MINUTES
SPECIAL CITY COUNCIL MEETING
JANUARY 28, 2003, CITY HALL
The City Council of the City of Anna met in Special Session at 7:00 p.m., Tuesday, January 28,
2003, at the Anna City Hall, 101 N. Powell Parkway, to consider the following items:
Call to Order.
The Mayor called the meeting to order at 7:48 p.m.
2. Roll Call and Establishment of Quorum.
The following members were present and participating: Mayor Ron Ferguson, Mayor
Pro -Tem Mark Montgomery, Councilman J. W. Finley, Jr., Councilman John Geren, and
Councilman Lynn Mosier -(arrived at 7:48 to make a quorum), Absent from the meeting:
Councilman Lynn Dhane
3. Consider citizen comments and presentations.
None
4. Staff reports and items for discussion.
Administrator Lawrence reminded the Council of the training session on basics on impact
fees for the four cities in the Alliance. All members are requested to attend if possible.
Public Hearing: Petition by Clyde R. Askew and Dorothy Askew to annex 39.9944 acre
tract in the Grandison Stark Survey, Abstract No. 798.
Mayor opened the public hearing at 7:50 p.m. The owner's representative asks for the
annexation to be subject to approval of the zoning requested on the property. No
comments from the general public. The hearing was closed at 7:53 p.m.
Public Hearing: Petition by Tommy Tompkins to annex 24.69 acre tract in the J. C.
Farris Survey, Abstract No. 331.
Mayor opened the public hearing at 7:53 p.m. Mr. Tompkins requested the property be
annexed. No comment from the public. Hearing was closed at 7:54 p.m.

7. Public Hearing: The City of Anna will hold a public hearing to consider the submission
of an application to the Texas Parks and Wildlife Department for grant funds to support
the development of a community park.
Mayor opened the public hearing at 7.55 p.m. Administrator Lawrence explained the
park project and budget to the council and public. No comment from the public. The
public hearing was closed at 8:00 p.m.
Consider resolution authorizing the submission of an application to the Texas Parks &
Wildlife Department for financial assistance to develop/construct park, recreation, and
open space facilities.
Councilman Finley moved to adopt a resolution to authorize the submission of the
application to the Texas Parks and Wildlife Department. Councilman Mosier seconded
the motion.

9. Consider action as desired by council regarding position of Building Official and/or Code
Enforcement Officer (item requested by Mr. Ricky Gillean).
Councilman Finley moved to table the item. Councilman Geren seconded the motion.

10. Consider action to authorize Mayor to sign Inter -Jurisdictional Mutual Aid Agreement
between City of Anna and Collin County and all municipalities located within Collin
County.
Councilman Finley moved to authorize the Mayor to sign the agreement. Councilman
Mosier seconded the motion.

11. Consider action creating position of Building Official/Code Enforcement Officer.
This item was not considered by the Council
12. Consider recommendation of Planning and Zoning Commission regarding preliminary
plat of a 57.23 acre tract in the J. C. Farris Survey, Abstract No. 331, Collin County
Texas, owner represented by Tommy Tompkins, located on the north side of W. White
Street on the west side of Slater Creek.
Councilman Finley moved to approve the recommendation of the Planning & Zoning
Commission with the front yard setbacks at 25 feet with streets H, A, J, and F being 31
feet back to back other streets being 27 feet back to back and add the cul-de-sac on the
north east street. Mayor Pro -Tem Montgomery seconded the motion.

13. Consider request for annexation of A 96.085 acre tract in the Thomas Rattan Survey,
Abstract No. 782, and the Henry Smith Survey, Abstract No. 823, owner being Soon
Chee, located on the north side of CR 367 east of S. Central Expressway on the east side
of Throckmorton Creek.
Mayor Pro -Tem Montgomery moved to adopt an ordinance annexing the 96.085 acre
tract owned by Soon Chee. Councilman Finley seconded the motion.

14. Consider request for zoning of 96.085 acre tract in the Thomas Rattan Survey, Abstract
No. 782, and the Henry Smith Survey, Abstract No. 823, owner being Soon Chee, located
on the north side of CR 367 east of S. Central Expressway on the east side of
Throckmorton Creek.
Mayor Pro -Tem Montgomery moved to approve the planned development zoning
ordinance with two 37 foot collector streets, 25 foot minimum front setbacks, 15 side
setbacks on corner lots, 5 foot side setbacks on other side setbacks, 15 foot rear setbacks,
and minimum. 6,000 square foot lots, to allow the cement fiber siding to be used to meet
the masonry requirements unless any structure uses brick or stone as masonry, the first
floor of the corner lots will be 100% brick or stone on the front and corner side and to
wrap the comer of the inside a minimum or two feet and other lots front brick or stone
with the two foot wrap on each side. Councilman Finley seconded the motion.

15. Consider recommendation of Public Works Director regarding revisions of Personnel
Policies Manual.
Mayor Pro -Tem Montgomery moved to approve option one as presented to the council
that would make holidays be considered as worked hours and be paid at 1 °/2 times regular
pay for holidays and other sections of the FLEA remain in effect without changes.

16. Consider Ordinance amending water service rates and charges for deposits on fireplug
meters.
Councilman Mosier moved to adopt an ordinance setting the deposit for a fire plug meter
at $1,500.00. Mayor Pro -Tem Montgomery seconded the motion.

17. Consider resolution urging the Texas congressional delegation to support funding of $3.5
billion first responder initiative during 108`'" Session of Congress (Texas Municipal
League).
Mayor Pro -Tem Montgomery moved to adopt a resolution urging the Texas
congressional delegation to support funding of $3.5 billion first responder initiative.
Councilman Finley seconded the motion..

18. Consider revision of employment agreement with Lee Lawrence (relative to Texas
Municipal Retirement System).
Administrator Lawrence requested the council to release him for the contract with the
city and make him a regular exempt employee as Administrator with a four day work
week as was provided in his contract. Administrator Lawrence agreed to waive the out
section of his contract. This will allow the Administrator to join the Texas Municipal
Retirement System.
Councilman Finley moved to grant the request and place the Administrator on as a
regular employee. Councilman Mosier seconded the motion.
