HomeMy WebLinkAbout2003-02-11 Regular Meeting MinutesCITY OF ANNA MINUTES REGULAR CITY COUNCIL MEETING FEBRUARY 11, 2003, CITY HALL The City Council of the City of Anna met in Regular Session at 7:30 p.m., Tuesday, February 11, 2003, at the Anna City Hall, 101 N. Powell Parkway, to consider the following items: Call to Order. The meeting was called to order at 7:34 P.M. 2. Roll Call and Establishment of Quorum. The following members were present and participating: Mayor Ron Ferguson, Mayor Pro -Tem Mark Montgomery, Councilman J. W. Finley, Jr., Councilman Lynn Dhane, Councilman Lynn Mosier and Councilman John Geren Consider citizen comments and presentations. Thomas and Kathryn Jones presented complaints about Edwards Street needing repairs. Complaints about brush piles and junk near the Ag Barn and the lot north of the football field. Area needs more street lights. Area is not being mowed near and including the railroad tracks. 4. Staff reports and items for discussion. Administrator Lawrence presented information to the council about State Legislative bills regarding annexation and concerns expressed by the Texas Municipal League on the bill. The City has issued 42 single family building permits to date. At this rate the city is looking at 350 building permits in the year. The next agenda will include hiring a building inspector. Consider Ordinance annexing 39.9944 acre tract in the Grandison Stark Survey, Abstract No. 798, owned by Clyde R. Askew and Dorothy Askew, on petition of property owner. There has been two public hearing on the requested annexation. The property is located on the North East corner of Highway 5 and County Road 421. The owner has requested annexation of the property conditional on receiving the zoning on the property and the zoning will be on the next month's agenda.. Mayor Pro -Tem Montgomery moved to table the annexation until next month's meeting. Councilman Mosier seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 6. Consider Ordinance annexing 24.69 acre tract in the J. C. Farris Survey, Abstract No. 331, owned by Tommy Tompkins, on petition of property owner. 02-11-03 Council Minutes-Regular.doc Page 1 of 5 01/14/2003 There have been two public hearing on the annexation. The engineering firm presented information on the property. There was concern expressed by the engineer that the preliminary plat would not be approved until the next council meeting. The Mayor advised he was not in favor of annexing property contingent on the developer getting everything they want. The engineer advised they wanted to go ahead with the annexation at this time. Councilman Finley moved to approve the annexation ordinance without any conditions. Councilman Mosier seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried Consider Ordinance establishing Planned Development zoning for 24.69 acre tract in the J. C. Farris Survey, Abstract No. 331, owned by Tommy Tompkins, on recommendation of Planning and Zoning Commission. The engineer for the developers went over the ordinance item by item with discussion on what was requested and recommended by the Planning and Zoning Commission. There was considerable discussion on the recommendation by the P & Z that the property bordering FM 455 be zoned as residential and that cement fiber siding not be used to meet the 70% masonry requirements. Councilman Finley moved to approve the ordinance as recommended by the P & Z and submitted to the council by the administrator with strike outs omitted and new language added with exceptions to add to minimum dwelling area 1,240 square feet and to add the original language requested for the maximum height. Mayor Pro -Tem Montgomery seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried Consider recommendation of Planning and Zoning Commission regarding preliminary plat for 24.69 acre tract in the J. C. Farris Survey, Abstract No. 331. Item was dropped from the agenda with no action taken by the Council. 9a. Consider action on a resolution setting date, time, and place for public hearings on annexation of 115 acre Harow Texas Property Trust tract. Councilman Finley moved to accept the request for annexation and approve the resolution setting the time and dates for the public hearings and publication of the public notices. Councilman Dhane seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 9b. Consider action on resolution setting date, time, and place for public hearings on annexation of 157.844 acre tract in F. T. Duffau Survey (Rudman Partnership) tract. 02-11-03 Council Minutes-Regular.doc Page 2 of 5 02111/2003 Councilman Mosier moved to accept the request for annexation and approve the resolution setting the time and dates for the public hearings and publication of the public notices. Councilman Dhane seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 10. Consider recommendation of Planning and Zoning Commission regarding preliminary plat for 100 acre tract located on north side of W. White Street (FM 455) on west side of U. S. Highway 75 (Mr. Don Collins). Approval is being requested and recommended by the Traffic Engineer with the understanding there are some outstanding questions about the ultimate configuration and location of some of the collector streets in the subdivision when the T1A is completed for the larger area. Councilman Finley moved to approve the preliminary plat for 100 acre tract. Councilman Geren seconded the motion.. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 11. Consider recommendation of Planning and Zoning Commission regarding zoning for William Weaver tract on W. White Street (FM 455) on west side of U. S. Highway 75 and east side of Hurricane Creek (Mr. Ikon Collins). The developer agreed to only consider the residential parts of the ordinance and the multifamily and commercial be considered in another ordinance after additional discussion. The residential park of the tract is 269 acres. The Engineer for the developer covered the ordinance item by item Mayor Pro -Tem Montgomery moved to approve the zoning as presented with a minimum of 15' on side setbacks on corner lots and 25' front setback in the ordinance. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 12. Consider action on ordinance adopting landscape regulations. The Planning and Zoning Commission has requested the council to consider adopting landscape regulations that were modeled after the McKinney regulations. They would go into effect after publication. Councilman Finley moved to adopt the Landscape Regulation Ordinance as recommended by the Planning and Zoning Commission. Councilman Dhane seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 13. Consider actions and ordinances regarding health insurance proposal by Texas Municipal League. 02-11-03 Council Minutes-Regular.doc Page 3 of 5 02/11/2003 Pat Doyle with the Texas Municipal League Employee Benefits fool presented information on the plans available for the City including cost. Assistant Administrator Cummings presented a recommendation for a plan for the city. The ordinances and forms to join the pool were discussed. Changing from the current coverage would save up to a $1,000.00 per month for the total insurance cost. Councilman Mosier moved to table action on this item until the next meeting to give the council more time to look over the options and for a recommendation from the staff. Councilman Finley seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 14. Consider ordinance adopting Code of Ethics. Administrator Lawrence recommended that the ordinance be reviewed by the City Attorney before any action by the Council. Councilman Mosier moved to table the ordinance. Councilman Dhane seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 15. Mayor and City Council orders General Election for May 3, 2003, to elect a Mayor and Two City Council Members. Councilman Finley moved to adopt an ordinance calling for the Anna General Election on May 3, 2003, to elect a Mayor and two Council Members and to pay the election officials the same as paid last year. Councilman Dhane seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 16. Consider adoption of Board/Commission Handbook. Administrator Lawrence recommended that the handbook be reviewed by the City Attorney before any action by the Council. Councilman Mosier moved to table the ordinance. Councilman Dhane seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 17. Consider approval of Minutes of meetings of January 14 and January 28, 2003. Councilman Finley moved to approve the minutes for January 14 and January 28, 2003 as corrected. Councilman Dhane seconded the motion. 5 Aye 0 Nay 0 Abstain Unanimous Motion Carried 18.
