how citizens could get items placed on the agenda.
4. Consider awarding bid on street improvements in east Anna.
City Administrator, Mr. Lee Lawrence explained this was a project re -bid and the bids
were rated as follows:
1. WOPAC Construction Part1-$37,953 Part2-$30,921 Total -$67,970
2. TMD & Associates Part1-$39,821.36 Part2-$38,747.2OTotal-$78,568.56
3. JRJ Paving Part1-$54,000 Part2-$46,000 Total -$91,€300

Mr. Mosier made a motion to accept the bid by TMD & Associates. Mr. Finley seconded
the motion. The motion carried 51010.
5. Pro rata payment(s) and Facilities Agreement for Meadow Ridge subdivision. Approval
of the final plat was conditional on two issues.
1. The water and sewer lines for this development are in place along the east edge of
the property, paid for by the developer of Tara Farms and the City has a pro rata
agreement with them regarding anyone else using these lines. This amounts to
about $35,000.
2. Capital Improvement Fee or Facilities Fee — all developers since Tara Farms have
been asked to pay this fee so existing residents are not paying for the cost of
development.
Mr. Lawrence said the developer has proposed he pay $1500 per lot total for the
facilities fee, with no pro rata fee. The developer stated that it was his understanding
when he purchased the property that there was no pro rata because there is a provision
in the easement that the property owner granted to the city that says the City has access
to the water and sewer line.
The City has been charging a fee of $1000-1250 for water taps and the same for sewer
taps depending on where the property is located for a total of approx. $1500 for the last
several months.
Mr. Mosier made a motion to deny the developers offer. Mr. Finley seconded the
motion. The motion carried 510/0.
6. Recommendation of Planning and Zoning Commission regarding one lot subdivision
requested by David Graham, located at 9188 CR 423.
This property is located on Hwy 5 South, it is the Adams property near the church.
There was a similar situation a couple of months ago in the Escamillo subdivision.
Mr. Finley made a motion to approve the subdivision. Mr. Geren seconded the motion.
The motion carried 510/0.
7. Resolution endorsing a plan to construct a water transmission main for delivery of
potable water to Anna and other cities and expressing intent to contract with Greater
Texoma Utility Authority for construction of said main and purchase of water.
The city is looking at the option of securing a long-term water supply of treated water
through a pipeline from the south edge of Sherman. This pipeline would serve Van
Alstyne, Melissa, Anna and possibly one or two water corporations that deliver water to
this area. There has been a preliminary engineering study prepared showing that it is
financially feasible to obtain water in this manner. This resolution would authorize
obtaining further information regarding this project. Mr. Finley made a motion to approve
the resolution. Mr. Geren seconded the motion. The motion carried 5/0/0. Resolution
2002-18,
8. Resolution ratifying Lease -Purchase Agreement between City of Anna and Government
Capital Corporation regarding financing of Ferrara Class "A" Pumper (fire truck).
Mr. Mosier made a motion to ratify the Lease -Purchase agreement regarding the fire
truck. Mr. Finley seconded the motion. The motion carried 51010. Resolution 2002-019.
9. Resolution regarding TXU gas rates
Mr. Kevin Slay, TXU Gas was recognized. In March the city suspended the rate change
while rate changes were investigated. About 70 cities have taken action and approx. 27
cities have accepted the rate change. The settlement offer by TXU reflects about '//a
percent increase. Mr. Mosier made a motion to accept the offer by TXU. Mr. Finley
seconded the motion. The motion carried 5/010. Resolution 2002-20.
10. Resolution authorizing Mark Montgomery as signatory on bank and other financial
accounts.
Mr. Finley made a motion to add Mr. Montgomery as a signatory on city accounts. Mr.
Geren seconded the motion. The motion carried 510/4. Resolution 2002-21.
11. Resolution establishing that the benefit for the memory of September 11 and the run for
Toys for Tots serves as a public purpose.
This is regarding a request to the City and the Texas Department of Transportation to
close Fourth Street on Sunday September 8, 2402 for this benefit. Ms. Connie
Montgomery, LTC Plumbing and Mr. Ron Tomonelli, Texoma Marine Corps League
were recognized.
Mr. Finley made a motion to approve the resolution establishing the benefit as a public
event. Mr. Mosier seconded the motion. The motion carried 5/0/0. Resolution 2402-22.
12_ Request by Wanda Bradshaw regarding oiling of part of S. Interurban St.
Ms. Bradshaw stated that she has been promised on numerous occasions that the city
would oil the road on a monthly basis and it has not been done. Mr. Cunningham was
recognized by the council and stated that the road belonged to the City and that he had
given the road to the City several years ago. Mr. Mosier stated that he remembered this
issue regarding the ownership of the road being brought up on a prior occasion and it
was a verbal agreement between Mr. Hendricks, Mr. Murphy and Mr. Cunningham and
that the City took ownership of the road.
Mr. Mosier made a motion to oil the road from FM 455 to the end of S. Interurban one
time. Mr. Finley seconded the motion. The motion carried 51010.
13. Minutes — meeting of May 14 (election canvas)
Mr. Mosier made a motion to accept the minutes. Mr. Finley seconded the motion. The
motion carried 5/010.
14. Minutes — meeting of June 11.
Mr. Mosier made a motion to accept the minutes. Mr. Finley seconded the motion. The
motion carried 5/0/0.
15. Minutes — meeting June 18
Mr. Mosier made a motion to accept the minutes. Mr. Finley seconded the motion. The
motion carried 5/0/0.
16. Minutes — meeting of July 2.
Mr. Mosier made a motion to accept the minutes. Mr. Finley seconded the motion. The
motion carried 5/0/0-
17, Bills
Mr. Mosier made a motion to pay the outstanding bills in both the water and general
fund. Mr. Finley seconded the motion. The motion carried unanimously.
18. Staff reports and items for discussion
Mr. Lawrence gave the council an update on current development activity (see
attached).
Mr. Lawrence gave an update on the status of the new city hall building. Several
members of the council reported that the fence needed to be repaired.
Direction was given to have S. interurban Street mewed.
Mr. Lawrence informed the council that the park grant had been submitted to the County
Commissioners.
Several citizens requested that the east side of Anna be cleaned up and brought up to
the same standards as the new developments.

These tracts have not been platted; however, pre -development conferences have been
conducted with developers of these properties. In al cases, the developers either own the
property or have sales contracts on the property.
The West tract developer has provided estimates of as high as 2,000 lots for this
property. The more realistic number is probably 1,400 lots.
