ORDINANCE NO. 268-2006
AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF THE
TEXAS TRANSPORTATION CODE, SECTION 545.356, UPON
ROADWAYS WITHIN THE INCORPORATED LIMITS OF THE CITY OF
ANNA; AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED
$200.00 FOR THE VIOLATION OF THIS ORDINANCE.
WHEREAS, the Texas Transportation Code provides that the governing body of
the City may determine the speed that is reasonable or safe in residential areas;
and
WHEREAS, said governing body may determine and declare a reasonable and
safe prima facie speed limit on roadways that are not officially designated or
marked roadways of the state highway system under certain specified conditions
by the passage of an ordinance; and
WHEREAS, after conducting a public hearing and deliberation on the matter, the
governing body of the City of Anna has determined that the reasonable and safe
prima facie speed limit on certain roadways in the city is 25 miles per hour.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ANNA, TEXAS:
Section 1.
As authorized by the provisions of Transportation Code, Section 545.356, the
prima facie speed limit on public roadways in the City of Anna is 25 miles per
hour, except for roadways:
(a) that are officially designated or marked as part of the state highway
system;
(b) that are more than 35 feet in width;
(c) along which vehicular parking is prohibited on one or both sides of the
roadway; or
(d) that have four or more lanes used for vehicular travel.
Section 2.
The prima facie speed limit of a roadway that has a posted speed limit sign
establishing a maximum speed that is less than 25 miles per hour during certain
times of day is not altered by this Ordinance during those certain times. At all

other times, the prima facie speed limit on any such roadway—with the exception
of roadways described in Section 1(a)-(d)—is 25 miles per hour.
Section 3.
The City Manager is hereby authorized to cause to be erected the appropriate
signs indicating such speed zones.
Section 4.
Any person violating any of the provisions of this Ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be fined in any sum
not to exceed Two Hundred Dollars ($200.00).
Section S. Repealer
All parts of any ordinance in conflict with the provisions of this Ordinance are to
the extent of such conflict hereby repealed.
Section 6. Severance
If any part of this Ordinance is for any reason found by a court of competent
jurisdiction to be invalid, illegal, or unenforceable, all other parts nevertheless
shall remain valid, legal, and enforceable.
Section 7. Effective Date
This Ordinance shall be effective upon the posting and/or publication of its
caption as required by law and the City Secretary is hereby directed to
implement such posting and/or publication.
