HomeMy WebLinkAboutOrd 330-2007 Repealing Ord. 2002-14 Creating the Anna Parks and Rec Advisory Board.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 330-2007 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, REPEALING ORDINANCE 2002- 14; CREATING THE ANNA PARKS AND RECREATION ADVISORY BOARD; ESTABLISHING PROCEDURES FOR APPOINTMENT AND REMOVAL OF MEMBERS; ESTABLISHING DUTIES AND RESPONSIBILITIES OF THE COMMISSION; PROVIDING A REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Anna has determined that there exists a need in the City for services related to park, recreation, and open space activities and facilities; and WHEREAS, the City Council has determined that the Creation of a parks and recreation advisory board will assist the City in its efforts to Create an effective parks, recreation, and open space program; and WHEREAS, the City Council of the City of Anna believes that the adoption and enforcement of these regulations will significantly increase and enhance the quality of fife for residents of the City, now therefore; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. Board Created. The Anna Parks and Recreation Advisory Board ("Commission") is hereby created. Section 2. Membership; Organbatfon: Compensation. 2.01 Membership. The Commission shall consist of five members who are residents of the City of Anna. Members are appointed by the City Council for a term of two years, but serve strictly at the pleasure of the City Council, who may remove any member at any time with or without cause. Vacancies shall be filled for the unexpired term of any member whose place becomes vacant for any cause in the same manner as the original appointment was made. The terms of members filling places 1, 3, and 5 shall expire on May 31 of each odd - numbered year and the terms of members filling places 2 and 4 shall expire on May 31 Ord No. 3342007 RepwWV Ord No 2002-24 and Creating Parks & Rec Advisory Board 06-26-07 of each even -numbered year. Commission members may be appointed to succeed themselves, and if a Commission member shall continue to serve after the expiration of the member's tens unfit the Council removes the member or appoints a succeeding member. Newly -appointed members shall be installed at the first Commission meeting after their appointment. 2.02 Organization. The Commission shall hold an organizational meeting in July of each year. The Commission shall adopt its own rules of procedure and keep a record of its proceedings consistent with the provisions of this Ordinance and the requirements of law. The Commission shall elect a chairperson and vice chairperson from its own membership at its annual organizational meeting. Meetings of the Commission may be held at the call of the chair, or in his/her absence, the vice -chair. The Commission shall keep minutes of its proceedings, showing the vote of each member upon each question or, if absent or failing to vote, indicating such fad. The minutes shall become official records of the City upon approval of the minutes by the City Council. A quorum for the conduct of business shall consist of three members of the Commission. 2.03 Compensation. Members shall serve without compensation, except for reimbursement of authorized expenses attendant to the performance of their duties. Section 3. Duties and Responsibilities. The Commission is purely an advisory board with no decision-making or policy-making authority, and any action or omission by the Commission is not binding on the City. The Commission is hereby charged with the duties and responsibilities to: (1) provide recommendations to the City Council and City staff as requested from time to time in matters relating to the Citys parks and recreation activities and facilities; and (2) Assist in the promotion of park -related programs and encourage donations of land, equipment, and resources in support of parks and recreation activities. Section 4. Repeal Clause. All parts of any ordinance in conflict with the provisions of this Ordinance are to the extent of such conflict hereby repealed.
