HomeMy WebLinkAboutOrd 316-2007 Amending Ordinance 61-2003 Retiree Benefits.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 316-2007 AN ORDINANCE OF THE CITY OF ANNA, TEXAS AMENDING ORDINANCE NO. 61- 2003 REGARDING THE CITY'S PROVISION OF CERTAIN RETIREE BENEFITS THROUGH THE TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL EMPLOYEE BENEFITS POOL TO UPDATE SAID ORDINANCE BASED ON CURRENT INTERLOCAL AGREEMENT. WHEREAS, the City Council finds that Ordinance No. 61-2003 should be amended to update said ordinance so that it is consistent with the current Interlocal Agreement under which City of Anna retirees are provided with health insurance benefits. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. Recitals Incorporated The foregoing recitals are incorporated herein as if set forth in full and constitute factual findings of the City Council. Section 2. Amendment to Section 3 of Ordinance No. 61-2003. Section 3 of Ordinance No. 61-2003 is deleted in its entirety and replaced with the following: "The City defines retirees as: Any employee that is eligible to retire under the Texas Municipal Retirement System with 5 years of service at age 60 or 20 years of service at any age. - Section 3. Amendment to Section 4 of Ordinance No. 61-2003. The three bulleted benefit plans listed in Section 4 of Ordinance No. 61-2003 are deleted and replaced with the following six benefit plans: • The same medical plan(s) offered to active employees • Dental Plan Ill • Vision Plan B • Retiree Life • Retiree Optional Life • Retiree Continuum of Care Plan for Early Retirees, >65 retirees not entitled to Medicare and Medicare Supplement program for>65 retirees Cm OF ANNA, TEXAS ORDNANCE NO. Pape I of 2 Section 4. Amendment to Section 5 of Ordinance No. 61-2003. In the second sentence of Section 5 of Ordinance No. 61-2003, the text "150% of the active employee contribution" is deleted and replaced with the following: "equal to the percentage of contribution that is established annually by TML IEBP". In the third sentence of Section 5 of Ordinance No. 61-2003, the text "150% of the active employee contribution" is deleted and replaced with the following: "equal to the percentage of contribution that is established annually by TML IEBP". Section 5. Repeat Provision All parts of any other ordinance in conflict with the provisions of this Ordinance are to the extent of such conflict hereby repealed. Section 6. Severance If any part of this Ordinance is for any reason found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, all other parts nevertheless shall remain valid, legal, and enforceable. Section 7. Effective Date This Ordinance shall be effective upon the posting and/or publication of its caption as required by law and the City Secretary is hereby directed to implement such posting and/or publication.
