ORDINANCE NO. M8-2007
AN ORDINANCE OF THE CITY OF ANNM TEXAS, DENYING ATMOS
ENERGY CORP., MID-TEX DIVISION'S REQUEST FOR AN ANNUAL
GAS RELIABIPTY INFRASTRUCTURE PROGRAM RATE
ADJUSTMENT IN THIS MUNICIPALITY SO THAT THE COMPANY
MAY PURSUE A SYSTEM WIDE ANNUAL GAS RELIABILITY
INFRASTRUCTURE PROGRAM RATE AD.111STMENT WITH THE
RAILROAD COMMISSION OF TEXAS; PROVIDING AN EFFECTTV
DATE; FENDING THAT TTIE MEETING AT WHICH THIS ORDINANCE
IS PASSED IS OPEN TO TIIE PUBLIC AS REQUIRED BY LAW; AND
PROVIDING FOR NOTICE OF THIS ORDINANCE TO ATMOS
ENERGY CORP., MID-TEX DIVISION.
NVUEREAS, Autos Energy Corp., MidTexDivision (the "Company') opastes
the distributive system servingthe City, and;
WHEREAS, w or about May 31, 2007, the Company Elect with the City Of
Aute, Texas (the "City"), a request for an annual gas reliability irlfraarcucwre program
rate adjourned: for customers on the Company's system -wide distribution system, to be
effective w July 30, 2009; and
WHEREAS, the City has Original jurisdiction to evaluate Om Company's request
as it pertains to customers of the Company served from the distribution facilities located
wlthm the City, pursuant to Texas Utilities Code §§ 102.001(b) and 103.001;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL, OF
ANNA, TEXAS:
SECTION 1. Tbat the Company's reglust for an normal gas reliability
infreavmcmre pro®am rote adjustmwt with respect to customers saved from Ne
Company's distribution facilities loce[N inside the City, as pmt of the Company's
system -wide gas utility system, is denied in all respects.
SECTION L That this Onduran a shall become efle chve immediately from and
after its passage, as the law and charter in such cases provide.
SECTION 3. That it is hereby officially found and detnmiued that the meeting
at wbich Oris Ordinance is passed is open to the public as requhd by law and the public
notice Of the rime, place, and purpose of said mmtivg was given as required.
SECTION 4. Tbat a copy of Ons Ordinance constituting final action on the
Company's rcluest for an arcual gas reliability io&natruwne program rate adjusboent,
shall be forwarded to fie Company's designated representative within IO days at dor
following address: Cbmles Yarbrough, Atmos Energy Corp., Mid -Tex Division, 5420
