HomeMy WebLinkAboutOrd 212-2005 South Grayson Water.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 212-2005 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, REVISING ORDINANCE NO. 79-2003 BY ADDING FORMER CUSTOMERS OF SOUTH GRAYSON WATER SUPPLY CORPORATION AS A CATEGORY OF CUSTOMERS AND ESTABLISHING A SEPARATE RATE FOR SAID CATEGORY OF CUSTOMERS; ESTABLISHING A REPEAL CLAUSE; ESTABLISHING A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the City of Anna has purchased and contemplates future purchases of facilities owned by South Grayson Water Supply Corporation (SGWSC); and WHEREAS, customers of SGWSC have been transferred to the City of Anna utility system and will be transferred with future purchases of facilities to the City of Anna; and WHEREAS, the City Council of the City of Anna desires that the transition of customers from SGWSC to the City of Anna be accomplished in a smooth, orderly, and fair process; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT Section 1 of Ordinance 79-2003 shall be amended by adding subsection (d) to read as follows: Former customers of the South Grayson Water Supply Corporation who become customers of the City of Anna utility system through a purchase of SGWSC facilities shall be considered a separate category of customers. Each customer in this category shall pay a minimum charge of $19.50 plus a usage charge of $2.00 for each 1,000 gallons of water used between 0 and 10,000 gallons, $3.00 for each 1,000 gallons of water used between 10,001 and 15,000 gallons, $4.00 for each 1,000 gallons of water used between 15,001 and 20,000 gallons, and $6.00 for each 1,000 gallons of water used in excess of 20,000 gallons. Such rate shall be in effect from July 1, 2005, through June 30, 2006. After July 30, 2006, the rate for said customers shall be the same as for other customers of the Anna utility system. Section 2. Repeal Clause All parts of any ordinance in conflict with the provisions of this ordinance are to the extent of such conflict hereby repealed. 06-28-2005 ORD South Grayson Water Page 1 of 2 06-28-05 Section 3. Savings Clause If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. Section 4. Effective Date This ordinance shall be effective upon the posting and/or publication of its caption as required by law and the City Secretary is hereby directed to implement such posting and/or publication.
