HomeMy WebLinkAbout2003-04-22 Regular Meeting MinutesCITY OF ANNA MINUTES REGULAR CITY COUNCIL MEETING APRIL 22, 2003 7;30 PM, CITY HALL The City Council of the City of Anna met in Regular Session at 7:30 p.m., Tuesday, April 22, 2003, at the Anna City Hall, 101 N. Powell Parkway, and considered the following items: The City Council held two public hearing on annexations before the scheduled meeting on the following tracts at 7:34 p.m.; (1) 116 acre Harow Texas Property Trust tract and (2) 157.844 acre tract in F. T. Duffau Survey (Rudman Partnership) tract. There were no comments by the public on the hearings. Closed at 7:38 p.m. 1. Call to Order. The Mayor called the meeting to order at 7:38 p.m. 2. Roll Call and Establishment of Quorum. The following members were present and participating: Mayor Ronald R. Ferguson, Mayor Pro -Tem Mark Montgomery, Councilman J. W. Finley, Jr., Councilman John Geren, and Councilman Lynn Mosier. Councilman Lynn Dhane. The following members were absent: Councilman Lynn Dhane. Staff reports and items for discussion. No staff report, information provided in packet. 4. EXECUTIVE SESSION: Under terms of Chapter 551 of Texas Government Code the City Council may enter into CLOSED SESSION or Executive Session to discuss the following: Councilman Mosier moved to go into closed session. Councilman Finley seconded the motion 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried at 7:42 p.m. A. To consult with legal counsel regarding pending or contemplated litigation and/or other legal matters. (Government Code, Chapter 551.071) B. To discuss purchase of real estate and/or easement(s). (Government Code, Chapter 551.072) This item was not discussed in closed session. Consider and act upon items listed under item 4 Executive Session, as necessary. A. Consider action regarding final plat for Willow Creek Addition, Phase 1. Councilman Finley moved to allow lay down curbs in phase one of the Willow Creek Subdivision. Mayor Pro -Tem Montgomery seconded the motion. 3 Aye 1 May 0 Abstain (Mosier Nay) Motion Carried B. Consider action regarding purchase of real estate and/or casement(s). Bill Richardson, City Attorney, explained to the council the steps for the council to acquire easements through a reasonable offer to the owner and the procedures of condemnation if the owner will not accept the reasonable offer when there is a public necessity for the easement. No action was taken by the council_ 6. Consider action regarding Code of Ethics. Councilman Mosier moved to table the Code of Ethics. Mayor Pro -Tem Montgomery seconded the motion. 3 Aye 1 Nay 0 Abstain (Finley Nay) Motion Carried 7. Consider action regarding Board and Commission Handbook. Councilman Geren moved to approve the Commission Handbook. Councilman Finley seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 8. Consideration of approval of audit. Councilman Finley moved to approve the 2001-2002 Audit. Mayor Pro -Tem Montgomery seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 9. Consider action to authorize city auditor to conduct interim financial report pursuant to changing financial accounting system. The Administrator and City Secretary explained how an interim financial report would be helpful in converting the City's financial system over to new software. Consider contract with Morris Engineers for basic engineering services, including development of plans and specifications, relating to water well, 300,000 gallon ground storage tank, and high service pumps at CR 370 water plant. Councilman Finley moved to approve a contract with Morris Engineers for engineering services on a water well project including Woodbine well, pump station and booster pumps. Mayor Pro -Tem Montgomery seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 11. Consider action on ordinance adopting regulations on outdoor sprinkler systems. Councilman Finley moved to approve an ordinance regulation outdoor sprinkler systems and regulations on outside watering. Councilman Geren seconded the motion 3 Aye 2 Nay 0 Abstain (Mosier and Montgomery Nay, Mayor Ferguson Aye) Motion Carried 12. Consider action on ordinance designating a section of the west side of S. Sherley Street between W. White Street and E. 8th Street as a No Parking zone. The Anna ISD requested that the west side of S. Sherley Street in front of the elementary school be restricted as a No Parking area. Councilman Finley moved to approve an ordinance making the area in front of the elementary school on the west side of S. Sherley a no parking zone. Mayor Pro -Tem Montgomery seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 13. Consider action on ordinance establishing building, mechanical, plumbing, and electrical permit fees. Administrator Lawrence explained that Ty Chapman, Building Official, has recommended an ordinance changing the method of calculating residential building permits from a building value method to a square foot method. This would cause a small increase in permit fees for larger residential buildings. Mayor Fro -Tem Montgomery moved to approve the ordinance setting the fees and method for calculation of residential building permits. Councilman Finley seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 14. Consider action on ordinance requiring registration of building contractors and setting registration/permit fees. Administrator Lawrence explained that Ty Chapman, Building Official, has recommended an ordinance requiring that building contractors register with the City. Mayor Pro -Tem Montgomery moved to adopt the ordinance with the addition of roofing and fence contractors and authorizing the Building Official to set a reasonable amount for the Insurance/Bond requirement. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 15. Consider resolution opposing House Bill 2178 relating to zoning authority of municipalities_ Councilman Mosier moved to approve the resolution opposing HB 3178 on zoning. Mayor Pro -Tem Montgomery seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 16. Consider resolution opposing reduction in state funding of the Texas Parks and Wildlife Department local parks program contained in C.S.H.B 1. Mayor Pro -Tem Montgomery moved to approve the resolution opposing reduction in funds for Texas Parks & Wildlife local park funding. Councilman Mosier seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 17. Consider resolution opposing Article 5 of House Bill 1606 relating to financial disclosure for city officials. Mayor Pro -Tem Montgomery moved to approve the resolution opposing Article 5 of HB 1606 relating to financial disclosure. Councilman Mosier seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 18. Consider resolution opposing House Bill 568 relating to municipal annexation policies. Councilman Mosier moved to approve the resolution opposing HB 568 relating to municipal annexation. Mayor Pro -Tem Montgomery seconded the motion. 4 Aye 0 Nay 0 Abstain Unanimous Motion Carried 19. Consider action on revision of water and/or sanitary sewer rates. The Council discussed water and sewer rates but no official action was taken. 20. Workshop: Development standards.
