AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS, CALLING A SPECIAL ELECTION FOR SEPTEMBER 14, 2009,
TO ELECT ONE COUNCIL MEMBER TO FILL THE UNEXPIRED TERM
CREATED BY THE VACANCY IN THE OFFICE OF COUNCIL MEMBER
PLACE 4; DESIGNATING POLLING PLACE; APPOINTING THE EARLY
VOTING CLERK; AND PROVIDING FOR NOTICE AND PUBLICATION
OF THE ELECTION.
WHEREAS, the Texas Constitution and the City of Anna, Texas Home -Rule Charter
("Charter"), as adopted on May 7, 2005, and amended on November 4,
2008, requires that a special election be called and held within 120 days
to fill a vacancy created by a vacancy on the City Council; and,
WHEREAS, City Council Place 4 became vacant when the Place 4 incumbent was
elected and then duly qualified and seated as Mayor of the City of Anna,
Texas on May 18, 2009; and
WHEREAS, the Texas Constitution and the Charter require that one Council member
be elected by the qualified voters for the remainder of the unexpired term
of Council Place 4;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL • THE CITY •
ANNA,TEXAS:
SECTION 1. That a special election is hereby ordered to be held on Monday,
September 14, 2009, between the hours of 7:00 a.m. and 7:00 p.m.
in accordance with the applicable provisions of the Texas Election
Code, and the Charter, as amended.
SECTION 2. That an election be held for the purpose of electing a person to fill
City Council Place 4 for an unexpired term ending on May 10,
2010, as prescribed by the Charter.
SECTION 3. That candidates for City Council Place 4 position may file for the
position beginning immediately after the adoption of this Ordinance
and until 5:00 p.m. on July 9, 2009.
SECTION 4. That the City of Anna City Administration Building, 111 N. Powell
Parkway, Anna, Texas is hereby designated as the early voting
polling place for said election.

SECTION 5. That the City of Anna City Administration Building, 111 N. Powell
Parkway, Anna, Texas is hereby designated as the election day
polling place for said election.
SECTION S. That the method of voting to be used in the special election on
Monday, September 14, 2009, be touch screen devices with
Diebold's ACCUVOTE TS R6v.4.6.4 direct recording devices
(DRE's) for early voting and election day and paper ballots for early
voting by mail.
SECTION 7. That the City of Anna, Texas City Secretary is hereby appointed
Early Voting Clerk for the purpose of conducting early voting for the
special election.
SECTION 8. That early voting by personal appearance be conducted on
weekdays that are not legal holidays beginning Friday, August 28,
2009 and shall close on Thursday, September 10, 2009. During the
lawful early voting by personal appearance period the City
Secretary shall keep the designated early voting polling place open
for early voting as follows:
SECTION 9. That the official canvass, by the City Council, will be held, if
feasible on Tuesday, September 22, 2009 in the Council Chamber,
or another date that is not earlier than the third day after the
election or later than the 1 lih day after the election.
SECTION 10. That this Ordinance shall be published at least one time, not more
than 30 days nor less than 10 days before the election in the
McKinney Courier Gazette.
SECTION 11. That a copy of this Ordinance be posted on the bulletin board used
for posting notices of the meetings of the City Council at least
twenty-one (21) days before election day.
SECTION 12. That a copy of this Ordinance be delivered to the Collin County
Clerk not later than the 60th day before Election Day.

SECTION 13. All election materials shall be printed in both English and Spanish
to the extent required by law.
