HomeMy WebLinkAboutOrd 262-2006 Anna Ranch PD Zoning - 737.3 Acre Tract.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 262-2006 jAnna Ranch PD Zoning — 737.3 acre tract) AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ZONING MAP OF THE CITY OF ANNA TO PROVIDE FOR REZONING OF CERTAIN PROPERTY; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Owner of the property described in Exhibit "A" attached hereto has requested a certain zoning for said property; and WHEREAS, the City Council of the City of Anna has given the requisite notices and afforded a full and fair hearing to all property owners generally and to all persons interested in and situated in the affected area and in the vicinity thereof, the City Council of the City of Anna has concluded that the Zoning Ordinance of the City of Anna should be amended as follows: NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 7 — Generally: The Comprehensive Zoning Ordinance of the City of Anna, Texas, as enacted on September 20, 2003 is hereby conditionally amended by enacting this Planned Development for the property as described in Exhibit "A" and graphically shown on Exhibit "D" — Concept Plan, attached hereto and made an integral part of this Ordinance, as Planned Development (PD). The Planned Development shall include the following elements: Section 2 - Permitted Uses: The permitted uses in the Planned Development will be the same as those permitted in the "SF -60 — Single Family Residence District", "C-1 Restricted Commercial District", "MF -2 Muthple Family Residential — High Density", and "SF- TH Townhome District" Regulations as outlined in the City of Anna Zoning Ordinance, except as herein provided. Section 3 - Heiaht and Coverage Regulations: The height and coverage regulations in the Planned Development will be the same as those permitted in the "SF -60 — Single Family Residence District:, "C-1 Restricted Commercial District", "MF -2 Multiple Family Residential — High Density", and "SF-TH Townhome District' Regulations as outlined in the City of Anna Zoning Ordinance. Section 4 - Lot Dimensions and Setbacks: The lot dimensions and setbacks shall be set as follows: The minimum lot width shall be as desenbed in Section 8.5.2. "a City of Anna Subdivision ONi imm. a. GW4TR-19 nF9 Zoning districts shall be as shown on attached Exhibit "B" h. Commercial Element: The Commercial Element of the PD is graphically identifted on Exhibit 'B' and Exhibit "D". Except as follows, all provisions of the Anna Zoning Ordinance as related to the C-1 Restricted Commercial zoning district shall apply to the Commercial Element of this Planned Development with a 70% lot coverage. Multiple Family Residential Element: The Multiple Family Residential Element of the PD includes approximately 315 acres, as graphically identified on Exhibit "B" and Exhibit "D". All provisions of the Anna Zoning Ordinance as related to the MF -2 Multiple Family Residential — High Density zoning district shall conform to the Multiple Family Residential Element of this Planned Development. Multiple Family Residential density shall be capped at 18 units per acre. j. Townhome Element: The Townhome Element of the PD includes approximately ±15 acres as graphically identified on Exhibit "B" and Exhibit "D". Except as follows, all provisions of the Anna Zoning Ordinance as related to the SF-TH Townhome District shall apply to the Townhome Element of this Planned Development. The exceptions are as follows: SF-TH Townhome District No fire sprinkler system shall be required for the dwelling units unless the building exceeds 5,000 square feet. • A maximum of six (6) units per building shall be permitted. Section 5 - Parkin Regulations: The parking regulations in the Planned Development will be the same as those permitted in the "SF -60 — Single Family Residence District", "C-1 Restricted Commercial District", "MF -2 Multiple Family Residential — High Density", and "SF-TH Townhome District" Regulations as outlined in the City of Anna Zoning Ordinance except for the designated lots with alleys where two (2) enclosed spaces must be provided behind the rear yard line. Section 6 - Permitted Accessory Uses: The permitted accessory uses in the Planned Development will be the same as those permitted in the "SF -60 — Single Family Residence District", "C-1 Restricted Commercial District, 'MF -2 Multiple Family Residential — High Density", and "SF- TH Townhome District" Regulations as outlined in the City of Anna Zoning Ordinance. Section 7 - Accesses and Entrances: The development shall provide connection points to planned street stubs for any adjacent property if such property has an existing preliminary plat or final plat approved by the City of Anna prior to the approval by the City of Anna of the Planned Development Zoning. There shall be no other required connections to adjacent properties, nor shall the number of lots or the density of the development be limited based on the number of connections to existing roads or adjacent properties. Section 8 - Crosswalk Easements: Crosswalk Easements as defined in Section 8.6.3 of the City of Anna Subdivision Ordinance shall not be required for the development. Section 9 - Garages: Garages may be front or rear facing and there is no requirement for "swing" driveways. Section 10 - Sidewalks: a. Sidewalks 4 feet in width minimum will be installed one foot (1) outside the right-of-way along street frontage of all residential lots prior to the issuance of a final certificate of occupancy for each house constructed thereon. b. A sidewalk 5 feet in width minimum will also be installed one foot (1) outside the right-of-way along the Major Collector street prior to the acceptance of the infrastructure improvements. The Developer shall not be required to but has the option of increasing the width any sidewalks. Section 11 - Screenina: a. Berms or masonry thin wall screening fences shall be utilized as screening adjacent to Collector streets. b. Along Collectors, no walls shall exceed a length of 500 feet without a change in character such as the addition of wrought iron with living screen. c. Screening fences will be located between the commercial uses and the residential, multiple family and townhome uses and shall be installed by the commercial user. d. There will be a consistent 6' screening wall along the La Paloma subdivision boundary with a capped fence e. Screening fences adjacent to commercial uses will be of masonry construction with masonry columns located on 50 foot centers installed by the commercial user. The maintenance of screening fences shall be funded through the creation of a Political Subdivision such as a Public Improvement District (PID). If a PID or a similar funding mechanism is not created, maintenance shall be the responsibility of a Home Owners Association (HOA). Section 12 - Private Landscape Improvements (HOA Landscaping): The Developer shall construct private landscape improvements for the project. The improvements shall be located within common open space areas and landscape easements maintained through the creation of a Political Subdivision such as a Public Improvement District (PID). If a PID or a similar funding mechanism is not created, maintenance shall be the responsibility of a Home Owners Association (HOA). Section 13 - Riahtof-Way and Street Widths: a. Typical pavement sections are shown in Exhibit "C" attached hereto. i. Local residential streets shall be 31 feet of concrete pavement from the back of curb to back of curb with a four inch (4") crown, contained within 50 feet of right-of-way, with stand up curbs. ii. Neighborhood streets shall be 37 feet of concrete pavement from back of curb to back of curb with a four inch (41 crown, contained within 60 feet of right-of-way. iii. Minor collector streets shall be 49 feet of concrete pavement from the back of curb to back of curb with a five inch (5") crown, contained within 60 feet of right-of-way. iv. Major collector streets shall be 120 feet of the right-of-way with two (2) - 25.0 foot back of curb to back of curb concrete roadways. v. Alleys in the development shall be 15 feet of concrete pavement from edge to edge with a six inch (6") invert, contained within 20 feet of right-of-way. b. The City and the developer understand that: (1) approval of the concept plan is only partial because the City does not approve the current street layout; (2) approval of the concept plan entirety is dependent on the City's approval of an alternate street layout and any other changes to the concept plan; and (3) failure to obtain the City's approval of any part of the concept plan is the same as a rejection of the concept plan. Section 14 - Amendment: The offiaal Zoning Map of the City of Anna shall be amended to reflect the change in zoning described herein. Section 15 - Repealer. All ordinances of the City of Anna in conflict with the provisions of this ordinance are repealed to the extent of that conflict. Section 16 — Effective Date: This ordinance shall take effect immediately from and after its passage as the law in such case provides.
