HomeMy WebLinkAboutOrd 215-2005 Personnel Policies.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 215-2005 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING CHAPTER 6 OF THE CITY OF ANNA PERSONNEL POLICIES MANUAL, ADOPTED BY ORDINANCE NO. 2001-12, BY AMENDING SECTION 6.01 RELATING TO WORK PERIODS AND SECTION 6.04 RELATING TO OVERTIME; PROVIDING FOR A REPEALER CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE Whereas, the City Council of the City of Anna has reviewed Chapter 6 of the City of Anna Personnel Policies Manual regarding work periods and overtime policy for police officers; and Whereas, the City Council has determined that changes need to be made regarding work periods and overtime policy for police officers in the City of Anna Personnel Policies Manual in order to provide for a more effective, efficient, and orderly operation of City business; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA: Section 1. Section 6.01 of Ordinance No. 2002-12 Amended Section 6.01 of the City of Anna Personnel Policies Manual, adopted by Ordinance No. 2002-12, is hereby amended to read as follows: 6.01 Work Period (a) Except as otherwise set forth expressly herein, the official work period for all City of Anna non -police employees is a five-day period beginning at 8:00 a.m. on Thursday and ending at 5:00 p.m., on the following Wednesday. Normal working hours are Monday through Friday, 8:00 a.m. to 5:00 p.m., with one hour off for lunch, for a total of 40 hours per work week. Morning and afternoon breaks of fifteen minutes each are available to each employee if duties permit, but this time does not accumulate if not taken. Part time regular employees work the hours assigned. The official work period for non-exempt police officers if working a standard 40 - hour week is a 14 -day period beginning at 112:00 a.m. on Thursday and ending at 11:59 p.m. on Wednesday of the second week following Wednesday. Normal work hours are assigned by the Chief of Police with approval of the city manager. When 06/28/05 ORD Personnel Policies 14 day Page 1 of 3 06-28-05 the police department changes to a 12 -working -hour -per -day schedule, the official work period will change to 28 -day periods with a standard 84 hours paid in the first pay period with overtime and compensating time figured on the second pay period at the end of the work period. (b) In addition, the department head may set other hours of work for field employees, individuals, or groups of employees, if necessary or desirable. (c) All employees are expected to report punctually for duty at the beginning of their assigned workday and work the full workday established. An employee who is expected to be late to work or needs to leave before the end of the workday should notify the department head as early as possible. Section 2. Section 6.04(b) of Ordinance No. 2002-12 Amended Section 6.04(b) of the City of Anna Personnel Policies Manual, adopted by Ordinance No. 2002-12, is hereby amended to read as follows: 6.04 Overtime (b) For non -police officer employees who are covered by the overtime provisions of the Fair Labor Standards Act (FLSA), the policy of the City is to grant 1.5 hours off during the same forty hour work week for authorized hours worked in excess of 40 working hours. In the event it is not possible to grant time off during the same work week in which the overtime was worked, the City will pay the employee one and one-half times the number of overtime hours worked at the employee's regular hourly rate. For police officers the policy of the City is to grant hours off during the work period if a non-exempt police officer works more than 86 hours if on a 14 -day work period or 171 hours if on a 28 -day work period. In the event it is not possible to grant time off during the same work period in which actual hours worked are above 86 hours if on a 14 -day work period or above 171 actual hours worked if on a 28 -day work period the non-exempt police officer will receive 1.5 times pay or 1.5 times compensatory pay up to a maximum of 84 hours of accrued compensatory time. The Chief of Police may approve payment of overtime in lieu of compensatory time. Section 3. Repealer Clause All ordinances of the City of Anna in conflict with the provisions of this ordinance are repealed to the extent of that conflict. Section 4. Savings Clause If any section, subsection, sentence, clause, or phrase of this ordinance is for any 06/28/05 ORD Personnel Policies 14 day Page 2 of 3 06-28-05 reason held to be unconstitutional, void, or invalid, the validity of the remaining portions of this ordinance shall not be affected thereby, it being the intent of the City Council in adopting this ordinance that no portion thereof, or provision or regulation contained herein shall become inoperative or fail by reason of the unconstitutionality or invalidity of any section, subsection, sentence, clause, phrase, or provision of this ordinance. Section 5. Effective Date This ordinance shall take effect immediately from and after its passage by the City Council and approval by the Mayor.
