ORDINANCE NO. 409-2008
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE CITY OF ANNA
PERSONNEL POLICY MANUAL UNUSED VACATION LEAVE POLICY AND
ACCURAL OF SICK LEAVE POLICY.
WHEREAS, the City of Anna, Texas ("the City") has previously adopted the City of
Anna Personnel Policy Manual ("the Manual"), which sets polices on unused
vacation leave and accrual of sick leave; and
WHEREAS, the City of Anna, Texas City Council ("City Council") has determined
that the Manual is in need of updating; and
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Amendment to Personnel Policy Manual
Section 7.03(d) of the Manual is hereby amended to read as follows
7.03 Vacation Leave
(d) Unused Vacation Leave. Employees are expected to use at least one week of vacation
leave each year starting in the second calendar year of employment. Unused vacation
leave of no more than 240 hours may be carried over for the next calendar year. At the
end of January, any accrued vacation hours in excess of 240 hours (excluding hours
accrued in January) are reduced to 240 hours. No advance of unearned vacation leave
will be made for any reason. (Example: An employee is hired in March of the calendar
year. He may carry any part of his vacation accrued into the next calendar year. In his
second calendar year the employee must take at least one week (40 hours for 8 hour shift
employees or 42 hours for 12 hour shift employees). Any vacation not used by the end of
January of his third calendar year will be reduced to the maximum of 240 hours. The
reduction in hours shall be at the end of January but the new hours accrued in January
shall not be included in any reduction of hours.)
Section 7.04(d) of the Manual is hereby amended to read as follows:
7.04 Sick Leave
(d) Accrual of Sick Leave. Sick leave for employees other than police officers that work 12 -
hour shifts is accumulated on the basis of one day of sick leave per month of employment
(3.69 tours per pay period). Employees accrue sick leave starting with the first full pay
period but in accordance with Section 2.04 herein, are not eligible for sick leave unfit they
complete the first 3 months of employment unless authorized by the City Manager.

Sick leave for police officers that work 12 -hour shifts is accumulated on the basis of eight
hours of sick leave per month of employment (3.87 hours per pay period). Employees
accrue sick leave starting with the first full pay period but in accordance with Section 2.04
herein, are not eligible for sick leave unfil they complete the first 3 months of employment
unless authorized by the City Manager.
Section 2. Repeal Clause
This ordinance shall be cumulative of all provisions and ordinances of the Anna Code
of Ordinances, as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such Code, in which event
the conflicting provisions of such ordinances and such Code are hereby repealed.
Section 3. Savings Clause
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs or sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
Section 4. Effective Date
This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, if required by law.
