ORDINANCE NO. 242-2005
IMPACT FEE ADVISORY COMMITTEE
AN ORDINANCE RATIFYING THE CREATION OF AN IMPACT FEE ADVISORY
COMMITTEE; ESTABLISHING COMPENSATION; ESTABLISHING THE NATURE OF THE
COMMITTEE; ESTABLISHING THE PURPOSE AND RESPONSIBILITIES OF THE
COMMITTEE; AND PERMITTING ESTABLISHMENT OF ADDITIONAL RESPONSIBILITIES
WHEREAS, the City Coundl of the City of Anna has previously created an impact fee advisory
committee; and
WHEREAS, the City Council desires to clarify issues relating to the membership of the
committee, its compensation, and its purpose and responsibilities; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA
Section 1. Membership.
The planning and zoning commission of the City of Anna is hereby designated and appointed to
serve as the impact fee advisory committee. Should no member of the planning and zoning
commission be a representative of the real estate, development or building industry who is not
an official or employee of a governmental entity or political subdivision, the council shall appoint
one additional person to serve as an ad hoc member of the committee. Said ad hoc member
shall be a representative of the real estate, development or building industry who is not an
official or employee of a governmental entity or political subdivision.
Section 2. Compensation.
Members of the impact fee advisory committee shall serve without compensation.
Section 3. Nature and matters.
All matters dealt with by the committee shall be advisory in nature. The board shall report to and
be solely responsible to the city council.
Section 4. Purpose and responsibllttles.
The purpose of the impact fee advisory committee shall be to assist and advise the city council
in the development and/or revision of impact fees as prescribed by Chapter 395 of Vemon's
Texas Codes Annotated, Local Government Code. The committee shall:
(1) Advise and assist the city in adopting land use assumptions;
(2) Review the capital improvements plan and Ole written comments;
(3) Monitor and evaluate implementation of the capital improvements plan;

(4) File semiannual reports with respect to the progress of the capital improvements plan
and report to the city any perceived inequities in implementing the plan or imposing the impact
fee; and
5) Advise the city of the need to update or revise the land use assumptions, capital
improvements plan and impact fee.
(b) The impact fee advisory committee is also authorized to exercise any other powers
authorized by Chapter 395 of the Local Government Code for such advisory committees.
The city council may from time to time enlarge the responsibilities of the impact fee advisory
committee and confer upon it additional powers, duties and responsibilities not inconsistent with
the City Charter or the laws of the State of Texas.PASSED on this the 13th day of December,
2005, by the following vote of all members of the City Council as present:
