ORDINANCE NO. 200-2005
AN ORDINANCE BY THE CITY OF ANNA, TEXAS, AMENDING ESTABLISHING SOLID
WASTE (TRASH) SERVICE RATES, SETTING THE EFFECTIVE DATE FOR THE NEW
RATES; ESTABLISHING A REPEAL CLAUSE; ESTABLISHING A SAVINGS CLAUSE;
ESTABLISHING A PENALTY FOR VIOLATION OF THE PROVISIONS OF THE ORDINANCE
WHEREAS, the City of Anna provides solid waste (trash) collection services through contract
with third parties for residents and businesses within the city as part of its efforts to protect the
health and welfare of residents of the city; and
WHEREAS, the City of Anna has received proposals for provision of solid waste collection
services and has contracted with third party providers of said services; and
WHEREAS, the City Council wishes to add an administrative fee to the contract fee for provision
of solid waste collection services to cover costs of billing and collection for solid waste services,
now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS:
Section 1. Solid Waste (Trash) Collection Service Rates
(a) Residential customers and commercial customers not using dumpsters andtor roll -off
containers
Each residential customer shall pay a minimum charge of $10.00 per month.
Commercial customers with 1.6 bags or cans, one pick-up/week
$12.50
Commercial customers with 1.6 bags or cans, two pic-upsMreek
$15.00
Commercial customers with 7-10 bags or cans, one pick-up/week
$16.00
Commercial customers with 7-10 bags or cans, two pick-ups/week
$18.50
(b) Customers using dumpsters and roll -off containers
Each customer shall pay a minimum charge per the following schedule:
Two yard dumpster, one pick-up/week
Two yard dumpster, two pick-upstweek
Three yard dumpster, one pick-up/week
Three yard dumpster, two pick-upstweek
Four yard dumpster, one pick-uptweek
Four yard dumpster, two pick-ups/week
Six yard dumpster, one pick-uptweek
Six yard dumpster, two pick-ups/week
Eight yard dumpster, one pick-up/week
Eight yard dumpster, two pick-ups/week

Section 2 Repeal Clause
All parts of any ordinance in conflict with the provisions of this ordinance are to the extent of
such conflict hereby repealed.
Section 3. Savinos Clause
If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of
such ordinance shall continue in full force and effect the same as If such invalid or
unconstitutional provision had never been a part hereof.
Section 4. Effective Date
This ordinance shall be effective on the first billing cycle of May, 2005, upon the posting and/or
publication of its caption as required by law and the City Secretary is hereby directed to
implement such posting and/or publication.
Section 5. Penalty
Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction shall be subject to a fine not to exceed the maximum as prescribed by the
statutes of the State of Texas. Each day of violation may be considered a separate offense
under the provisions of this ordinance. Each transaction in violation of any provision hereof
shall be deemed as a separate offense. Prosecution or conviction under this provision shall not
be a bar to any other remedy or relief for violations of this ordinance.
PASSED by the City Council of the City of Anna, Texas, by the following vote on this the 22nd
day of March, 2005.
