ORDINANCE NO. 391-2008
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING ORDINANCE NO.
384-2008 ESTABLISHING THE AUTHORITY OF THE CITY MANAGER TO
APPROVE CONTRACT CHANGE ORDERS; PROVIDING FOR A REPEAL CLAUSE;
PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Anna, Texas ("the City") has previously adopted Ordinance
384-2008 which established the authority of the City Manager to approve certain
contracts; and
WHEREAS, the City of Anna, Texas City Council ("City Council") has determined
that it is in the best interest of the City to establish the authority of the City Manager
to approve contract change orders;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Amendment
Section 2 of Ordinance No. 384-2008 is hereby amended to include only the following
subsections (a) and (b):
(a) In accordance with City of Anna Home -Rule Charter, Section 7.15, the City Manager is
hereby generally authorized to contract for expenditures without further approval of the City
Council for all budgeted items provided that the total amount of such contract and any
change orders that are approved by the City Manager do not exceed $50,000. If a change
order under this subsection would make the total contract amount more than $50,000, then
the change order must be expressly approved in advance by the City Council.
(b) All contracts for expenditures or purchases involving more than $50,000 must be expressly
approved in advance by the City Council. However, the City Manager is authorized to
approve change orders without further approval of the City Council when the original amount
of the contract is more than $50,000 provided that the total amount of such change orders do
not: (1) increase the amount of the original contract by more than 10%; or (2) increase or
decrease the contract amount by more than $25,000.
Section 2. Repeal Clause
This ordinance shall be cumulative of all provisions and ordinances of the Anna
Code of Ordinances, as amended, except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances and such Code, in which
event the conflicting provisions of such ordinances and such Code are hereby
repealed.

Section 3. Savings Clause
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs or sections of this ordinance, since the same would

This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, if required by law.
PASSED by the City Council of the City of Anna, Texas, on this the 8th day of July,
