AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CODE OF
ORDINANCES BY AMENDING PART II, ARTICLE 49, SECTION 7.14(f) AND
AMENDING PART IV, FEE SCHEDULE, ARTICLE VII, SECTION 8 (7), REGARDING
THE WATER RATE FOR FORMER CUSTOMERS OF SOUTH GRAYSON WATER
SUPPLY CORPORATION; ESTABLISHING A REPEAL CLAUSE; ESTABLISHING A
SAVINGS CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE
WHEREAS, the City of Anna, Texas ("the City") has previously adopted a policy
regulating water use and fees relating to former water customers of the South
Grayson Water Supply Corporation; and
WHEREAS, the City of Anna, Texas City Council ("City Council") now desires to
amend said policy to extend. the dates under which the policy remains in effect.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Amendment
In accordance with Part II, Section 9 of City of Anna Code of Ordinances, the following
amendments are made to Part II, Article 49, Section 7.14(f) and Part IV, Fee Schedule,
Article VII, Section 8 (7) is adopted as follows:
Former customers of the South Grayson Water Supply Corporation who are now
customers of the City of Anna utility system are considered a separate category of
customers. Each customer in this category shall pay a minimum charge of $17.50 plus
a usage charge of $2.00 for each 1,000 gallons of water used between 0 and 10,000
gallons, $3.00 for each 1,000 gallons of water used between 10,001 and 15,000
gallons, $4.00 for each 1,000 gallons of water used between 15,001 and 20,000
gallons, and $6.00 for each 1,000 gallons of water used in excess of 20,000 gallons.
Such rate shall be in effect through januaw 31, 2009.-February 28, 2009 After daauar
31, 2099 February 28, 2009, the rate for said customers shall be the same as for other
customers of the Anna utility system, unless otherwise modified by action of the City
Council.
Section 2. Repeal Clause
This ordinance shall be cumulative of all provisions and ordinances of the Anna Code
of Ordinances, as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such Code, in which event
the conflicting provisions of such ordinances and such Code are hereby repealed.

Section 3. Savings- Clause
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs or sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
Section 4. Effective Date
This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, if required by law, of its caption and the City Secretary is
hereby directed to implement such posting and/or publication.
PASSED by the City Council of the City of Anna, Texas, by the following vote on this
the 27th day of January, 2009.
